RESOLUTION
RE: VACATION, ABANDONMENT AND CLOSING OF ALL ALLEYS
IN BLOCKS 23 and 24.and 5TH AVENUE BETWEEN SAID -HLOCKS
23 and 24, ALL IN THE UNINCORPORATED TOWN OF GILL,
WELD COUNTY, COLORADO.,'
WHEREAS, a petition has been presented to the Board of County
Commissioners, Weld County, Colorado, requesting that the north-south
alley in Block 23 between 6th Avenue and 5th Avenue, and the north-south
alley in Block 24 between 5th Avenue and 4th Avenue, and the east-west
alley in Block 24 between 5th Street and the north-south alley in Block 24,
and all of 5th Avenue between its intersection with 5th Street and 6th
Street; all in the unincorporated town of Gill, Weld County, Colorado, be
abandoned and vacated, said alleys and street being locaktd adjacent to
property wholly owned by the petitioners as contained in road petition
requesting vacation of said alleys and street, and said alleys and street
being more particularly described as follows:
That portion of north-south alley in Block 23
lying between Sixth Avenue and Fifth Avenue,
and that portion of north-south alley in Block
24 lying between Fifth Avenue and Fourth
Avenue, and all that portion of east-west alley
lying in Block 24 between Fifth Street and north-
south alley in said Block 24, and all of Fifth
Avenue between its intersection with Fifth Street
and Sixth Street; all in the unincorporated town
of Gill, Weld County, Colorado; and
WHEREAS, the Board. after investigation of all of the facts and
circumstances surrounding the petition, and that after personal investiga-
tion of the hereinabove described alleys and street sou lotto be vacated,
has determined that the necessity of the public no longer requires this por-
tions of alleys and street; and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, believes it to be in the best interest of the public, and Weld
County, to approve said petition.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the aforementioned alley in
Block 23, and the aforementioned alleys in Block 24, and all of Fifth Avenue
between Fifth Street and Sixth Street, all in the unincorporated town of
Gill, Weld County, Colorado, be and they are hereby declared abandoned,
vacated, and closed, in accordance with the submitted petition.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 11th day of February,

THIS DEED, Made this 11th day of February, A.D. , 1975, be-
o tween WELD COUNTY, a municipal corporation and a political subdivision
r— of the State of Colorado, by the BOARD OF COUNTY COMMISSIONERS,
for the respective interests of the COUNTY OF WELD, and the STATE
OF COLORADO, of the First part, and THE PRESENT OWNERS, of

WITNESSETH, that the said party of the first part, and in considera-
t" tion of the sum of other valuable considerations and ten dollars, to said party
0 of the first part in hand and paid by the said parties of the second part, the
o receipt whereof is hereby confessed and acknowledged, has remised, released,
' sold, conveyed and QUIT CLAIMED, and by these presents does remise, re-
lease, sell, convey and QUIT CLAIM unto the said parties of the second part,
," all the right, title, interest, claim and demand which the said party of the
ca first part has in and to the following described real estate situate, lying and
m being in the County of Weld and State of Colorado, to-wit:

appurtenances and privileges thereunto belonging or in anywise thereunto
appertaining, and all the estate, right, title, interest and claim whatsoever,
of the said party of the first part, either in law or equity, to the only proper
use, benefit, and behoof of the said parties of the second part, their heirs
and assigns forever.
SIGNED AND DELIVERED, this 11th day of February, A.D.,
1975, by WELD COUNTY, a municipal corporation and a political sub-
division of the STATE OF COLORADO by the BOARD OF COUNTY COM-
MISSIONERS, for its respective interests.
