All ongoing maintenance is handled by members and volunteers, which includes picking up spent shells, boxes and spent wads on the trap range as well as the other areas of the club. The weed growth on the property are generally maintained by mowing with various types of equipment and the use of garden type weed control sprays. The weeds on the burms are generally kept to a maximum height of 10 inches, with the use of string trimmers, or lawn type sprays which will not destroy the grass which helps with the sound mitigation. It is the goal of the club to always keep a clean general appearance at the range. Boulder County 4-H has been the guest of the Berthoud Gun Club over this time and they have been a huge supporter of the program by providing a place that we can use to teach the youth in the region about Leadership, Responsibility, Shooting sports and Firearm safety. Without the Berthoud Gun Club facility many youth would not have access to a place to learn about, or practice shooting sports. Just wondering if Weld County is ever going to take some kind of action to enforce the noise issue from the gun club. Before the wooden fence was installed we (neighbors) were fine with the goings on at the club, they were here first etc etc. Since the fence was built to "help"the club the noise has gotten very loud. So loud in fact the neighbor across the road from us a long time resident (John Sullivan) is also very disappointed in the club and the counties lack of caring and/or responsibility in this matter. I do believe it is a "change of use" by the gun club and would like to see Weld County get off center and do something! I promise if this change occurred in your back yard you would want it made right. Please let me know. Al of our tanks are specifically manufactured to have solid bottoms and have always been made that way. It would not be considered a holding tank without a bottom, If we sold Berthoud Gun Club a septic without a bottom,they would have had major problems right off the bat,and would have never passed Weld Countys inspection. The local residences have much more at stake than any member of the Gun Club. I am really tired of being wakened by the gun club on the weekend. Now that the fence has been built, I have to turn my TV or radio up so loud to try to drown out their noise. Since they added the fence, the noise has intensified and it comes through my homes walls more than before. Over the years, we cant participate in out door activities on the weekend and evenings without the increased banging of shotguns, this has added a new nuisance that is simply unreasonable. Please remember, when we moved here 20 years ago they shot once a quarter or once a month at the most. Single lane. Not 3-4 lanes. I am exhausted at the arrogance and disrespect towards the neighbors and the officials at Weld County. In my opinion, they have extended their rights further than what is reasonable. If any single county official were in my shoes and this was their back yard, it is my opinion this would be dealt with firmly and with absolute resolve. (even if they were a club member or sympathetic to the club) Here are the facts. In the recent years, the Gun Club has increased their shooting lanes which have increased the amount of shots per minute by 3 fold increasing the intensity of noise to the area. The Gun Club has expanded its facility beyond its initial existence with buildings, storage, stadium lighting, large equipment storage etc. The Gun Club does not meet NRA safety standards. The Gun Club has added black powder lanes and Archery lanes. The Gun Club does not adhere to the hours the county has set. The County allows too many hours of use for being so close to residential homes. At minimum, I would like to request that the fence be removed. Ideally the county would recognize that the building developments in the area will drive up the property value. Right now is the ideal time to deal with this. Land is reasonable and market timing is in the Counties favor. If the county waits to deal with this once the 2 home developments are in place, the financial option will be limited due to the increased property value. I have observed over the years what noise nuisances gas compressor engines are for neighbors. I have observed "cheap/immediate/quickly installed" methods for noise mitigation for the comfort of people who live in the area---but noise seems always to be a chronic problem until, minimally, these sources of discomfort are placed in permanent, sound buffered enclosures that are surrounding the generator on all six sides (roof,4-sides,and, of course, a concrete pad or gravel pad). Noise is a real environmental nuisance for people whether it is a gun, compressor engine, barking dog, pulsating music, loud human speech over an amplified speaker, airplane engines, general traffic noise from knobby tires, or poorly muffled motorcycle engines. Jake brakes are a big source of discomfort for people who live on roads or near intersections where trucks are slowing for turns or rapid stops. Anyway, I'll be interested to hear(or be told) what happens there at the Berthoud Gun Club. J. Even tho the gun powder explosions were at decibel levels less than traffic along WCR 1 at the sites of the nearest residences, If I were the property owner, I probably would not be pleased with the noise created and transmitted off- site of the gun club. But, again, the sound are "exempt" and nothing much can be done unless the regulation/code is changed. You mentioned to me something about "Hay Bales" used for sound mitigation. Based on what I observed and experienced, I'm thinking that significant sound mitigation "only" would be possible by enclosing the shooting operation in a closed building (as the one on Hwy 34 about WCR 45 where E-18`h merges with Hwy 34). Or, at least, doing more with buffering around the shooters if they are still going to be outside. The shooters are standing in the open---I could see them from WCR 42.5, the point at which I was measuring the noise. Maybe the standing area from which they are shooting should be a surrounded on 4-sides with sound buffers (top, right, left, and back). Sound engineers probably know best what can be done to mitigate these strong pulses of explosive noises. 2 Phil J. Referencing the staff comments for this facility, At the time of application , the Comprehensive Plan was referenced in the preparation of the case comments including Section 22-4-60 " Noise is a source of environmental pollution . Exposure to excessive noise levels over prolonged periods can be a threat to public health . Statutory noise standards have been established for areas where commercial , industrial and residential uses are located . " Section 22-4-70 .A, 2 ( N . Policy 1 . 2) stated "The Department of Public Health and Environment will prescribe noise level standards for land use applications when appropriate . Operating outside of the guidelines Weld County established In addition to the complaints that have been filed since September of 2004 and in lieu of the Berthoud Gun Club minimizing their activity within the guidelines that the county imposed on them, the Berthoud Gun Club has continued their shooting activities outside of the times established by the county. Increased noise Level Additionally, the noise has increased since they completed the wood fence around part of the property as heard in the recorder file I sent you via e-mail. ( would like to confirm you received this via e-mail if you would please) The fence that was installed last week has multiplied the volume from the shooting range, creating an echo and whistling blast due to a wind tunnel effect created by the fence. This affects all housing to the south and west which is where most of the housing is located. Change of Use When I purchased the property 18 years ago, it was not an issue as they didn't shoot after dark and shooting 1 to 2 times a month. The hours of use has increased from approximately 8 hours a month to approximately 30 to 60 hours a month in the past few years. This is documented. Additionally, the increase in the quantity of shooters is has multiplied greatly based on the added shooting platforms, rounds fired and increasing uninterrupted (back to back) shooting. Therefore the noise is proportionate to this. • Unauthorized Firearms The increasing activity at the rifle and pistol shooting range is being used with unauthorized firearms. New School and Development across the Street Some concerns that will likely come up very soon includes the new school that is scheduled to be built and opened in Aug of 2012, in the O'Malley Glen Subdivision. httn.//www renorterherald com/print.asp?ID=31698 This 700 children school is located across the street and about 400-500 yards from the Berthoud Gun Club. Additionally, the town of Berthoud has approved the O'Malley Glen development across the street. Activities to Reach Goal: Examples include: _Avoid shooting over and into water and wetlands. _ Prevent off-site migration of lead through groundwater and surface water runoff. _Conduct lead recovery. _ Discourage ingestion of lead by wildlife. _Maintain soil pH between 6.5 and 8.5 in the shotfall zone. Site Assessment Description of Ranges and Support Facilities The Berthoud Gun Club has a 2 position Trap Range, and a Small Arms Range, which is limited to .22 caliber rim-fire and 40 gr. blackpowder. These ranges are located in a rural setting and are oriented away from residential areas and surface water bodies, The Little Thompson River does run along the south border of the property. Additionally, the Rockwell irrigation ditch, also runs along the south border of the property, parallel to the river. The range is arranged on 3 levels. See Figure 1. The top level is the trap range, with parking and club house situated on the west end of the property. The trap line is east of the clubhouse, with the shooters shooting towards the east. Approximately 400,000 targets are thrown each year to support open shooting, ATA shoots, league shoots, 4-H, and Colorado Youth Outdoors. On the next level down, there is a small caliber/black powder range. This runs parallel to the trap range, shooters again shooting towards the east. This is limited to .22 caliber and limited black powder. The back stop is a large bowl shaped berm, which is approximately 30 ft. high. The lowest level, along the Rockwell ditch contains a small archery range. As with the other ranges, shooters shoot towards the east. Existing Environmental Conditions The trap range rests on top of an old landfill. Vegetation at this time, is sparse, excluding weeds, as the recent work with install berms for sound mitigation needs to be vegetated. Trap Fields Action Plan The trap range has been in existence since 1952. Over the course of time the location of the two traps has remained constant, and use has been sporadic. Use of the traps has increased over the past several years, and to date, there has been no effort to reclaim the lead in the shotfall area. In order to control the lead, the following management options have been selected, and will be implemented in a short term, and longer term effort: - Cover the Rockwell irrigation ditch - Vegetate sparse grass areas of trap field. -Apply lime to shotfall zones if soil test results indicate this would be beneficial. - Prepare fields for lead reclamation. - Get bids for lead reclamation project. - Conduct lead reclamation within the trap shotfall zones. In order to implement the options selected, the following actions are necessary. a) Management Actions: assign personnel responsible for initiating, conducting, and completing the alternatives selected above. b) Operational Actions: collect soil samples for pH analysis, consult with USDA's Natural Resources Conservation Service and/or the county Cooperative Extension Service regarding best suited vegetative management recommendations c) Construction Actions: do site preparation work, get bids, institute mowing and vegetative management recommendations, erect fences on top of berms as needed to reduce shotfall zones Plan Implementation - Schedule for Implementation Winter/Spring: Soil survey shall occur in the spring : pH survey, contact local officials for vegetation management recommendations Summer/Fall: Lime will be applied in the summer, if necessary.. As a rule of thumb, 50 pounds of lime per 1,000 square feet should raise soil pH by 1 once the residual acidity is overcome. Seeding of sparse areas will occur in early summer. Re-vegetation is necessary to control water runoff and minimize erosion. -Vegetate the backstop berm(s) to minimize erosion. -Apply lime to the berm and foreground if pH test determines it is necessary. - Begin planning a lead reclamation project. The action plan above, is similar to the plan stated for the trap range. Below are some examples of areas to monitor: Lead Recovery Document the quantity (pounds) of lead recovered and recycled, along with the cost of conducting the activities. Vegetation The density of vegetation growth should be measured throughout the growing season, especially in areas of sparse growth where steps have been taken to increase the vegetative cover. This is can be done by taking periodic photographs (e.g., once a month) from the same places to document the impact of the Plan. Wildlife Keep a log of visual observations made regarding the frequency of range usage by the variety of species in your area. In the history of Erie Preract,(50 years of business)we have never manufactured a septic tank nor a cistern without a bottom. All of our tanks are specifically manufactured to have solid bottoms and have always been made that way. It would not be considered a holding tank without a bottom, If we sold Berthoud Gun Club a septic without a bottom,they would have had major problems right off the bat,and would have never passed Weld Countys inspection.
