Unloading and Polishing Facility
A Use by Special Review Permit for a Crude Oil Truck Unloading and Polishing Facility,
including compressors
The Weld County Public Works Department has reviewed this proposal. This project falls
under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division
4, Section 23. Staff comments made during this phase of the Use by Special Review process
may not be all-inclusive, as other issues may arise during the remaining application process.
All issues of concern and critical issues during further review must be resolved with the Public
Works Department.
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the
state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-
350-2163) to verify the access permit or for any additional requirements that may be needed to
obtain or upgrade the permit. (State Highway 14)
Weld County also has 30 feet of unmaintained County right-of-way (30 feet in Sec 25, T8N,
R63W, no right-of-way in Sec 30, T8N, R62W) along CR 73 section line alignment.)
Verify, show and label all existing right-of-way on the Plat.
Access/Roadway:
Access to the site will be from State Highway 14; the application has been submitted to CDOT.
Please show and label on the Site Plan, the proposed access width and the turning radiuses
into the site, 45'-60' radiuses required to accommodate trucks, and all CDOT improvements
needed.
Tracking control is required to prevent tracking of mud and debris on to the State Highway.
Please show and label a double cattle guard (2 cattle guards placed back to back to allow for a
full rotation of truck tires) at the access. Place the cattle guards far enough back from the
State Highway to allow a tractor trailer to completely pull off the State Highway before crossing
the cattle guards, not in State right-of-way.

Traffic:
The Briggsdale facility will operate 24/7, initially utilizing 4 loading bays that can handle up to
110 truckloads per day. However, 4 additional loading bays are planned. If the number of
bays increases, there could be up to 220 truck trips per day. In addition, 1-2 water trucks, 3
emulsion trucks, 3 employee vehicles and pick-ups, mail and deliveries will use the site.
Permits:
Contact the Permitting/Inspection agent for Weld County Public Works, at (970) 304-6496, ext.
3764 for a Right-of-Way permit for any work that may be required in the right-of-way on County
roads. A special transport permit will be required for any oversized or overweight vehicles that
may access the site and may also be obtained through the same office.
Please place the following note on the Plat:
1 . Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds
exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds.
2. Off-street parking spaces including the access drive shall be surfaced with gravel,
asphalt, recycled asphalt base, concrete or the equivalent and shall be graded to
prevent drainage problems.
Stormwater:
A preliminary drainage report was received on August 31 , 2012. The report was stamped
signed and dated by Steve Sciscione, P.E. # 46051 .
Please provide a drainage report that follows the USR-SPR Drainage Report Checklist and a
complete set of construction drawings that have been stamped, signed, and dated by a
registered professional engineer licensed in the State of Colorado.
Comments from the review of the submitted drainage report must be addressed in the
resubmitted drainage report and on the construction drawings. The comments have been
summarized and have been returned to the applicant's engineer under separate cover.
Please place the following notes on the Plat:
1 . The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
2. The applicant must take into consideration storm water capture/quantity and provide
accordingly for best management practices.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
Grading Permit:
The project will disturb over an acre of land therefore, a Weld County Grading Permit is
required before construction.

Please add a condition of approval requiring a grading permit prior to the start of construction
at the site.
Improvements Agreement:
Weld County Public Works is asking applicant to enter into an Improvements Agreement and
post collateral for all on-site and off-site improvements.

Drawing Comments
The Weld County Public Works Department has reviewed this proposal. This project falls
under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division

may not be all-inclusive, as other issues may arise during the remaining application process.
All issues of concern and critical issues during further review must be resolved with the Public

COMMENTS:
Comments provided in this memo relate only to the drainage report and construction drawings.
There may be other outstanding issues that are not addressed in this memo.
Drainage:
A drainage report was received o0ctober12 , 2012. The report was stampSgned and
dated by Steve Sciscione, P.E. # 46051 .
The narrative of the drainage report appears to be acceptable to Public Works.
Sheet C-201 that was included in the appendix is the only sheet with any comments. Please
address the following comments with regards to Sheet C-201 .
1 . Please label the 100-year water surface elevation on the three detention ponds. Please
show the 100-year water surface elevation for the detention ponds.
2. It is unclear what the line in Sub-basin B-2 is delineating. Please label the line shown in
Sub-Basin B-2.
3. It is unclear what the line around Detention Pond B represents. Please label the line
around Detention Pond B.
4. It is unclear what the line to the left of Detention Pond B represents. Please label the
line.
5. The symbology used in the legend to present future improvements does not match the
symbology used on the sheet. Please review and revise as necessary.
6. The ouffall pipe shown for Detention Pond C does not match the ouffall pipe with
regards to diameter and pipe type shown on the construction drawings. Please review
and revise as necessary to ensure that the construction drawings are consistent with
the developed drainage plan (Sheet C-201) in the drainage report.

7. The drainage plan calls for Type L riprap to be used in all locations where riprap is
required. Type L riprap needs to be buried. If Type M riprap is used, it does not have to
be buried.
Construction Drawings:
1 . The ditch names shown in the construction drawings are different than the ditch names
used in the drainage report. Please review the construction drawings to ensure that the
terminology used to name the ditches is consistent with the terminology used on the
Developed Drainage Plan (Sheet C-201) of the drainage report.
2. Please address the redline comments on Sheets C-209 through C-502.

Environmental Health Services has reviewed this proposal fora Mineral resource
development facility - an Oil and Gas Support and Service Facility (Crude oil truck
unloading and oil polishing facility, compressor facility and central processing facility) in
the A (Agricultural) Zone District.
The dust abatement plan states that a water truck will be utilized during construction
and the access road will consist of gravel road base. The dust plan shall be updated to
indicate the areas that will consist of asphalt such as the truck unloading and stacking
area. The plan shall also stipulate that interior roads will be gravel or asphalt. Also,
water should be added as a dust control measure after construction if necessary.
The waste handling plan stipulates that there will be a trash dumpster on site that will be
serviced by Waste Management.
A Spill Prevention Control and Countermeasure plan (SPCC) will be required and the
plan shall be available on site at all times.
A truck thaw building is proposed. This facility will be utilized to thaw frozen discharge
valves on the trucks in order to release the oil. A detailed design and operation plan is
required to ensure there is no discharge to groundwater.
The application indicates that restroom facilities will be provided, however a timeline for
construction was not included. As there will be 5 full time employees on site, permanent
water and sewer is required.
The application states water that is separated out of the oil will be directed to a water
recycling facility. It is not clear if the water recycling facility will be located on this site.
In order to avoid the requirement to obtain a Certificate of Designation, plans for the
proposed water recycling facility are typically submitted to the Colorado Department of
Public Health and Environment (CDPHE) Hazardous Materials and Waste Management
Division's Solid Waste Unit for review and designation as a water recycling facility.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1 . The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that a well is appropriately permitted for the
commercial use.
3. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
4. A Spill Prevention Control and Countermeasure plan shall be submitted to Weld
County Department of Public Health and Environment (WCDPHE).
5. A detailed design and operations plan for the truck thaw building shall be
submitted to WCDPHE for review and approval. The design shall demonstrate
how all spilled waste, stormwater and wash down water will be contained. The
design shall also include the method to prevent leakage. A leak detection
system shall be designed and installed beneath the washout bay. The truck
washout shall be constructed and operated in accordance with the approved
design.
6. Submit plans for the proposed water recycling facility to the Colorado Department
of Public Health and Environment (CDPHE) Hazardous Materials and Waste
Management Division's Solid Waste Unit for review and designation as a water
recycling facility. Provide documentation to WCDPHE indicating approval of the
water recycling facility. Alternately, the applicant can provide evidence from
CDPHE that they are not subject to these requirements.

7. The applicant shall submit an updated dust abatement plan, for approval, to
WCDPHE. The plan shall include at a minimum, the following:
Specify all areas that will consist of asphalt. Stipulate interior roads will be gravel
or asphalt. Indicate that water will be added as a dust control measure if
necessary.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy:
1 . An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code or all

applicable State noise statutes and/or regulations.
8. The operation shall comply with all applicable oil and gas operations regulated by
the Colorado Oil and Gas Conservation Commission.
9. In accordance with the Underground and Above Ground Storage Tank
Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed
around the aboveground fuel tanks. The volume retained by the spillage berm
should be greater than the volume of the largest tank inside the berm.
Alternative protective measures may be allowed provided they comply with the
Above Ground Storage Tank Regulations.
10.The truck washout shall be operated in accordance with the approved design and
operations plan.
11.The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
12.Any petroleum contaminated soils on the facility shall be removed, treated or
disposed of in accordance with all applicable rules and regulations.
13.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
14.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
15.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. inside use only, etc. Also,
the applicant should be made aware that groundwater may not meet all drinking
water standards as defined by the Colorado Department of Public Health and
Environment. We strongly encourage the applicant to test their drinking water
prior to consumption and periodically test it over time.
16.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
17. A Spill Prevention Control and Countermeasure plan shall be kept on site, at all
times.

18.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
19.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
20. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
21.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following comments:
A building permits will be required for the Oil and Gas Support and Service Facility and associated buildings and
equipment. A building permit application must be completed and two complete sets of engineered plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted.
A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or a open
hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006
International Mechanical Code; 2006 International Plumbing Code: 2006 International Energy Code; 2006
International Fuel Gas Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility Code the 2006
International Plumbing Code. and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.

This referral does not appear to qualify as a'subdivision`as defined in Serticin 33-28-
101(10JIa),C.R.S. Therefore,pursuant to the State Engineer's March 4.2005 and March 11,2011
memorandums to county planning directors,this office will onry perform a cursory review of the
referral information end provide informal comments. The comments do not address ire adequacy of
the water supply plan for this project or the ability of the water suppry plan to satisfy any County
regulations or requirements. In addition,the comments provided herein cannot be used to
guarantee a viable water supply plan or infrastructure,'he issuance of a wad permit,or physical
availability of water.
Noble Energy and Wattenberg Holding LLC propose to create a truck unloading and oil
polishing facility,referred to as the Briggsdale Facility.o1 an 80 acre site owned by Leonard and
Tammie Ball. The site will also Inehide a compressor station,and a future central processing tastily
There will be up to five full lima employees at the site,and additional visits by oil trucks,water
trucks,and varlet*other vehiclas.
There is no existing water source on the property. A water truck will be used to control dust
at the site during contrruction. Noble Energy and Wallenberg Holding LLC propose to obtain a
permit to conduct a commercial well to supply water for a restroom facility at the site. It is
anticipated that a commercial exempt weli permit could be obtained for the site. This type of well
may be used for drinking and sanitary purposes inside a oommeieial business.with no irrigation or
other outside use allowed. The amount of water allowed to be withdrawn would be limited to one:-
third of an acfe-foot(106.600 gallons)per year. This office's final determination regarding If a well
permit can be issued fa•the site will be made at the time a well permit application is submitted to this
office.
