A Use by Special Review permit for an earth moving company.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 58 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The business will utilize the existing access from CR 58. Adequate (min 60') truck turning radiuses are
required at the access. Please show the access on the Plat and label it with the approved Access Permit
number(will be provided).
The applicant stated that there will be up to 15 employees with 6-8 trucks using the site daily. Please
• verify with the Planning department that the number of parking spaces shown is adequate.
A water quality depression design has been submitted and is acceptable to Public Works.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show the access point on the Plat and label it with the Access Permit number(will be provided).
2. Show and label the Water Quality Area on the Plat.
3. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for an excavation business.
The facility will include an office, repair shop and outdoor vehicle and equipment
storage. There will be up to 6 onsite employees and up to 20 employees accessing the
site temporarily to pick up and drop off vehicles and equipment.
• The facility will be served by Central Weld County Water District. A letter of commitment
from the Water District, dated November 4, 2011, was included with the USR
application. The applicant is proposing to install an engineer designed septic system.
The applicant will be required to apply for a septic permit and the permit will need Weld
County Board of Health approval.
The facility will have 2-8000 gallon aboveground fuel tanks. A Spill Prevention, Control
and Countermeasure Plan will be required and the tanks will require registration with the
Colorado Department of Labor and Employment, Oil Inspection Section.
The applicant submitted a waste handling plan. Floor drain waste in the repair shop will
be captured in a watertight vault and the contents will be removed and disposed by
McDonald Farms. A dumpster will be provided and Waste Management will provide
trash removal. The applicant needs to include in the waste handling plan removal and
disposal or recycling of wastes generated from vehicle and equipment repairs and
maintenance, such as waste fluids, batteries, tires, and other parts. Also, the waste
handling plan should address clean up and disposal of spilled vehicle and equipment
fluids and fuels.
Water trucks will be used during construction to mitigate dust. Access drives, parking
and outdoor storage areas will be covered with a gravel road base. The applicant is

required to submit an onsite dust control plan addressing dust control methods for the
facility after construction is complete and the business is in operation.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
2, In the event washing of vehicles will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
• 3. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
4. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment. In accordance with Section 3-6-1 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations
(40 CFR Part 112).
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.

3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. In the event that 1 or more acres are disturbed during the construction and
development of this site, the applicant shall obtain a stormwater discharge permit
from the Water Quality Control Division of the Colorado Department of Public
Health and Environment.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
• 2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large-capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.

4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
6. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Rules
and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in
the Commercial Zone as delineated in Section 14-9-30 of the Weld County
Code.
• 9. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
10.Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
11.Adequate toilet facilities (portable toilets) and hand washing units shall be
provided during the construction of the facility.
12.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes (Central Weld County Water District).
13.Bottled water shall be utilized for drinking during construction of the project.
14.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
15. Process wastewater (such as floor drain wastes) shall be captured in a
watertight vault and hauled off for proper disposal. Records of installation,

maintenance, and proper disposal shall be retained.
16.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
17. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.
