We are working on the changes to the plat and will provide you a copy prior to the Board of County Commissioners hearing. The conditions we would like to address are in numerical order below: Condition 2: After review of the Building Department referral dated October 19, 2011 it is understood that new construction, alterations and additions to existing structures will require a building permit. We request that this condition be considered adequately addressed and deleted. Condition 4: A waste handling plan has been submitted to Lauren Light with the Department of Public Health and Environment. The plan has addressed the items requested by Ms. Light and we request that this condition be considered adequately addressed and deleted. Condition 5: Condition 1G requires showing the existing oil and gas facilities located on the property. The surveyor is currently working on that item. This proposal does not impact any existing or future drill sites based on the nature of the project. We met with John Butera who at the time was a Senior Landman with Kerr-McGee. We previously provided you with a letter dated July 22, 2009 from Mr. Butera indicating 1 MG fully acknowledges and supports the application approval. We request that this condition be considered adequately addressed and deleted. Condition 6: We met with the Town of Mead concerning this application on October 31, 2011. The Town of Mead supported our request with three conditions. We are working on the parking layout and the access to the property has always been shown on the maps. As requested, camping is limited to the area near the clubhouse and will be shown on the plat. The request for no water skiing is not acceptable to Highland for the uses allowed under USR-1683 and needs to remain as a part of the review and approval E0/Z0 39tid 00 H01IC QNV7HSIH Lb£bSES0L6 EO:bt ZlOZ/tE/t0 as submitted. The skiing is regulated under the development standards and any concerns should be mitigated. We will send an electronic copy of the plat to the Town of Mead when it is completed. We request that this condition be found adequately addressed and deleted. Condition 7: After review of the referral comments from Mr. Terry McKee of the U.S. Army Corp of Engineers dated October 19,2011,the applicant understands that any work that falls under the Corps jurisdiction needs to be discussed with the Corp prior to completion of the work. Development Standard 12 covers this item adequately. We request that this condition be considered adequately addressed and deleted. Condition 8: After review of the referral comments from Larry Rogstad with the Colorado Division of Wildlife dated December 21, 2008 the applicant understands the comments and will take them under consideration in the operation of the site. We have consulted with the US Fish and Wildlife Service concerning the Preble's meadow jumping mouse and it has been determined that this proposal does not affect the mouse habitat. The Corp of Engineer item is addressed in the above condition. Mr. Rogstad indicated that these activities provide wholesome recreation for friends and family and provide economic benefit to local retailers. We request that this condition be considered adequately addressed and deleted. This letter bas adequately addressed several of the conditions of approval. Mulligan hunting and fishing club stated at both the Mead meeting and the planning commission hearings that they would not have skiing but they do not represent Highland and can only speak to uses when they have the lease. The applicant is Highland Ditch Company and the Mulligan club and Highland will execute the lease once approved by Weld County. The camping has been confined to the area near the club house and is not going to be a common occurrence based on the application. Have a great day. Todd A. The Town Board also recommended that camping be limited to an area behind the existing clubhouse. It looks like the revised plan detail includes a larger area for caomping. Can you respond to this?
