HomeMy WebLinkAbout20121636 RESOLUTION RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #1159 - TERRY YOUNGLOVE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated September 10, 1997, the Board approved Use by Special Review Permit #1159 for a Private Airstrip in the A (Agricultural) Zone District for Leslie Vandenbos on the following described real estate, to-wit: NE1/4 of Section 28, Township 9 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from the current property owner, Terry Younglove, 1923 Elba Court, Windsor, Colorado 80550 to vacate said Use by Special Review Permit#1159, since the use of an airstrip is no longer being operated on the property, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. Mr. Younglove is requesting that USR-1159 be vacated from his parcel, 0455 28 000002 since the use of an airstrip is no longer being operated on the property. Background information: Legal Description: NE4 Section 28, T9N, R66W of the 6th P.M., Weld County, CO. Location: South of and adjacent to County Road 102 and west of and adjacent to County Road 31 SUP-119: USR-1159 was approved by the BOCC on September 10, 1997, for A Site Specific Development Plan and Special Review Permit for a private airstrip in the A (Agricultural) Zone District 2012-1636 To :Weld County Department of Planning Services From Terry Younglove Date 06-12-2012 Dear planning Service, I wish to vacate the USR -1159 airstrip on the proposed recorded exemption as described below in the requirements to record this plat. If you have any further questions or comments please contact me. Regards Terry Younglove The applicant has indicated over the phone that they wish to vacate USR-1159 for an airstrip. If that is still the intention of the applicant he will need to submit a letter to the Weld County Department of Planning Services indicating that he wishes to vacate USR-1159. If the applicant wishes to keep USR-1159 on the property Lots A, B and C will need to be resized or relocated to not interfere with the airstrip and then the applicant will need to apply for and be approved for a partial vacation of USR-1159 to have the airstrip entirely on proposed Lot D of RECX12-0049. Section 24.4.2.1—This proposal is consistent with the Weld County Comprehensive Plan,as amended. A.Goal 1 encourages the preservation of prime farmland for agricultural purposes. Soils on the site are considered high potential dry cropland by the USDA Soil Conservation Service map. The availability of a consistent supply of water must exist in order for soils to be classified prime. Land use on the site is principally nonirrigated crop production with improvements located in the southwest corner of the property.
