Please find our responses to your adequacy review concerns for the subject Technical Revision
No. 2 below. The responses arc denoted in hold italics.
1. Rule 6.2.1(2) requires maps he signed by a registered land surveyor, professional engineer, or
other qualified person. The maps submitted to the Division were not signed. Please resubmit
signed copies of the maps. Maps are now signed.
2. The Division's engineering staff reviewed the October 8, 2012 Flood Analysis prepared by Flow
Technologies, LLC, and the November 9, 2012 riprap sizing analysis prepared by Varra
Companies. A copy of Mr. Cazier's memorandum is attached. Please address the comments
noted in the memorandum. The comments have been addressed,please see below.
3. The Division will estimate the cost to repair flood damage during mining operations and install
the post mining flood control structures at the site based on the information submitted once the
Operator addresses the concerns noted in this letter. Noted.
4. Please commit to staying four hundred (400) feet from the tank battery in the northeast corner of
Tract C until the design for the hard armoring protection is submitted as a technical revision and
approved by the Division. During the course of our September 21, 2012 meeting with DRMS,
a few different ideas were proposed and discussed regarding erosion protection. One of these
was the possibility of armoring the tank battery. Another one, which is the method we have
chosen to use, was to provide a protected point at which we believe potential,floodwaters will
enter the site. The thinking behind this option was, that by protecting the point at which
floodwaters would enter the site, we would avoid embankment erosion and possible river
capture. Likewise, we proposed to provide a protected anvils for which floodwaters eolith
move from Tract C to Tract O, and also protect the mil/gas pipes within the embankment
between the two tracts. hi revisiting this issue. it was determined by ourselves and our
consultant, Mr. Trieste, that the points we have protected should prevent embankment erosion
and river capture. Likewise, the pipelines between Tract C and Tract 1)should also be
protected from bank erosion and failure. The introduction of floodwaters to this site should
not affect the tank battery as a result of our mining activities. The tank battery owner has
already constructed what they feel should be adequate surface protections,for their facilities in
the event of a flood, and Varra Companies mining activities will not have an effect on these
surface protections. Additionally, velocities in the area of the tank battery should be minimal,
as the entry pond far the floodwater is on the western side of Tract C and the tank battery is
on the eastern side of Tract C. The inclusion alike continent regarding the armoring of the
tank battery in the Hood Analysis report was a miscommunication on our end between
ourselves and our consultant, and was again misinterpreted by Varra Companies in our
proofing of the report to mean the design of the riprap protected weir between Tract (.'and
Tract 1)as we have now designed. Please see the included photos of the current.state of the
existing tank battery. Also,please see our Statement o f Understanding addressed to Adjacent
Surface Owner of Record. dated Thursday, July 29, 2010, which was part of the original
application for the Western Sugar project. This document outlines the expectations of our
coexistence with adjacent surface owners. This document was sent to all adjacent surface
owners by certified return receipt mail, and these were also submitted with our original
application for Western Sugar.

The Flood Analysis appears adequate. No action required. Noted.
2. The ripnip sizing analysis appears adequate. No action requnrd. Noted_
I'loodway and Erosion Mitigation Map. The map only presents the aerial extent of the
proposed riprap. In order to fully understand and evaluate the riprap protection proposed.
the DRMS requires sections perpendicular and parallel to the flow directions on Ihe. Tract
C and I) weirs. Please provide section that meet the following specifications
a. Riprap layer and bedding/granular faller layer thicknesses_
h. Elevation of top of riprap for each weir,
C. Profiles in the direction of flow showing how the riprap :and kidding
layers lie inlo the proposed reclamation uopographc (above and/or below
\vater level).
d. Permanent pool water lesels. and
e. Section(s)perpendicular to the direction of flow showing how the riprap
and bedding layers lie into the proposed reclamation topography.
The above requested elements hare been added to the plans.
