HomeMy WebLinkAbout20120632 RESOLUTION RE: ACTION OF THE BOARD CONCERNING APPLICATION OF MARTIN GUTIERREZ FOR TEMPORARY ASSEMBLY PERMIT-APRIL 14, AND 15, 2012 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Martin Gutierrez, 7717 County Road 31, Fort Lupton, Colorado, 80621, presented to the Board of County Commissioners an application for a Permit for Temporary Assembly on land within the unincorporated portion of the County of Weld, State of Colorado, to be held on April 14 and 15, 2012, from 11:00 a.m., until 5:00 p.m., each day, on property described as follows: 7717 County Road 31, Fort Lupton, Colorado, 80621; being further described as Lot B of Recorded Exemption #3375; being part of the E1/2 of Section 28, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has paid Weld County the sum of ONE-HUNDRED DOLLARS ($100.00) for said Weld County Permit for Temporary Assembly, and WHEREAS, having examined said application, the Board deems it advisable to deny a Weld County Permit for Temporary Assembly to Martin Gutierrez, based on the complaints received following prior events, with instruction that a new application may be submitted for consideration if the attendance is limited to 1,000 people, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said Weld County Permit for Temporary Assembly on April 14, and 15, 2012, be, and hereby is, denied. Assembly Permit Tonya, My review of the application indicates a few issues to be addressed or considered: 1. Berta Gutierrez is the co-owner of the property but she is not listed as an applicant. A notarized statement that she consents to the event is required unless she adds herself to the application and signs it. 2. In terms of the number of people at the event, the application states "[a]pproximately 1500 although attendance unknown (open field)." The Board will want to know an exact maximum amount and how the number of people in attendance will be regulated to 1500 or fewer people. 3. If 1500 people is the maximum number expected, 15 portable toilets are required. Currently, only 12 are contracted. There are additional issues that will be discussed tomorrow, but I thought Mr. Gutierrez might be able to address these issues between now and the hearing tomorrow. Thank you. After reviewing the application, the following is the recommendation made by this Department: 1) Temporary hand washing stations should be located outside the portable toilets. We recommend that there be one hand washing station for every two portable toilets (provided the toilets are in close proximity to one another). If the portable toilets are spread throughout the facility we recommend one hand washing facility per toilet. Based on number of toilets being provided (12) we recommend having 6 hand washing stations. Other items to note Last year while conducting inspections of licensed facilities at this location the following observations were made: 1) There were additional food vendors selling from vehicles who were not licensed and there were staff members of the licensed mobile units, selling outside of their units. All sales should be conducted from the licensed retail food establishments. 2) I entered the facility early in the day and getting in was rather easy. However, there was an issue with trying to leave the facility after my inspections were completed. The only way out of the facility was back through the same road used to enter the facility. At times I had to enter the ditch or move off the road in order to let people that were coming into the facility pass me. It appeared that there might have been another access point on the property where traffic could exit (would recommend that change if available).
