COLORADO April 5, 1976 Board of County Commissioners Weld County, Colorado 1516 Hospital Road Greeley, Colorado 80631 Re: RE-206 NW Sec. 32 T7N R65W Dear Sirs: The following findings and recommendations are with reference to a re- quest by Clarence E. and Margaret A. Nelson for a Recorded Exemption on property lying within the above described area. The property in question lies approximately one mile northeast of the Town of Eaton. The sub- mittal requirements defined by Section 9 of the Weld County Subdivision Regulations have been met by the applicant with reference to this parti- cular application. The following findings are based on an analysis of the request and on an analysis of land use characteristics in the area in question by the Weld County Planning Department staff. 1 . The 2.06 acre parcel which is to be split off from the total 105.063 acre parcel contains Class IV soils. This soils classification is based on the U.S.G.A. Soil Conservation Service agricultural capability classification system. Though the 2.063 acre parcel (hereinafter referred to as Parcel B) is composed of Class IV soils, the parcel itself is surrounded by predominantly Class II and III agricultural lands. The general soils map contained in the Weld County Comprehensive Plan shows this particular parcel lying in an area containing pre- dominantly Class III and IV irrigated lands. The general area is bordered by lands containing Class I, II and III soils. WELD COUNTY COMMISSIONERS GLENN K. Farmland contiguous to Parcel B is now being farmed right up to the boundaries of Parcel B. There appeared to be no physical constraints which would prevent this parcel from being farmed along with Parcel A. 3. The Eaton Comprehensive Plan has established the Eaton Draw as the east boundary of the area proposed for future growth. The plan states that residential development in the Town of Eaton should be limited to those areas to the west of Interstate 85. The plan projects primarily industrial uses to the west of I-85. 4. Surrounding land uses include residential acreages which have been established to the west, north and east of Parcel B. The area to south of Parcel B is an agricultural use. 5. The Weld County Subdivision Regulations establish the Recorded Exemption procedure as "a means whereby non- productive agricultural lands may be developed for higher or more productive uses, in-so-far as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. " 6. In considering the proposed use of Parcel B for a dwelling unit, it is felt by the staff that one additional house is not likely to prejudice the ability of other individuals in the area to carry on agricultural pursuits on adjacent lands. However, it is felt that by allowing additional land divisions in this area we tend to encourage the further development of the area in general for urban uses which would be in conflict with the existing agricultural characteristics of the area. Based on these findings, the Weld County Planning Department staff would recommend denial of the request for a recorded exemption on the property in question. Additional information which should be considered in this application includes the letter of intent which is attached to the application and signed by Clarence E. and Margaret A. Nelson. The County Commissioners April 5, 1976 Page 3 letter indicates that confusion has existed as to who actually owns Parcel B since the time when the larger 105 acre parcel was transferred to the Nelsons in December, 1973. When the Nelsons purchased the property in 1973 it was their intent that Parcel B would remain under the ownership of Ronald L. and Betty J. Pappenheim, who were the original owners of the entire parcel . At that time, and since that time, both the Nelsons and the Pappenheims have been under the assumption that the Pappenheims actually owned Parcel B. This fact is evident by observing the parcel in question. Mr. Nelson has not farmed Parcel B since 1973, rather assuming that it was owned by the Pappenheims. The error which occurred was not discovered until Pappenheims transferred Parcel B to a third party, who then applied for a building permit on the parcel . At that time, through title research, it was discovered that the Pappenheims were not actually, or legally, the owners of the property which they had transferred. It was also discovered at that time that a building permit could not be issued on the parcel until such time as Parcel B had been legally divided from the larger 105 acre parcel by meeting the requirements of the Weld County Subdivision Regulations. The current application is a request by the Nelsons so such division can be accomplished. The staff feels that the latter described conditions create extenuating circumstances which should be taken into account in the Board' s decision to approve or deny this request. We purchased our farm from R:rnald L. Pappenheim and Betty J. Pappenheim on December 27, 1973. Upon initial contacts and again at real estate closing it was clearly explained that the 2.063 acres now described as Parcel B was to be retained by Ron and Betty Pappenheim. Provided along with our deed was a legal description and survey of the 2.063 acres, then described as Tract D, which was to be excluded from our deed. Attorney William H. Southard handled this transaction. At closing, Ron Pappenheim was apprehensive abut the correctness of our deed and his ability to later prove ownership of Tract D, however hewers repeatedly assured that everything had been taken care of. Ron and Betty Pappenheim have since sold the 2.063 acres to Gary and Charlotte Billings. When Gary Billings attempted to get a building permit, Bob Adams of the Planning Commission discovered that the land was included in our deed. Therefore to rectify this situation, we gratefully request that this recorded exemption be approved. Without question it is our moral obligation to return Parcel B to R,n and Betty Pappenheim. March 28, 1976, Commissioner Carlson to attend the Adams County dedication on their county facility. March 26, 1976, Chairman Billings stressed the need to sign the payroll vouchers in the afternoon. NARROWS DAM PRESENTATION: Representatives from the Bureau of Reclamation requested the Board's endorsement of the Narrows Dam Project. The Central Colorado Water Conservancy District representatives were also in attendance. With the assistance of color coded maps and graphs a detailed discussion was held. The two proposed sites, Hardin and Narrows, were reviewed. The economics of the two sites were also discussed. The Greeley Chamber of Commerce has en- dorsed the Narrows site rather than the Hardin site. After further examination of the considerations, Commissioner Jacobucci made a motion to support the con- struction of the Narrows Dam site. Commissioner Steinmark seconded the motion and it carried unanimously. The Chairman called a break. RECORDED EXEMPTION - CLARENCE NILSON; Mr. Fortner reviewed this request and indicated it is not consisfent with county policies, but referred to the confusion of d g1 / ownership as a result of the sale in 1973. After brief discussion, Commissioner 6S Carlson made a motion to approve this request. Commissioner Moser seconded 3 the motion and it carried with all commissioners voteing aye except Commissioner Billings who abstained. SECURITY PATROL ORDINANCE, FIRST READING.: Special Legal Counsel read the first ordinance into the record. Commissioner Carlson made a motion to pass the ordinance on first reading as read. Commissioner Steinmark seconded the motion and it carried unanimously. The Clerk's Office will publish April 2 and the ordinance will appear on the agenda for April 12, 1976. ANDERSON, HUNTER, THOMTE AND KURTZ SUGGESTION: The Chairman read the letter into the record regarding the Highway User's Tax apportionment erroneously deposited to Weld County. The payment of $5,349.94 should have been received and deposited by the City of Greeley. Commissioner Jacobucci made a motion to authorize the Weld County Treasurer to remit $5,349.94 from the Road and Bridge Fund to the City of Greeley. Commissioner Moser seconded the motion and it carried unanimously. BRIDGE ON COUNTY ROAD 16 (60) BETWEEN COUNTY ROADS 15 AND 17 DESTROYED BY FIRE: Commissioner Moser made a motion to temporarily close County Road 16 (60) between County Roads 15 and 17 for bridge construction. Commissioner Carlson seconded this motion and it carried unanimously. MOUNTAIN BELL CONTRACT: Special Legal Counsel indicated he had reveiwed the contracts. He recommended that articles 11, 12, 13, 14, 15, 18, 19, 21, 22, 23, 24, 26, 27 and 28 be excluded. Commissioner Jacobucci made a motion to instruct Special li Legal Counsel to attach a letter to the contract indicating that those items not be a part of the contract.
