WHEREAS, the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 28th day of March, 1979 , in the Chambers of the Board of County Commissioners of Weld County, Colorado that a certain parcel of land is owned by William Mitze, which land is more particularly described as follows , to-wit: E1/2E1/2SW1/4 Section 22, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado. WHEREAS, the owners of said tract of land desire to obtain a variance from the minimum lot size requirement so that William Mitze may make application to the Board of County Commissioners to apply for a recorded exemption, as set forth in Section 9-4.A. (6) of the Subdivision Regulations , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, based upon the recommendations of the Department of Planning Services, feels that the applicant has not shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a variance from lot size requirements be, and hereby is, denied to William Mitze for the abovedescribed parcel of land. Weld County, Colorado 915 10th Street Greeley, CO 80631 RE: LSV-88 Dear Commissioners : The attached letter and related materials are in reference to a request for a lot size variance from William Mitze. The property on which this request has been made is described as the EkEkSW4 Section 22, T2N, R66W of the 6th P. M. , Weld County, Colorado . This property is located approximately 2 miles northeast of Ft. Lupton, directly north of Aristocrat Ranchettes Subdivision. The property contains approximately 40 acres of Class IV and VI rigated soils . The request is to obtain a variance from the mini- mum lot size requirement, Section 9-4 A. (6) , so that he may make application to apply for a recorded exemption. Section 9-4 A. (6) of the Weld County Subdivision Regulations states : "That the original tract or parcel of land to be divided under this section meets the minimum lot size requirement established by the Weld County Zoning Resolution; variance from this requirement being allowed only upon good cause being shown to the Board of County Commissioners or where said tract or parcel of land lies within the Compre- hensive Plan area of an existing incorporated town of Weld County (Revised 4-17-74) ." If this lot size variance is granted, Mr. Mitze will proceed with his application for a recorded exemption to divide the property into two parcels. One parcel is proposed to contain approximately 5 acres which will be used as a residential building site. The second parcel of approximately 35 acres will continue to be used for a greyhound kennel. There is an existing mobile home and other improvements located on the proposed 35 acre parcel . Board of County Commissioners Page 2 March 28, 1979 Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recoiiuiiends this request be denied for the following reasons : 1. The proposed request does not comply with the Weld County Compre- hensive Plan because it would promote non-agricultural use of agricultural land and it would encourage urban encroachment on rural land use. 2. This request is not in conformance with the intent clause of the Agricultural Zone District (Section 3 . 3 A. of the Weld County Zoning Resolution) which states : "Intent - The intent in establishing the A-Agricultural Zone District is to allow all agricultural related uses in those areas in which agriculture is and should con- tinue to be the predominant land use. This district is intended to discourage encroachment of incompatible uses upon the agricultural land in a district, to encourage agricultural uses as the highest and best use of the land in the district as compared with other uses in con- flict therewith, and to provide for the orderly expansion of urban growth in conformance with the Weld County Com- prehensive Plan." This request would not be encouraging agricultural uses as the highest and best uses, it would not be providing for the orderly expansion of urban growth, it would be promoting the division of agricultural land into smaller less economic parcel sizes, and increasing the residential density on the 40 acres . 3 . This request is not in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Sub- division Regulations) . Said clause states : "The intent in establishing the recorded exemption pro- cedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby non-productive agri- cultural lands may be developed for higher and more productive uses insofar as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. (Revised 4-17-74) ." The parcel contains only one set of existing improvements . The split would allow an extra set of improvements to be built on the 40 acre parcel and therefore, create an urban encroachment which would be noncompatible with the Agricultural District. Board of County Commissioners Page 3 March 28, 1979 4. The minimum lot size in the Agricultural Zone District for ir- rigated parcels is 80 acres and for non-irrigated parcels is 160 acres. The intent is to maintain tracts which are large enough for farm purposes , and to assist in the encouragement of agri- cultural uses as the highest and best use of the land. This request is in violation of that intent. The required minimum lot width in the Agricultural Zone District is 180 feet as set forth in Section 3 . 14 of the Weld County Zoning Reso- lution. Mr. Mitze' s request, as presented, has only 160 feet of lot width on the proposed 35 acre parcel . Therefore, if this lot size variance is approved by the Board, Mr. Mitze should provide the mini- mum 180 feet of lot width or obtain approval from the Weld County Board of Adjustment for a variance from the 180 foot minimum lot width requirement prior to approval of a recorded exemption on this property. Lupton Planning Commission met 3/8/79 at 7:00 P.M. at the City Hall. Chairman Alan Sandberg called the meeting to order. Members present at roll call were Alan Sandberg, Tony Trujillo, Joe Martinez and Corky Colgrove. - Andy Lake was absent. The minutes of the meeting of 2/8/79 were approved as presented on a motion by Joe Martinez, 2nded by Corky Colgrove and all members voted "aye". Joe Martinez reported the Weld County Planning Commission are going to meet 3/13/79 at 7:30 to discuss revising their procedures. He asked members of the Commission to try to attend. Chairman Alan Sandberg declared the Public Hearing for re-zoning areas in the Flood Plain open' and it was explained the reason for the re-zoning was to allow persons to obtain Federal Flood Insurance should they desire to build in the area. There were no comments and Joe Martinez motioned to recommend adopting the zoning to the City Council, 2nded by Corky Colgrove and all members voted "aye" at roll call. Jim Erger, salesman for Century 21 in Commerce City, discussed with the Commission the land north of Lancaster Subdivision. The cities major storm drainage plan calls for approximately 7 acres to be used as a future detention pond. Mr. Erger has this property listed to sell for $6500.00 per acre. Comments were made on the necessity of having a pond there and it was suggested trying to locate it on the northeast corner of Lancaster. The matter was referred to the City Engineer, Tom Norton. The proposed annexation of the Williams property along south Fulton was discussed as was the proposed zoning of R-1 and R-2. R-2 would allow up to 4 units to be built on lots 5-6-7-8-9. The consensus of the Commission and residents present from the balance of the area that is not annexed to the City, to circulate a petition and annex the entire area at the. same. time. The matter was re-scheduled for 3/22/79 before the Planning Commission. The setbacks-in Ranchero was discussed. Dave Schneider, Chairman of the Board of Adjustment, reported on the meetings they have held and said they did not feel they could grant a blanket variance to Ranchero and had referred it to the Planning Commission. There are 13 lots that do not meet the setback requirements that have houses already built on them and the Commission agreed there is nothing that can be done about these. The 16 lots_ Ralnc�hero._ asked for setback. variances on were discussed and Joe Martinez mOLiuucu ��aL air.lots. 1 regulations .must be adhered to and also that' all applications for building permits must be accompanied by plot lans showing the location of the buildings on the lots to insure P P setbacks are correct. Corky Colgrove. 2nded. the motion and all members voted "aye". There was some discussion on the problems with drainage in Lancaster and the detention pond and master storm drainage plan. Steps should be taken to have the developers comply with the drainage plan rather than assess the property owners at a later date. The Re-zoning application from Clyde Malara to change the zoning from A-Agriculture to I- ' Industrial was discussed. This request is for a parcel of ground between road 10 and road 8, east of old 85. He wants to convert a storage. building into a recreational vehicle manufacturing business. After some discussion, Corky motioned to advise the Weld - County Planning Commission to reject the application as it does conform to Ft. Lupton's General Plan. Joe Martinez 2nded the emotion and. all-members voted. "aye". • The Commission discussed the Lot Size Variance request from Wm. Mitze to allow them to buil a home on a 5 acre parcel located in the EIESISW1/4 Sec.22 T2n, R66W. Joe Martinez motioned to advise the. Weld County Planning Commission that we have no objections to the variance. Tony Trujillo 2nded the motion and all members voted "aye" at roll call.
