RE: THE ADOPTION OF AMENDED UNIFORM FEE SCHEDULE FOR THE USE
OF COUNTY ROAD RIGHTS OF WAY FOR EXTRAORDINARY USE IN
WELD COUNTY, COLORADO.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, heretofore and on October 3 , 1973 by Resolution
the Board of County Commissioners of Weld County, Colorado did
adopt an Amended Uniform Fee Schedule for Extraordinary Uses
of County Road Rights of Way, and
WHEREAS, the Board has reassessed the County' s position
relative to such fees and costs to inspect such uses , and has
determined that it would be in the best interests of Weld County
to revise same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Amended Uniform Fee
Schedule for the Use of County Road Rights of Way in Weld County,
Colorado, as more fully set forth on Exhibit A attached hereto
and made a part of this Resolution, is hereby adopted and shall
be effective as of January 1, 1980 and shall continue to be in
effect until further order of the Board, and
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the County Engineer, or his
authorized representative , is hereby authorized and directed to
issue permits for the extraordinary uses of County road rights of
way and to collect fees for same as specified on Exhibit A only
after prior application therefore is properly made and after the
Weld County Engineer, or his authorized representative, has investi-
gated the circumstances surrounding the specific use contemplated in
the application and determined those conditions upon which the
permit may be granted for the particular use , which conditions , in
the estimation of the Weld County Engineer, or his authorized repre-
sentative, best protect County roads and bridges relative to the
use, and which conditions may include obtaining such assurances

and sureties as may be necessary to protect and reimburse Weld
County for damages to its roads and bridges within the purview
of Sections 42-4-409 through 42-4-411, CRS 1973 , and
BE IT FURTHER RESOLVED that all Resolutions of the Board
of County Commissioners of Weld County, Colorado specifying
permit fees for those extraordinary uses cited on Exhibit A are
hereby amended to reflect the new permit fee structure specified
on Exhibit A, effective January 1, 1980 .
The above and foregoing Resolution was , on motion duly
made and seconded, adopted by the following vote on the
10th day of December, A.D. , 1979 .

EXHIBIT A
AMENDED UNIFORM FEE SCHEDULE FOR THE
USE OF COUNTY ROAD RIGHTS OF WAY FOR
EXTRAORDINARY USE IN WELD COUNTY, COLORADO
UTILITIES
For all utilities, regardless of installation, permit fee shall be based
upon trench width as follows:
Trench Width Permit Fee
Up to 6" $0.02 per lineal foot
7" thru 12" $0.05 per lineal foot
13" thru 24" $0.09 per lineal foot
25" thru 36" $0.14 per lineal foot
37" and above $0.18 per lineal foot
Minimum permit fee will be $10.00.
Fcr all non-ferrous pipelines installed in road rights of way, a suitable
facility shall be installed with the pipeline to facilitate future pipeline
location.
Service taps (residential ) included on line expansion permit shall not be
included in fee.
Service taps on existing facilities shall be considered at the minimum fee.
Encasement where facility parallels right of way line and encasement is
suspended from or attached to a bridge or drainage structure shall not be
included in total .
Where boring and encasement is required across a County road from private
rights of way to private rights of way, all charges shall be based upon
$0.01 per inside diameter inch of the encasement pipe per lineal foot
installed across County right of way.
All extraordinary costs relating to the inspection of impacts to County
rights of way will be borne by the Permittee at the rate specified by Weld
County on a cost recovery basis.
The Board of County Commissioners may, at their discretion, wave permit
fees where any facility is being moved and reinstalled at the County's
request or any repairs on an emergency basis or any other reason in the
opinion of the Board warrants their action.
The above fee schedule and conditions do not relieve any utility company,
its agents, contractors, or personnel of any conditions outlined, or duties
required as specified in the utility permit required.

Operation of vehicles of excessive size
and weight on County roads $ 5.00
Overhead utility permits in County right of way $25.00/pole
Overhead utility crossing in County right of way $ 5.00 plus actual
cost of time and

Vibratory $25.00 per mile
House move without inspection required $ 5.00
House move with inspection required $50.00
Effective: January 1, 1980
