RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR12-0019, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, INCLUDING
AN OIL AND GAS SUPPORT AND SERVICE FACILITY (OFFICE AND SHOP
BUILDING AND OUTSIDE PARKING, STORAGE AND STAGING AREA FOR
VEHICLES AND EQUIPMENT) IN THE A (AGRICULTURAL) ZONE DISTRICT - C&M
RODRIGUEZ SERVICES, INC.
A public hearing was conducted on July 18, 2012, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 12, 2012, and duly published June 20,
2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of C&M
Rodriguez Services, Inc., for a Site Specific Development Plan and Use by Special Review
Permit, USR12-0019, for Mineral Resource Development Facilities, including an Oil and Gas
Support and Service Facility (office and shop building and outside parking, storage and staging
area for vehicles and equipment) in the A (Agricultural) Zone District. Brad Yatabe, Assistant
County Attorney, made this a matter of record.
El Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal, entered the favorable recommendation of the Planning Commission into the record as
written, and gave a brief description of the location of the site. He reviewed the referral
responses and surrounding uses, and stated staff received one letter from a surrounding
property owner inquiring about screening of storage. He stated the applicant has already
completed the necessary screening and the Development Standards address noise and lighting.
He also reviewed the referral from the Colorado Department of Transportation (CDOT) for the
record and displayed a site map and photographs of the site and surrounding area.
El Don Carroll, Department of Public Works, reviewed the access, road classification, traffic
count, road improvement requirements, dust mitigation, water quality feature, and CDOT
requirements. He addressed questions from the Board and explained, although there is no

current traffic count for the area, dust abatement will be applied in front of two or three homes
based on anticipated traffic generated by the site.
ID Mary Evett, Department of Public Health and Environment, stated the applicant was
approved for a Commercial septic permit in June, 2012, and the State has approved the
Commercial well permit, therefore, Condition of Approval #1.C has been met. She stated the
applicant has also submitted Dust Abatement and Waste Handling Plans. She further stated
the applicant intends to do vehicle maintenance in the shop and the Waste Handling Plan
addresses the requirement for a floor drain and vault to capture fluids.
e In response to Commissioner Kirkmeyer, Mr. Gathman reviewed staff's requirements for
screening under Condition of Approval #1.A.7 and Development Standard #32.
El Tim Naylor, AGPROfessionals, LLC, represented the applicant and reviewed the proposed
site operations and haul route for the record. He reiterated they have been approved for both a
commercial well and commercial septic system for the office building and shop for Phase 1, as
well as the second shop in Phase 2. He stated the facility is situated to accommodate oil and
gas operations in the area and they are in the process of negotiating a Surface Use Agreement.
In response to questions from the Board, Mr. Naylor clarified the old site was leased and the
applicant intends to relocate their entire operation to the new facility.
ID No public testimony was offered concerning this matter. Mr. Naylor confirmed 120 days is
adequate time to record the plat, and the applicant is also in agreement with the proposed hours
of operation and number of employees. In response to questions from the Board, Mr. Carroll
explained the dust abatement is only intended to be applied in front of the nearby residences
once or twice a year. Mr. Naylor clarified the operation will only be utilizing 1.5-ton pickup trucks
transporting the roust-a-bout equipment; there will be no semi trailers. Commissioner
Rademacher proposed deleting the dust abatement requirement unless warranted by traffic
counts, and Commissioner Kirkmeyer agreed and suggested the specific houses be identified in
the Improvements Agreement along CR 25 if the operation exceeds 200 trips. Following
discussion, the Board agreed to delete the last two sentences of Condition of Approval #1.F,
with instruction to staff to abide by the 200-trip trigger criteria for requiring dust abatement.
Following discussion regarding the location of a nearby tank battery, the Board agreed to modify
Development Standard #32 to state, "The existing on-site screening shall be maintained." In
response to Chair Conway, Mr. Naylor stated he and the applicant have reviewed, and agree to
abide by, the Conditions of Approval and Development Standards, as proposed and modified.
El Commissioner Garcia moved to approve the request of C&M Rodriguez Services, Inc., for
a Site Specific Development Plan and Use by Special Review Permit, USR12-0019, for Mineral
Resource Development Facilities, including and Oil and Gas Support and Service Facility (office
and shop building and outside parking, storage and staging area for vehicles and equipment) in
the A (Agricultural) Zone District, based on the recommendations of Planning staff and the
Planning Commission, with the Conditions of Approval and Development Standards as entered
into the record. His motion also included deleting the last two sentences of Condition of
Approval #1.F and modifying Development Standard #32 to state, "The existing on-site

screening shall be maintained." The motion was seconded by Commissioner Long, and it
carried unanimously. There being no further discussion, the hearing was completed at
2:56 p.m.
This Certification was approved on the 23rd day of July, 2012.
