Proposed USE of the Property ski e 'ce,Inc. (A& NV) on land owned by and leased from The Gulleys,Parcel #08011700090, r poses to create a"Water Loading Dock"on a portion of the foregoing parcel. The Water Loading function would initially be served by an existing hydrant in CR-70 owned by North Weld County Water District(NWCWD). Up to 10-20,000 gallon future water tanks and appropriate msnifolding, would also be served by NWCWD. Trucked water will be provided to oil/gas operations in the area. An average of 75 round trip truck tanker loads(85,000#GVW-maximum)per day would occur under the first phase and up to 150 round trips should future tanks be installed.. Approximately 1.59±acres of the 141+acre parcel would be impacted. No employees will be stationed on the Site. Employees will be truck drivers and occasionally a supervisor. Hours of operation will be 24 hours/day, 365 days/year. No septic nor potable water will be required for the Loading Dock. No electric service is required and the future tanks on skids, self contained and portable. Authorization for one portable toilet is specifically requested in this USR Application. No paved surfaces nor buildings are proposed. No landscaping nor screening is proposed as the location is within a tilled field. All adjacent uses are agricultural and/or rural residences. No new grading will occur on the essentially flat Site. An existing gravel access road from CR- 70 and a gravel loading area will be utilized. An additional egress point is proposed to CR-70. Per the January 27,2012 Pre-Application Meeting,Ms.Heidi Hanson, Weld County Public Cc 5-�j—lz Works, stated,"No Tracking Pad (required)unless paved(CR-70) or a problem exists." Also see Pre-Application Minutes. The 1.59±acre Site is separated from the 141+acre total parcel via a Subdivision Exemption (SE) process(SUBX12-0002). A& W Water Service, Inc. and The Gulleys will enter into a lease for the use of the SE Parcel. Appropriate notification will advise the County of any future changes in lessee(s) over the course of the SE/USR. No.2 Consistency with the Intent of the Weld County Code.Chapter 22 of the Comprehensive Plan Comprehensive Plan Consistency The Weld County Comprehensive Plan addresses goals and policies for agriculturally zoned properties and oil and gas facilities. The Comprehensive Plan also addresses the presence of oil and gas deposits in the County and encourages the extraction of oil and gas resources that conserve the land and minimize the impact on surrounding land and the existing surrounding land uses. This new facility will assist in the extraction of oil and gas resources as water is a critical component to the drilling operation. The new Water Loading Dock and future tanks should not impact the area surrounding the facility. The proposed Water Loading Dock will decrease the impact on roads and traffic in other areas of Weld County by providing access to water that is closer to drilling operations in the area. Trucks that transport the water will drive less to service operations in the area, thus decreasing impact on roads throughout the County. A & W Water Service, Inc. will pay for all on and off site improvements attendant to the planned USE. The USR is serviced by an existing North Weld County Water District(NWCWD) line and hydrant in CR-70. No.3: Consistency with the Intent of the Weld County Code. Chapter 23 (Zoning) and the Zone District in which it is located Section 22-2-10(D) emphasizes the extraction of natural resources as an important part of the economy of the County. The Water Loading Dock supports the extraction of these natural resources by providing water for drilling processes. Oil and gas facilities are allowed as a Use by Right in the A(Agricultural) Zone District. Oil and gas support and service operations require Use by Special Review authority. No. 4: Surrounding USES The parcel abuts CR-70 and is located approximately 2+miles southeast of the Town of Galeton and 3*miles northwest of Gill. Farm/ranch/grazing operations are to the north, west, east and south with rural residences to the northwest. Oil/gas wells abound throughout the area. No. 5: Ouestionnaire Response a. Water Loading Dock: At maximum capacity use, up to approximately 75 people will visit the site per day. b. None—all employees will be transient,truck drivers and an occasional supervisor. c. The Site will be open 24 hours per day, 365 days per year. d. Water Loading Dock: Ten 20,000-gallon portable tanks -- (future). e. None. f. Water Loading Dock: The Use will be serviced by up to 85,000 lb. tractor trailers. Maximum round trips will be 75 per day initially, potentially increasing to 150/day. g. No. 7: Reclamation The proposed Uses will have little impact on the land. In the unlikely event that the Uses are terminated, USR improvements, (the water tanks) would be removed from the property,and the parcel would be reasonably restored to its condition prior to the USR, with farming operations where the USR activity on the parcel has occurred. No. 8: Storm Water Drainage None. No. 9: onstruction Schedule Water Loading Dock: No initial construction is required for this use except some additional gravel. Ten (10)portable frac tanks may be placed on the Site at a future date. No. 10: Waste Storage/Stockpile No storage or stockpile of wastes will occur associated with this Use. LAND LEASE THIS AGREEMENT is made and executed this day of , 2012, by and between Steven E. and Sheryl L. Inc., whose address is Box 887, Fort Lupton, CO 80621. hereinafter referred to as "LESSEE". WHEREAS. Rent: Lessee shall pay Lessor without demand the sum of Five Hundred & no/100 ($500.00) Dollars per month on or before the 10th of each month for that month and monthly thereafter during the original term hereof or any extension thereof. Upon installation of tanks on the Premises the rent shall increase to Six-Hundred-Fifty ($650.00) per month. Lessee agrees to pay the rent to Lessor at 33605 CR-53. Gill, Co., 80624, or at such other place as Lessor may from time to time request. 4. Remediation Fee: Lessee shall pay Lessor a non-refundable fee for Lessor's restoration of the Premises upon expiration/termination of this Lease Said fee of One Thousand & no/100 Dollars ($1000.00) shall be due and payable upon mutual execution of this Lease. 5. Access and Use: Lessor hereby also grants to Lessee, during the initial term hereof or any extension thereof, the exclusive right of access, in common with the Lessor, over, on, to and from the Premises including two accesses to CR-70 and the use of the Premises. 6. Utilities: Lessor shall pay all utility charges, including but not limited to water, sewer, electricity, telephone and any other utilities. 7. Real Estate Taxes: All real estate taxes levied upon or due and owing on the Premises during the term of this Agreement shall be paid for by and are the responsibility of Lessor. 8. Improvements: Lessee shall have the right to make, install, and construct improvements at the Premises with the consent of the Lessor. All Lessee owned improvements shall upon the expiration or earlier termination of this Agreement be the property of the Lessee. unless otherwise agreed between the Parties. Lessee owned improvements would include tanks and appurtenances but not Site improvements such as gravels. culverts. cattle guards and grading. 9. Maintenance of Premises: Lessee hereby covenants and agrees that he will use due care at the Premises and that he will be responsible to pay for any and all needed repairs of Lessee owned improvements, which are necessitated by any error, act or omission on the part of Page 2 Lessee. Lessor agrees to plow snowfall over six (6) inches in depth to allow Lessee's reasonable access to the Premises. 10. Repair of Damage: In the event that the Premises is either partially or totally destroyed or damaged by fire or other casualty, necessitated by any error. act or omission on the part of the Lessee, the repair shall be the full responsibility of the Lessee. 11. Insurance: Lessee is responsible for insuring the Lessee owned improvements located thereon against, fire, theft and any and all other casualty and loss. The Lessor will not be held liable due to theft or vandalism of the Lessee owned property 12. Indemnification by Lessee: Lessee hereby covenants and agrees that he will indemnify, defend and hold harmless, the Lessor from any and all claims, demands, suits, causes of action, losses, damages, expenses and/or any and all litigation arising out of occurrences, in or at the Premises or as occasioned or suffered by the Lessee or any of his employees, agents. invitees. occupants, or other persons in attendance in or at the Premises, including for any damages awarded for such claims, demands, causes of action, losses, damages and expenses or for costs or attorney's fees, due to the error, act or omission of the Lessee. 13. Laws, Regulations and Codes: Lessee shall at all times during the term of this Agreement comply with all local, state and federal laws, building, fire and sanitation regulations and codes as they affect Lessee's enjoyment of the Premises. 14. Waste and Nuisance: Lessee hereby covenants and agrees not to commit waste on or at the Premises or allow it to be committed nor permit maintenance of a nuisance or any other noxious matter which may interfere with or affect the Premises. 15. Surrender of Premises: Unless otherwise agreed between the parties or unless as otherwise provided for by the terms of this Agreement, Lessee hereby covenants and agrees to surrender the premises at the end of the term arranged for under this Agreement or any extension hereof, and to remove within Ninety (90) days of said expiration all Lessee's personal property occupying the Premises, so that it is restored to the same or similar condition it was in before Lessee first occupied it, other than improvements performed by Lessee constituting fixtures, with exception for reasonable wear and tear or damage by unavoidable casualty not able to be repaired in time. Any and all property not removed from the Premises within Ninety (90) days at the end of the term of this Agreement or any extension hereof, will be considered to have Page 3 reverted to the status of building improvements belonging to the Lessor or to have abandoned as to any and all rights or claims of Lessee, and will be at Lessor's sole right of disposal. 16. Assignment and Subordination: Lessee during the term hereof, shall not have the right to sell, assign, sublease, mortgage or encumber any part or all of the Premises, without the prior written consent of the Lessor, which may not be unreasonably withheld by the Lessor. 17. Events of Default and Remedies: A. Events of Default: Each of the following events shall constitute an event of default under this Agreement: (1) If Lessee shall fail to pay any annual installment of rent or any other charges or payments provided for in this Agreement on the date the same is due; (2) If Lessee shall default in the performance of or compliance with any of the terms, covenants, agreements, conditions or provisions of this Agreement and shall default shall continue for a period thirty (30) days after written notice thereof by Lessor to Lessee; (3) If a receiver or trustee is appointed to take possession of all or a substantial portion of the assets of Lessee; (4) If any bankruptcy, reorganization, moratorium, insolvency, creditor adjustment or debt rehabilitation proceedings or the like are instituted by or against Lessee under any state or federal law; (5) If a liquidator, receiver, custodian, sequester, conservator, trustee or other similar judicial officer is applied for by Lessee or appointed for Lessee; and (6) If Lessee becomes insolvent in the bankruptcy or equity sense. 18. Time of the Essence: Time is of the essence with respect to any time period for the performance of any conduct or act by either party set forth in this Agreement. 19. Waiver: No delay, omission or failure to exercise any right of Lessor under this Agreement shall be construed as a waiver of any such right or as impairing any such right. Any waiver by Lessor of a single breach or default shall not be construed as or constitute a waiver of any prior to subsequent breach or default. All remedies provided for above or by law, or otherwise afforded to Lessor, are cumulative and not alternative. 20. Binding Effect: This Agreement shall be binding upon and inure to the benefit of the parties hereto, their respective heirs, executors, administrators, successors and assigns. Page 4 21. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado. 222. Severability: If any provision of this Agreement is held invalid by any court of competent jurisdiction. said provision shall be deleted from this Agreement, but such invalidity shall not affect the other provisions that can be given legal effect without the invalid provision. 23. Counterparts: This Agreement may be executed simultaneously in one or more copies or counterparts, each of which shall be deemed an original. but all of which together shall constitute and be one and the same Agreement. 24. No Recording: The parties covenant and agree that this Agreement shall not be recorded at the Office of the Clerk and Recorder of Weld County. Colorado. An occasional supervisor with pickup will inspect the operations. Traffic will enter and exit the Site on an existing gravel access and a new access proceeding at minimal(10 mph) speed, access the hydrant and/or Water Loading Dock,thence egress to CR- 70. Access Permit Application Forms are hereby tendered for the entry/egress points. Traffic to and from the USR Site is dependent upon actual water user demand. Initial projections suggest some 75 round-trip trucking events per day, spread over a 24-hour period with up to 150 round trip events should future water tanks be installed. These levels were discussed in the Pre-Application Review of January,27, 2012 and at that time Ms. Heidi Hansen of Public Works indicated a Traffic Study would be waived. That said, future water storage and trips could trigger "Thresholds"requiring additional traffic/road enhancements. Ms. Hanson stated, "No Tracking Pad(required)unless paved(CR-70)or a problem exists". The 7-Day Completeness Review dated May 4,2012 now states: "Traffic Study—Revisions to the Traffic Narrative ARE required The information provided in the traffic narrative is incorrect. A traffic study was not waived at the pre-application meeting, it was stated that the applicant could provide a detailed traffic narrative for the Traffic Engineer to review and decide if she would like a complete traffic study. The Pre- application minutes are attached which reflect this discussion. Also tracking control for the site was not waived The attached pre-application minutes say that an Improvements and Road Maintenance Agreement is required Tracking control has been consistently required on all other facilities of this type and will be required in the Revised May 9,2012 Improvements Agreement for this facility. The level of tracking control may be phased based on truck numbers and whether the road is paved but bask tracking control consisting of double cattle guards will be required up front to prevent tracking of mud onto the gravel roadway. The traffic narrative needs to be revised to contain the following information: • primary haul route to and from the facility • trip distribution along the haul rout(Le., 50% of traffic will come from the north,20%from the south,30%from the east) • include and acknowledge the following road improvements triggers in the narrative 1. 200 vpd or significant dust as identified by County-Mag-Chloride dust abatement 2. 300 vpd pavement 3. 10 vph during peak hour turning left into the facility-left deceleration lane 4. 25 vph during peak hour turning right into the facility-right deceleration lane 5. 50 vph during peak hour turning right out of the facility-right acceleration lane." As of May 8, 2012, it is our understanding that cattle guards will not be required as adequate gravels will be placed on site to avoid tracking and entry/egress are "gravel to gravel" Recent County analyses(2006)suggest a current traffic count of 57/day on CR-70. Most USR traffic(90%±) is projected to enter and exit the USR Site on CR-70 and travel from and to CR-51 averaging 3 loads/hr x 24 hours=72 loads/day. Due to steady hydrant deliverability no peaks are expected until future water tanks are installed which could trigger the foregoing mentioned"Thresholds". As stated foregoing, the haul route is CR-70. Ninety percent of the traffic will arrive and depart from/to the west toward CR-51,thence split(50/50%) north and south. The remaining ten percent will arrive and depart from/to the east toward CR-53,then split (33/33/33%) north, east and south. The foregoing road improvement triggers are hereby acknowledged. No peak hours are anticipated with averages,therefore, initially at 6 vph and at build out 12 vph. The only anticipated future triggers are therefore Nos. 1 and 2. The proposed site is located in the NW Y of the NE % of Section 17,Township 6 North, Range 64 West in Weld County. More specifically, the site is located approximately 3200 feet east of the intersection of Weld County Road (WCR) 51 and WCR 70. The site is bound on the north by WCR 70 and on the other three sides by undeveloped farmland. The existing site is covered by natural grasslands and is 1.59 acres. The existing topography of the site slopes from the southeast corner to the northwest corner at a 1%to 1.5%grade. The proposed development of the site will consist of the installation a "water loading dock"with ten(10) 20,000 fresh water tanks. A gravel road base area will be installed around the tanks. An existing gravel drive off of WCR 70, located at the northwest corner of the site, and a new gravel drive, located near the northeast corner of the site, will be used to access the site. The existing drainage from the site sheet flows from the southeast to the northwest. Offsite flows from the undeveloped natural grasslands south and east of the site also sheet flow across the site. Since the proposed development of the site is minimal,the existing drainage patterns will be maintained and the difference in the overall runoff generated from the site will be negligible.
