Dear Ms. Aungst:
We have reviewed the above referenced Site Specific Development Plan and Use by Special
Review Permit application. The submitted material does not appear to qualify as a "subdivision" as defined
in § 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide comments. The comments will not address the adequacy of the water supply plan
for this property or the ability of the water supply plan to satisfy any County regulations or requirements.
The applicants are seeking a permit to operate a multi-use recreation park including walking,
horseback, and motorcycle tracks near Keenesburg. The parcel is approximately 30 acres and currently has
one single family dwelling and a barn that is sometimes used as an office. The water supply for the
residence is an existing well with permit no. 238055. For special events, bottled water is proposed for public
consumption. Water trucks are to be used for dust suppression weekly or as needed. Portable restrooms
are used to support public use of the site. The recreation park is to have two full time employees.
The existing well is completed in the nontributary Laramie Fox Hills aquifer. It is permitted for the
following uses: ordinary household purposes inside two (2) single family dwellings, the watering of the user's
own non-commercial domestic animals, and the irrigation of not more than 1 acre of home gardens and
lawns. Since the barn is sometimes used as an office and there are two full time employees, the well is
being used for commercial purposes. We require that the well be re-permitted to include commercial uses.
As the well is completed in the nontributary formation, it can be permitted for a range of uses, including
commercial, without a requirement for an augmentation plan. A new non-exempt well permit including
commercial uses would require a flow meter on the well.
We request that the well be re-permitted to include commercial and any other relevant uses needed
to support the recreational park. In addition, water trucks used for dust suppression must obtain the water
from sources permitted for such use. If you or the applicant have any questions in this matter, please
