HomeMy WebLinkAbout20120109 RESOLUTION RE: ACTION OF BOARD AT INITIAL HEARING CONCERNING RESCINDING USE BY SPECIAL REVIEW PERMIT #1714 - ANTHONY AND SHERRY REIS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 18, 2009, the Board approved the application of Anthony and Sherry Reis, 29825 County Road 398, Keenesburg, Colorado 80643, for a Site Specific Development Plan and Use by Special Review Permit#1714 for a Kennel (up to 30 dogs of a non-specific breed, including dog grooming, boarding, doggie daycare, and training) in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lot A of Recorded Exemption #3481; being part of the NW1/4 of Section 25, Township 2 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services notified the applicant of outstanding Conditions of Approval and items to be completed prior to recording the plat, by letters dated August 4, September 26, and December 12, 2011, and WHEREAS, on the 11th day of January, 2012, an Initial Hearing was held before the Board to consider granting additional time to meet all of the conditions/requirements of approval and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special Review Permit#1714 and Deny the application, and WHEREAS, at said hearing, Anthony and Sherry Reis were present, and WHEREAS, after hearing all testimony presented, the Board deemed it advisable to refer the matter back to the Department of Planning Services for processing, with the direction that the applicant submit quarterly reports on their progress to staff. Remaining Outstanding Conditions of Approval: Staff has no record of any of the outstanding conditions of approval having been addressed. There are still a number of substantial outstanding conditions of approval(improvements agreement,a technical review of the capacity of the septic system for the proposed use. Staff Recommendation: The applicant has obtained a well permit and a technical review of the septic system has been installed. The two remaining items are the applicant needs to obtain a building permit for a change of use for the outbuilding involved in the dog grooming business and satisfy the requirements of the State of Colorado as outlined in the applicant's letter dated 12/31/2011. Faithfull Grooming,llc does wish to continue the persuit of our USR permit. We regret to inform you that we have not been able to apply for the change of use permits that we need due to the lack of funds. We are aware of the hearing scheduled with the Board of County Commissioners on January 11,2012 and we will be present. We have just finished the recertification on our septic system the end of November and have sent a copy to the health department. Now we have been saving the best we can for the other permits that we need to obtain as this has been very difficult since we lost the use of our boarding kennel this past August. The State of Colorado Department of Agriculture(PACFA) had a routine inspection August 8 2011. During this inspection they informed us that they now require us to install a floor in the kennel and stop the use of the kennel until we have done so. The floor now is pea gravel the state requires the floor to be concrete or wood with a sealed finish. They said that they may open to other suggestions if we had any. With this it has been difficult to adjust to another loss of income at this time. We pray at this time that the Board of County Commissioners will understand and grant us more time to obtain the required permits. We have invested a lot of time and money to obtain our USR permit and would like to continue to do so if allowed more time. Issuance of this permit cancels permit no.253316. 4) Water from this well may be used for domestic purposes inside 1 single family dwelling(s),and the watering of the owner's own large non-commercial domestic animals. 5) The pumping rate of this well shall not exceed 15 GPM. 6) The annual withdrawal of ground water from this well shall not exceed 1 acre-foot. 7) The irrigated area shall not exceed 8,000 square feet of lawn and garden. 8) Production is limited to the Laramie-Fox Hills aquifer which is located 595 feet below land surface and extends to a depth of 865 feet. Plain casing must be installed and grouted to prevent the withdrawal of ground water from other aquifers and the movement of ground water between aquifers. 9) The depth to the top of the Laramie-Fox Hills aquifer is approximate. To ensure the exclusion of poor quality water from zones immediately above the aquifer,plain casing and grout shall extend through the lowermost coal and/or carbonaceous shale that overlies the Laramie sand portion of the aquifer. 10) This well shall be within 300 feet of the location specified on this permit. 11) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner(recorded at least annually)and submitted to the Lost Creek Ground Water Management District and the Division of Water Resources upon request. NOTE: Noncompliance with the procedures outlined in the attached information sheet(form GWS-5)may void your well permit. This is due to the ongoing financial difficulty that we are experiencing-at this time.We have had a problem meeting our obligation to our mortgage company since January of 2010. Our mortgage was scheduled for foreclosure on March 24,2010 and we were able to avoid this action. We have still been 30 to 45 days out on our mortgage. As of May 10,2010 our mortgage company has informed us that we have qualified for a modification on our mortgage that will reduce the monthly payment and allow us to preserve our property,and this begins with a trial period that starts June 1, 2010. So as we focus on preserving our property we do not have the funds to meet items"C"and"D"of the Conditions of Approval at this time. All other conditions have been addressed and completed. We relize that without preserving our property there is no use for a USR permit and without a USR permit we can not preserve our property as well. So as you can see it is truly a catch 22. We have been and will continue to comply with all of the Development Standards. We feel that we can and will address items"C"and"D"if givin time to get financily stable. Faithfull Grooming's business is showing improvement this second quarter and Anthony's income is expected to increase in the next 10 to 12 months.
