This permit application is for the Gobbler Water Storage Facility and addresses all project components described below within unincorporated Weld County. 1. Explain, in detail, the proposed use of the Property This USR application for the Gobbler Water Storage Facility is submitted by Anadarko E & P. Anadarko has extensive oil and gas operations in the Denver-Julesberg (DJ) Basin, with the majority of the activity being located in Weld County. With the increased production of oil and gas in the County, support facilities such as water storage ponds are required to assist with the drilling operations. Anadarko is submitting an application for the construction of a water storage pond located on private land in the East half of section 23, Township 2 North, Range 66 West. This water storage facility will assist with Anadarko's drilling operations in the Wattenberg Field and will supply water for the drilling and hydraulic fracturing of oil and gas wells in the area,thus decreasing the amount of truck traffic necessary for operations. Water, which is critical to these activities, will be stored at this facility and will come from an existing 1 %" water tap that will be upsized to 4". The pond will be approximately 4 acres in size and is expected to hold an estimated 30 acre feet of water. A small storage building is shown on the plan but is not expected to be constructed with the initial development.The water will be piped from the storage facility to each individual drilling location. Anadarko is proposing the following equipment and improvements: • 4 acre storage pond that will hold 30 acre feet of water • Electrical floating pump powered by generator • Truck turnaround facility off existing access road • Fencing around facilities for safety and protection of site • Small storage building (potential future building) Please see the Site Plan in the Appendix for a more detailed layout for the proposed water storage facility. The access point for the facility is located off of Weld County Road 20. This entry point is already existing and facilitates Anadarko's other operations on the parcel. 5 2. Explain how this is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan The Weld County Code, Chapter 22, Comprehensive Plan, has been reviewed and the proposed project is consistent with the intent of the Comprehensive Plan, including Land Use, Environmental Resources, and Natural Resources. The Weld County Comprehensive Plan also outlines the policies for oil and gas facilities in properties zoned for agriculture. While the Plan seeks to minimize the impacts on surrounding lands and keep the surrounding land uses intact, it also promotes and encourages the development of oil and gas through orderly exploration. The proposed water storage facility will assist in the extraction of oil and gas resources, by providing water to individual drilling sites. Due to the small footprint of the storage pond and proximity to these sites, it maintains the integrity of the Weld County Code by limiting truck traffic in these areas, thus minimizing impacts to agricultural lands and operations, protecting air quality, and minimizing the cumulative impacts to County roads and other infrastructure. This protects the longevity of the agricultural resources in Weld County. In addition,the decreased amount of vehicles on County Roads making trips to individual drilling locations will also help ensure the safety of citizens who are in close proximity to these facilities. 3. Explain how this is consistent with the intent of the Weld County Code, Chapter 23 (Zoning)and the zone district in which it is located. While oil and gas facilities are classified as a use by right in the A Zone District (Agricultural), they still must take into consideration the welfare of the residents in Weld County. As discussed, the proposed water storage pond serves multiple functions that demonstrate its consistency with the intent of the Zoning provisions in the Weld County Code. The Use by Special Review Permit however, will be required. 4. Surrounding Uses and Compatibility with Surrounding Uses The proposed Project would be compatible with the surrounding land uses. Land surrounding the proposed Project is primarily used for agricultural purposes. The proposed Project would only remove 4 acres of land for the life of the project and would not interfere with any agricultural operations. 6 1 r � a 5. Describe the Following (Special Review Use Questionnaire) a. Number of people who will use this site A small crew, (approximately 2-3 people) will utilize the site between 2 and 4 times daily for approximately one hour each visit. The visits will be intermittent and involving monitoring the facilities. b. Number of employees proposed to be employed at this site Upon completion of construction, there will no full time personnel at the site. c. Hours of operation The site will operate during drilling times, which at times may be 24 hours a day and 7 days a week. d. Type and number of structures to be built on this site The storage pond will hold approximately 30 acre feet of water. There may also be a small monitoring and storage building on the site. e. Type and number of animals There will be no animals on site. f. Kind of vehicles that will access this site and how often The site will be accessed by pick-up trucks with a possible trailer. Access is estimated to be at most 4 times per 24 hour period. g. Fire protection The Fort Lupton Fire Protection District provides fire protection to the site. A letter will provided regarding information on this project. h. Water source on the property Water will be obtained from sources off-site through Anadarko leased or purchased sources, by a buried water line, and then fed directly to individual drilling locations. Water bottles shall be utilized for drinking during construction of the project. i, Sewage disposal system Sewage disposal is not required at the site. The facility is only being used for fresh water storage. Additionally, restrooms are not necessary. Anadarko will be providing a portable sanitation unit however, which will be emptied once a week. 7 j. Storage or warehousing A small storage and monitoring building may be constructed eventually, but is not expected to be constructed with the initial development 6. Proposed Landscaping There is no existing screening or additional landscape being proposed for this application. 7. Reclamation Procedures Upon termination of the proposed project, the storage facility would be removed, along with all equipment associated with its operation. The ground would be re-graded to accommodate agricultural uses. S. Storm Water Drainage The storage pond is located on a relatively flat parcel and will be surfaced with gravel. Please refer to the drainage report in the appendix of the application for additional details. 9. Construction Period Construction of the proposed water storage facility is expected to commence shortly after the site plan and Use by Special Review application are approved. We expect construction to be complete before the end of 2012. 10. Waste Handling Plan The only source of waste on site will be from the portable sanitation unit, which will be emptied on a weekly basis. No chemicals will be stored on site, nor will vehicles be washed. In the unlikely event of a motor vehicle oil leak (potentially during construction), or leak by the surface generator, Anadarko standard operating procedures are to dig up the contaminated soil and ship it to the (Ault Waste Management Facility or add other facility). Anadarko then tests and analyzes the remaining soil to be sure it is clear of all contaminates. Once that is completed, Anadarko back fills the previously contaminated area. 11. Dust Abatement Plan During the construction phase of the project, Anadarko and its contractors utilize water trucks to maintain dust suppression and fugitive particulate emissions. Also, the Storm Water Management plan will be followed to mitigate soil erosion during construction. After construction is completed each property will be stabilized using appropriate native vegetation, which will not be allowed to grow over 12" high. Additionally, Anadarko will gravel any access and driving surfaces affected, with the same material in its existing condition. If necessary, Anadarko also will utilize a water truck to control dust after construction. 8 SECTION 2 1. Notification Requirements In accordance with Section 23-2-260 (B) (9) of the Weld County Code a certified list of the names and addresses of the owners of property within 500 feet of the subject property is listed below and provided in the Appendix. Operation Standards Noise Control Due to the fact that the site will be used to pipe water to drilling locations, rather than provide a water source to water trucks, noise will remain under the 55-50 dB acceptability range during all hours of the day. If noise does become an issue, measures will be taken to decrease levels. The daily maintenance performed by sub-contractor or Anadarko employee will be done by pick-up truck and trailer and typically during normal business hours. The rural setting of the project location is preferred to mitigate the effects of noise emissions on the surrounding property owners. Air and Water Quality All activities will be in compliance with the permit and control provisions of the Colorado Air Quality Control Program, Title 25, Article 7, C.R.S. as applicable. No waste water will be discharged within the site. All water and waste is carried by vehicle off the site. Lighting Lighting on the site will be downcast and shielded lighting located on two poles at either end of the facility and at the entry/exit to the site. Lighting is provided for security, evening maintenance, and emergency work. Any source of lighting on the site shall be shielded so that light will not shine directly onto adjacent properties. Nor will direct or reflected light from any source on the project site create a traffic hazard to operators of motor vehicles on the adjacent road access. Weed Control The water storage site will be kept free of weeds, rubbish, and other waste material. The area will be treated if necessary and as practicable to prevent invasion of undesirable species and noxious weeks. 10 3. Required Permits Weld County A Use by Special Review Permit is required to be approved by the Board of County Commissioners prior to construction of this facility_ Anadarko E & P will submit any additional permits necessary for County Approval prior to commencement of construction site. Oversize Load Permits If necessary, oversize load permits will be submitted as part of this application. The submitted access application is in the Appendix Grading Permit A grading permit is needed for disturbing an area of 1 acre or more. A grading plan is submitted as part of this application and included in the Appendix. Access Permit The access point for the facility is located off of Weld County Road 20. This entry point is already existing and facilitates Anadarko's other operations on the parcel, and meets all Access requirements. Please see Appendix for pictures of existing Access. 4. Traffic A traffic study is not applicable in this Application because the site will not require new access and increased vehicular traffic. 11 5. Fire and Emergency Response There is adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and County. All roads leading to the site and within the site will be designated and maintained to support fire apparatus. A turnaround may be constructed as necessary to accommodate fire apparatus. In addition to above-referenced rules and regulations, Anadarko is also subject to COGCC Rule 6064 pertaining to Fire Prevention and Protection. Anadarko has support personnel in the field or on call at all times to provide technical assistance in fire prevention and elimination. 12 Emergency Information Sheet 1. General Information: The purpose of this document is to provide ownership information case of emergency at the Gobbler Water Storage Facility. It maybe used by outside agencies, company employees, and contract labor to help secure a speedy recovery from such emergency situations: A.
