SUBJECT: USR-1787, Dietzler Water Resources Corporation
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not completed at this step in process.
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:
CRs 95 is local gravel roads and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
CR 122 is collector roads and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld

IMPROVEMENTS AGREEMENT:
This Use by Special Review will be subject to a designated haul route and any intersection improvements such
as adequate turning radiuses, dust control if needed, on-site improvements or upgrades necessary to
accommodate this type of use.
TRAFFIC STUDY:
The applicant has provided a Traffic Impact Study for the Dietzler loading facility prepared by Fox Higgins.
After reviewing the submitted traffic study and visiting the project site I have prepared the following comments:
1. Please submit a revised copy of the Traffic Study that is signed, stamped, and dated by a registered
professional engineer licensed in the State of Colorado.
2. The applicant is proposing approximately 320 round trips per day to the facility.
3. Public Works staff has identified the haul route for this facility to travel 2 miles north on WCR 95 to
WCR 122 traveling 3 miles west to the paved portion of WCR 122.
4. An annual road inspection will be performed in the spring to establish the condition of the haul route
and surrounding roadways to determine if any road damage was caused by the operation of the loading
facility.
5. The applicant will be responsible excavate, repair, or patch any damage on the roadways to mitigate for
heavy truck traffic volumes created by the loading facility. The type and method of repair will be
determined by the Department Public Works.

6. If road damage is beyond repair, the applicant will pay their proportional share for the reconstruction to
restore the road.
7. Roadways Improvements may be triggered due to heavy truck traffic associated with the facility:
a. Full Depth Mag-Chloride will be required when the traffic volumes reach 200 vpd.
b. CTB (Concrete Treated Base) with a Chip Seal or RAP is required when the traffic volumes
reach 300 vpd.
c. Pavement is required when the traffic volumes reach 500 vpd.
8. Turn lanes will be triggered once traffic volumes meet the following warrants:
a. 25vph turning right into the facility during a peak hour.
b. 10vph turning left into the facility during a peak hour.
c. 50 vph turning right out of the facility during a peak hour.
9. A stop sign will be required to be installed at the facility access onto WCR 95.
10. The access will have 60' radius to accommodate the larger trucks entering and existing the site.
11. No parking or staging of commercial vehicles on the county road is allowed. Use on-site parking area.
PRELIMINARY DRAINAGE:
The applicant has provided a preliminary drainage report and plan for the Dietzler Water Resources project.
The preliminary drainage report was not signed, stamped, and dated by a registered professional engineer
licensed in the State of Colorado
1. Please address the redline comments on the drainage report and drawings that were returned to the
applicant's engineer. Future drainage report submittals must be stamped, signed, and dated by a
registered professional engineer licensed in the State of Colorado.
2. Please ensure that the Final Drainage Report addresses all items in the Preliminary and Final Drainage
Report Checklists.
3. Please provide design calculations for all swales and channels that will be constructed on the site.
4. Please show the detention pond in a drainage easement on the final plat and label the volume and
release rate.
5. Please include a map delineating the off-site drainage basins that drain onto the site.
6. The preliminary drainage report appears to be utilizing rainfall amounts for the town of Firestone. It is
not appropriate to utilize Firestone rainfall for a proposed site that is over 60 miles northeast of the
town. Please utilize the appropriate rainfall amounts shown in the NOAA atlas.
Grading Permit: Prior to recording of the final plat, the applicant needs to submit a grading permit showing:
proposed grading, erosion control placement, typical details for all BMPs to be utilized, and a Construction
Stormwater permit from the Colorado Department of Public Health and Environment. The permit must be
stamped by a registered professional engineer licensed in the State of Colorado. Please note that the grading
permit will not be released until the applicant has signed the improvements agreement, posted collateral, and
submitted the final plat for recording.

Drainage Report Comments
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:
The final drainage report was submitted for review on January 6, 2011. The report was stamped, signed and
dated by Frank Buturia, P.E. #31475.
The drainage report could not be fully reviewed due to miscalculations in the historic release rate. Proper
calculation of the historic release rate is the basis for all subsequent calculations made for sizing the detention
pond. The historic release rate calculated in the drainage report was based on the 80 acre parcel boundary
not the 9 acre project site. The detention pond size was calculated using the historic runoff rate for the 80 acre
site and a 9 acre runoff area. In order to properly calculate the historic release rate, the same acreage should
be used in both the historic release rate and detention pond sizing calculations. In this case, the historic
release rate and detention pond sizing calculations should have been based on the proposed project area of 9
acres.
However, to be consistent with water hauling USR applications that were reviewed subsequent to this
application, Public Works will allow the applicant to provide a water quality pond that is at least 6,000 cubic feet
in size in lieu of the full size storm water detention pond. Although a water quality pond can be utilized at this
point, the applicant should be aware that future development which increases the impervious area on the site
may require upgrading water quality pond to a full sized storm water detention pond.
If the applicant chooses to provide only a water quality pond at this time, please show the water quality pond
on the plat. Place the water quality pond in a drainage easement that is delineated on the plat and labeled as
a "No Build or Storage Area". Also label the capacity of the water quality pond on the plat.
If the applicant chooses to provide a full size storm water detention pond at this time, please correct the
calculations to properly reflect the historic runoff rate and the correct detention pond sizing.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility for a dry mining operation. As this is a temporary use, portable
toilets and bottled water are acceptable for sanitary uses.
Noise will be restricted to the level allowed in the industrial zone district. Noise can be
limited by utilizing haystacks, white noise backup beepers, equipment at bottom of pit
and a circular mining pattern.
Dust abatement will consist of watering roads, reducing vehicle speeds and covering
loads. The application states that water will be available from a water sprayer truck
which will be filled at the groundwater loadout facility just north of the site.
Waste will be placed in trash containers that Waste Chasers of Eaton will service.
There will be fuel storage on site that will not exceed 660 gallons. The fuel tank will be
contained within a secondary containment gravel berm. Individual above ground
petroleum storage tanks (AST) that are less than 660 gallon capacity are exempt from
State registration. The application indicates a Spill Prevention Control and
Countermeasures (SPCC) Plan will be in place for the fuel storage and will be available
on site.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence from the Air
Pollution Control Division, Colorado Department of Health and Environment that
they are not subject to these requirements.
2. The applicant shall submit a spill prevention, spill control, and spill
countermeasures plan (SPCC Plan) to the Environmental Health Services
Division of the Weld County Department of Public Health & Environment.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
6. Any vehicle washing areas shall capture all effluent and prevent discharges from
drum washing and the washing of vehicles in accordance with the Rules and
Regulations of the Water Quality Control Commission, and the Environmental
Protection Agency.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.

9. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. Portable toilets and Bottled
water are allowed in accordance with Environmental Health Policy 2.2.K. as
attached.
10.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
11.The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
12.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
13.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
14.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
15.If applicable, the applicant shall obtain a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division.
16.The operation shall comply with all applicable rules and regulations of the
Colorado Division of Reclamation Mining and Safety.
17.The operation shall comply with the Mine Safety and Health Act. (MSHA)
18. The operation shall comply with the Occupational Safety and Health Act.
(OSHA)
19.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Use of portable toilets and bottled water(revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Policy: Portable toilets are allowed in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day

Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.

Dear Ms. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information
and provide informal comments. The comments do not address the adequacy of the water supply
plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a viable
water supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
According to the submitted information, the applicant is proposing a dry aggregate mining
pit. The aggregate mine will be located on two neighboring parcels: Parcel A- 120 acres located
in the S1/2 of the SE1/4 and the SE1/4 of the SW1/4 of Section 30, T 10N, R 60W; and Parcel B -
40 acres located in the NW1/4 of the NE1/4 of Section 31, T10N, R 60W of the 6th P.M.
Per the applicant, proposed water uses are dust control for onsite aggregate pavement
drive aisles, processing and loading areas and the two-track ranch road and County Road 112
adjacent to the aggregate processing facility, all haul roads, circulation and stockpile areas.
The operation is not expected to encounter groundwater and shall be considered a dry pit.
Therefore, exposure of ground water must not occur during or after mining operations.
Per the applicant, the source of water for industrial uses at the Pawnee Aggregate Pit is
ground water from off-site well permit nos. 74874-F, 74876-F, 74877-F, and 74878-F, owned by
Halliburton Energy Services, Inc. Well permit nos. 74876-F and 74878-F are located in the SW1/4
of the NW1/4 of Section 29, T10N, R60W of the 6"' P.M. Well permit nos. 74874-F and 74877-F
are located in the NW1/4 of the NW1/4 of Section 13, T10N, R61W of the 6th P.M.

The approved uses for all four well permit nos. 74874-F, 74876-F, 74877-F, and 74878-F
are limited to irrigation, industrial and commercial, livestock, fish rearing, recreation, and pond
filling on 3840 acres of overlying land, in portions of Sections 17, 18, 19, 20, 28, 29, and 30 , T10N,
R60W and portions of Section 13 and 24, T10N, R61W of the 6th P. M . ; and additionally in all of
Weld County for industrial and commercial use via truck hauling . The proposed industrial use for
dust control via water trucks is consistent with approved uses .

On August 15, 2012,the Division of Reclamation,Mining and Safety(Division)approved your 112c
mining permit application.
Stipulation No. 1
A notarized agreement with Weld County for relocation of County Road 112 shall be
submitted to the Division prior to commencement of mining in Cell 4, which would
adversely impact the public roadway.
Stipulation No. 2
The Operator shall incorporate the relocation of Weld County Road 112 into the
reclamation plan by submittal of a technical revision, per Rule 1.9, prior to any full
reclamation release request being considered by the Division.
The amount of financial warranty set by the Division for this operation is$237,231.00. You must
submit a financial warranty in this amount and a performance warranty in order for us to issue a
permit. In the event you have requested a financial warranty form,we have enclosed it in this
letter. If you have not, please select a type of financial warranty from Rule 4.3. Then contact us so
that we can provide you with the appropriate warranty form. We have enclosed a performance
warranty form with this letter for your use.
PLEASE NOTE THAT MINING OPERATIONS MAY NOT COMMENCE UNTIL A PERMIT HAS BEEN
ISSUED BY THE DIVISION AFTER RECEIPT OF YOUR FINANCIAL WARRANTY AND PERFORMANCE
WARRANTY. A PERMIT WILL NOT BE ISSUED UNTIL WE VERIFY THE ADEQUACY OF BOTH YOUR
