RE: 2011 Financial Assurance Review

Dear Mr. Croissant;
The Hazardous Materials and Waste Management Division of the Colorado Department of Public
Health and Environment (the Department), has conducted a review of your 2011 Financial Assurance
compliance for the BOSS Compost facility. The Department has determined that the amount held in
the Certificate of Deposit (CD) Account adequately covers the inflationary adjusted Closure and
Post-Closure costs.
The Department received Closure and Post-Closure costs for the BOSS Compost facility on April 9,
2007. The Department also received a copy of the CD Account Statement from Valley Bank and Trust
on July 17, 2010 and the value was $8459.18. As the aforementioned items account for the inflationary
increases to the Closure and Post-Closure costs only, BOSS Compost is hereby required to submit a
Five-Year Revised Cost Estimate (RCE) to the Department by September 30, 2012 as required by
Section 1.8.3(D) of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 (the
Regulations). Based on a review of the April 9, 2007 submittal, please ensure that all third party cost
estimates are properly signed and dated.
Also, due to banks adopting more stringent homeland security measures and based on the advice of our
council, the Department is no longer allowing CD Accounts to be set up without a Collateral
Assignment Form. In addition, due to our inability to access information and potentially funds, it has
been determined that existing CDs need be replaced with Collateral Assignments upon maturity. Our
records show that BOSS Compost's Certificate of Deposit #2101 with Valley Bank, N.A. will need be
replaced with a Collateral Assignment. The Collateral Assignment Form can be found at;
http://www.cdphe.state.co.us/hm/sw/cdassi;nrment.doc. Please have your bank contact Enrique Martinez
on how this process can be completed.
