Home My WebLink About20121847.tiff RESOLUTION RE: APPROVE AGREEMENT FOR TRANSFER OF ENTITLEMENTS TO CENTRAL COLORADO REGIONAL AIRPORT, BUENA VISTA, COLORADO, AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Transfer of Entitlements to the Central Colorado Regional Airport, Buena Vista, Colorado, among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the City of Greeley, the Greeley-Weld County Airport Authority, and the Federal Aviation Administration, commencing upon full execution, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Transfer of Entitlements to the Central Colorado Regional Airport, Buena Vista, Colorado among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the City of Greeley, the Greeley-Weld County Airport Authority, and the Federal Aviation Administration be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Cyr Sr. ME Airport Manager This Agreement is a transfer of Entitlements under a program the Airport worked out with the FAA in 2010. We were able to multi-year our Entitlements by using the Entitlements of three other Colorado Airports to complete$600,000.00 worth of asphalt work in 2011. Starting this year 2012 and again in 2013-2014. The Greeley-Weld Airport will waive our FAA Entitlements each year for the next three years. These funds will go to the three Colorado Airports that waived their funds to allow us to complete the project work in 2011. (signature of sponsor's attorney) FAA Form 5100-110(12/90) 2 CITY OF GREELEY, COLORADO RESOLUTION NO. 4q , 2012 A RESOLUTION AMONG THE CITY OF GREELEY, WELD COUNTY, AND THE GREELEY-WELD COUNTY AIRPORT AUTHORITY TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION FOR TRANSFER OF ENTITLEMENTS WHEREAS, Section 47117(c)2 of Title 49 U.S.C. allows a primary airport to make an agreement with the Secretary of Transportation waiving any part of an entitlement amount apportioned for the airport under Section 471 14(c)(I) of this Title if the Secretary makes the waived amount available for a grant for another public-use airport in the same State or geographical area as the primary airport; and WHEREAS,the City of Greeley, Weld County, and the Greeley-Weld County Airport Authority desire to waive entitlement and receipt of the 2012 fund amount of$150,000 on the condition that the Federal Aviation Administration makes the waived amount available to the Town of Buena Vista, Colorado (Central Colorado Regional Airport); and WHEREAS, in accordance with C.R.S. §29-1-201 and §29-1-203, governments are permitted and encouraged to make the most efficient and effective use of their powers and responsibilities by cooperating and contracting with other units of government for funding and services lawfully authorized by each other; and, WHEREAS, the parties assert that this Entitlement Agreement is in the best interests of the citizens of all entities. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF GREELEY, COLORADO: 1. The City Council authorizes the City to execute the Department of Transportation Federal Aviation Administration Agreement for Transfer of Entitlements, a copy of which is attached hereto and incorporated herein as Exhibit A. 2.
