RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 348 -
MR. AND MRS. DAVID MILLER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 20th day of November, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado that a certain par-
cel of land, being the property of Mr. and Mrs. David Miller, does
not come within the purview of the definition of the terms "sub-
division" and "subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, said Board of County Commissioners of Weld County,
Colorado did approve Recorded Exemption No. 348, by Resolution,
on November 20 , 1978, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has been informed by the Weld County Planning Department
that the aforementioned Recorded Exemption now needs to be
amended by correcting a typographical error in the typed legal
description on the recorded exemption plat. The amended legal
description is as follows :
A tract of land located in the Northwest Quarter of
Section 13, Township 6 North, Range 67 West of the
6th Principal Meridian, Weld County, Colorado and
being more particularly described as follows:
Beginning at the Northwest corner of said Section 13
and considering the North line of the Northwest Quar-
ter of said Section 13 to bear North 88°59'02" East
with all other bearings contained herein being rela-
tive thereto;
Thence North 88°59'02" Fast along said North line,
619.73 feet to a point being 20 feet, more or less,
Northeasterly fran the centerline of the Roulard
Lateral Ditch and Extension;
Thence along a line that is 20 feet Northerly and
Easterly of said centerline by the following thir-
teen (13) courses:
South 41°40'40" East, 398.91 feet;
South 29°06'57" East, 107.77 feet;
South 10°27'00" East, 344.76 feet;
South 16°03'27" East, 615.06 feet;

1822.82 feet to a point on the boundary of the KENNEDY
SUBDIVISION;
Thence along the perimeter of said KENNEDY SUBDIVISION
by the following six (6) courses:
North 31°39'00" Fast, 54.37 feet;
North 62°45'00" East, 154.88 feet;
North 58°03'00" West, 787.38 feet;
North 45°06'00" West, 66.87 feet;
North 55°50'00" West, 129.41 feet;
North 68°08'00" West, 173.50 feet to a point on the West
line of the Northwest Quarter of said Section 13;
Thence North 00°00'00" East along said West line, 1937.48
feet to the Point of Beginning;
Said tract of land contains 87.742 acres.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado deems it advisable to approve said amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove amend-
ment to Recorded Exemption No. 348 for Mr. and Mrs. David Miller
be, and hereby is , approved.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 13th day of
December, A.D. , 1978.

RE : Amendment to Recorded Exemption #348
Dear Commissioners:
The attached materials are in reference to a request from Mr. and Mrs.
David Miller for an amendment to Recorded Exemption #348. The property
is described as Pt . NWl Section 13, T6N, R67W of the 6th P.M. , Weld
County, Colorado . This property is located approximately 3 miles east
of the Town of Windsor and 2-1/2 miles south of the Town of Severance.
The request is to amend Recorded Exemption #348 by correcting a typo-
graphical error in the typed legal description on the recorded exemption
plat . The request , if approved, would delete the word "east" from the
last sentence in the typed legal description and replace it with the
word "west" .
Based on the information submitted, the Department of Planning Services
Staf - -commends approval of this requested amendment since it will
cor ect . n incorrect legal description.
