HomeMy WebLinkAbout20120693 RESOLUTION RE: ACTION OF BOARD CONCERNING AMENDED USE BY SPECIAL REVIEW PERMIT, USR11-0030 (FORMERLY USR-1664), FOR AN OIL AND GAS PRODUCTION FACILITY IN A PUD (PLANNED UNIT DEVELOPMENT) ZONE DISTRICT WITH E (ESTATE), C-1 AND C-2 (COMMERCIAL), R-1, R-2, R-3 AND R-4 (RESIDENTIAL) ZONE DISTRICTS - BAYSHORE, LLC, CIO KERR-MCGEE OIL AND GAS ONSHORE, LP WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 22nd day of February, 2012, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing the application of Bayshore, LLC, c/o Kerr-McGee Oil and Gas Onshore, LP, 1099 18th Street, Suite 1800, Denver, Colorado 80202, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0030 (formerly USR-1664), for an Oil and Gas Production Facility in a PUD (Planned Unit Development) Zone District with E (Estate), C-1 and C-2 (Commercial), R-1, R-2, R-3 and R-4 (Residential) Zone Districts, on the following described real estate, to-wit: Part of the SE1/4 of Section 25, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing the Board deemed it advisable to continue said matter to March 21, 2012, to allow adequate time for a hearing to be held before the Planning Commission which was continued to March 6, 2012, due to prior commitments of the applicant and the representative, and WHEREAS, on March 21, 2012, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, finds that this request be approved and the matter should be continued to June 27, 2012, at 10:00 a.m., to allow the applicant adequate time to execute a Surface Use Agreement for the horizontal well prior to a hearing to be held before the Planning Commission which was continued to June 5, 2012. Long fy Attorney Dougl s Rademac er Date of signature: 1-9.5/2 2012-0693 PL1867 MEMORANDUM VICTO: Board of County Commissioners COLORADO DATE: March 21, 2012 FROM: Kim Ogle, Planning Services SUBJECT: Continuance of USR11-0030 Kerr McGee Oil and Gas Onshore LP, do Kelly Carrington requested a continuance of case number USR11-0030 at the February 7, 2012 Planning Commission hearing as representatives for the applicant were unavailable and there was not an executed Surface Use Agreement for the horizontal well as required by staff. The case was also continued at the Board of County Commissioners hearing on February 22,2012. The applicant has stated that Kerr-McGee OnShore and the property owner, Brookfield Residential Properties [CARMA aka Bayshore, LLC] are very close to getting this agreement signed. Given, this circumstance, the applicant, Kerr-McGee is requesting this case be continued and a Planning Commission hearing date be set for June 5, 2012, as stipulated in Ms. Carrington's letter dated March 5, 2012. Therefore, it is further requested that the March 21, 2012 Board of County Commissioners Hearing be continued until June 27, 2012. On behalf of Kerr-McGee, the Department of Planning Services is requesting a continuance until June 27, 2012 to allow execution of the agreement by the surface owner and Kerr-McGee OnShore, LP. Hello
