RE: RECORDED EXEMPTION NO. 249 - HARRY A. ANDREWS.
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 23rd day of February, 1977, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Harry A. Andrews ,
Weld County, Colorado, more particularly described as follows :
Those portions of Section 25, Township 5 North, Range 65 West
of the 6th Principal Meridian, Weld County, Colorado, more
particularly described as follows:
Total Parcel
That portion of said Section 25 lying south of the right-of-
way of the Union Pacific Railway, containing 522 acres more
or less and being subject to existing rights-of-way.
Lot "A"
That portion of said Section 25 lying south of the right-of-
way of the Union Pacific Railway, excepting therefran that
portion of said Section 25 lying Southerly and Easterly of the
presently existing centerline of the Gilmore Ditch. Said Lot
"A" contains 508 acres more or less and being subject to
existing rights-of-wa .
Lot "B"
That portion of said Section 25 lying Southerly and Easterly
of the presently existing centerline of the Gilmore Ditch.
Said Lot "B" contains 14 acres more or less and being subject
to existing rights-of-way.
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-28-
101 (10) (d), CmS 1973,as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Harry A. Andrews, be exempt
from the definition of the terms, "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended, and Section 2-lA (3) of the Weld County
Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
February, A.D. , 1977.

RE: Recorded Exemption #249
Dear Commissioners:
The attached application, plat, and related items are in
reference to a request by Andrews and Company for a
Recorded Exemption. The parcel of land in question is
described as part of Section 25, T5N, R65W of the 6th P.M.
Weld County, Colorado. The subject property contains
522 acres of Class III , IV and VI irrigated and dryland
soils.
The request is to split the property into parcels of 508
acres and 14 acres. One residence and labor house are
currently located on the 508 acre parcel . Presently there
are no improvements on the proposed 14 acre parcel. As
stated in a letter dated February 2, 1977 from Mr. Harry
Andrews, Andrews and Company desires to convey the 508 acre
parcel to an individual who proposes to further develop the
non-irrigated portion into irrigated land. Presently approx-
imately 179 acres out of the 508 acre parcel is non-irrigated
and it is this portion of the 508 acre parcel which the pur-
chaser proposes to convert to irrigated farmland through the
installation of additional sprinkler systems. The proposed
14 acre parcel is severed from the remainder of the property
by the Gilmore Ditch and contains Class VI dryland soils.

Based upon the information submitted and the adopted policies
in the County, the Planning Commission staff recommends the
request be approved for the following reasons :
1. The proposed split conforms with the intent clause of the
Recorded Exemption procedure (Section 9-2 of the Weld
County Subdivision Regulations) , the intent clause of the
agricultural district (Section 3. 3 A of the Weld County
Zoning Resolution) and the Weld County Comprehensive Plan
since the use would be compatible with the surrounding
agricultural use, the split would be promoting agricultural
development through the installation of additional sprinkler
systems and the conversion of dryland agricultural land to
irrigated agricultural lands, and the approval of this re-
quest would allow for the conversion of non-productive
agricultural lands to a higher and better use.
2. The Town of Kersey Planning Commission has indicated the
Town has no objections to the granting of this request .
3. The request complies with the provisions of Section 9-4 (A)
of the Weld County Subdivision Regulations.

To Whom It May Concern:
I hereby request the granting of this Recorded Exemption for
the following reasons:
1. We plan to sell Parcel A, which contains approximately
319 irrigated acres and 179 acres of dryland. We anticipate
that the purchaser will further develop Parcel A and put
part of the 179 acres of dryland under irrigation in the
future.
2. Parcel B is dryland, is above the irrigation ditch, and
has no practical use for agricultural purposes. Parcel B
is; however, a nice homesite. I anticipate building a
residence there in the future.
