RE: CDPS Permit and 2011 Annual Report—Compliance Advisory

Dear Mr. Garcia:
The Water Quality Control Division (Division)received an annual report from Weld County(permittee). The permittee
did not answer the following questions on the annual report:
• Part 3, Program Area 5: Post-Construction Stormwater Management, Number of BMP Inspections
• Part 5, Information Collected and Analayzed
The due date for the submittal of the 2011 Annual Report was March 10, 2012. Failure to submit the above referenced
information, as required by Parts I.F and II.A.8 of the Municipal Separate Storm Sewer System Permit COR090000(the
MS4 Permit) and is a violation of the MS4 Permit. The MS4 permittee must submit the above referenced information to
complete the 2011 Annual Report,to the Division by July 7, 2012.
This Compliance Advisory is intended to advise the permittee of violations of the Colorado Water Quality Control Act, its
implementing regulations,and the Permit, so that the Permittee may take appropriate steps to correct the Division's
records(if applicable), or to avoid or mitigate formal enforcement action. This Compliance Advisory does not constitute
a Notice of Violation or Cease and Desist Order and is not subject to appeal. However, the issuance of this Compliance
Advisory does not limit or preclude the Division from pursuing its enforcement options concerning the above violations.
The Division will evaluate the facts associated with the above-described violations and the permittee's response to this
advisory. If a formal enforcement action is deemed necessary,the perrttittee may be issues a Notice of Violation/Cease
and Desist Order that may include the assessment of penalties.
