RE: AUTHORIZATION TO PAY SPECIAL ASSESSMENT TO DELTA IRRIGATION COMPANY
FOR DITCH REPAIR.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado,
and
WHEREAS, Weld County is the owner of seventeen (17) shares of the Delta
Irrigation Company to provide water for the Davis Ranch, and
WHEREAS, at a special meeting conducted November 8, 1979, it was voted
that the special assessment for ditch repair be set at THREE HUNDRED DOLLARS
($300.00) per share, payable on or before January 1, 1980, and
WHEREAS, the Board of County Commissioners have determined that it is
in the interest of Weld County to have the Delta Irrigation Company make the
ditch repairs prior to high water in the spring to avoid interruption of irri-
gation water to County farm property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the payment of FIVE THOUSAND ONE HUNDRED DOLLARS
($5,100.00) prior to December 31, 1979 to the Delta Irrigation Company for
the above special assessment is hereby approved, and
BE IT FURTHER RESOLVED that the Board of County Commissioners hereby
directs the Director of Finance and Administration to prepare a supplemental
appropriation in the Motor Vehicle - ICS Fund in the amount of FIVE THOUSAND
ONE HUNDRED DOLLARS ($5,100.00) to accommodate the above payment prior to
December 31, 1979.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 28th day of November, A.D. , 1979.

NOTICE
SPECIAL ASSESSMENT •
At the special meeting conducted November 8, 1979, it was voted that the special
assessment for ditch repair be set at $300.00 per share, payable on or before
January 1, 1980, a 12% interest charge will be assessed if payment is made
after January 1, 1980. We would appreciate your prompt payment of this assessment
to take care of the current obligations of the Company.

SPECIAL MEETING
DELTA IRRIGATION CO.
NOVEMBER 8, 1979
7:30 P. M.
The Special Meeting was called by the Board of Directors of Delta
Irrigation Company to be held at their office in the Centennial
Center, 915 - 10th Street, Greeley, Colorado at 7:30 P. M. , on
November 8, 1979. The Directors attempted to reach each share-
holder by telephone to notify them of this Special Meeting..
The following shares of stock were represented in person at said
meeting.

The 1979 financial report was reviewed by the stockholders in attendance.
Checking account balance on hand November 8, 1979
totaled $ 603.94
Certificate of Deposit 1,500.00
Interest to date 56.83
$2,160.77
James Clark, stockholder, elaborated on the immediate need to rebuild
the Delta Ditch. Due to erosion, approximately 20 feet of the ditch
bank has been lost. If another 5 feet is lost, there will be a
breach in the ditch. The cause of the possible breach is due to a
change in the channel, caused by a.built up sand bar up stream.
Mr. Clark reported that state and/or federal funds cannot be obtained.
Jack Burger, private contractor, commented on the damage to the ditch.
In his opinion; the damage began in the early 1970. He estimated his cost
to repair said ditch would he between 8 and 10 thousand dollars. He
charges $60 per hour to use his big machine and $30 per hour for his small
machine. Mr. Burger warned that if the ditch isn't repaired before the
high water anticipatednext spring the Delta Irrigation Co. won't receive
any irrigation water.
Mr. Clark stated that he maybe able to divert sane of the river water to
other ditches while the repairs are being made.
The amount of rip rap needed to repair said ditch, cost, delivery,
stock piling and sources were discussed.
The City of Greeley representative, Darryl Alleman, informed the
stockholders that the City may have rip rap that they want to get
rid of. Mr. Alleman was asked to meet with Alex Grauherger, Ditch
Rider and Stockholder, to determine where to pile rip rap if it is
available.
After additional discussion, James Clark, made a motion that the
thirty day meeting notice requirement be waived due to the breach
emergency, approve special assessment of $300.00 per share, and
further that all assessment payments are due on or before January
1, 1980. William Israel seconded the motion and it carried unanimously.
James Clark amended the above motion to include that a 12% interest
charge will be assessed after January 1, 1980 if the assessment has not
been paid. William Israel seconded the motion and it carried unanimously.
It was a consensus of the stockholders in attendance that Jack Burger
perform the service to repair said ditch as soon as possible.
The Special Meeting was adjourned by the President Norman Carlson at
8:25 P. M.
