RESOLUTION
RE : APPROVAL OF RECORDED EXEMPTION NO. 308 - CHESTER SMITH AND
GEORGE SLOAN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing
held on the 15th day of March, 1978 , in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of a certain parcel of land, as
shown on the plat known as Recorded Exemption No. 308, being the
property of Chester Smith and George Sloan, described as Part
of the NW4 of Section 17, Township 7 North, Range 67 West of
the 6th P.M. , Weld County, Colorado, containing 36. 89 acres,
more or less , and being more particularly described as follows:
A tract of land situate in the Northwest 1/4 of Section
17, Township 7 North, Range 67 West of the Sixth P.M. ,
Weld County, Colorado, which considering the North
line of the Northwest 1/4 of said Section 17 as bearing
S 89°49' E and all bearings contained herein, relative
thereto, is contained within the boundary lines which
begin at the Northwest corner of said Section 17 and run
thence along the North line of the said Northwest 1/4
S 89°49' E 409.26 feet; thence S 00°34' E 604.81 feet;
thence S 89°49' E 212.08 feet; thence N 00°12'13" E
604.77 feet to the North line of said Northwest 1/4; thence
along the North line of said Northwest 1/4 S 89°49' E 30.00
feet; thence S 00°12'13" W 2633.33 feet to the South line
of the said Northwest 1/4; thence along the South line of
the said Northwest 1/4 N 89°51' W 660.07 feet to the West
1/4 corner of said Section 17; thence N 00°13' E 2633.71
feet to the point of beginning, being subject to all rights
of way and easements as they nag exist. The above described
tract contains 36.89 acres, more or less;
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and

Colorado, finds that this particular division of land is not

1973, as amended, and Section 2-1A (3) of the Weld County Sub-

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Chester Smith and George
Sloan, be, and hereby is, exempt from the definition of the
terms, "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 15th day of
March, A.D. , 1978 .

Dear Commissioners :
The attached application, plat , and related items are in reference to a re-
quest by Chester Smith and George Sloan for a recorded exemption . The sub-
ject property is described as Pt . NW* Section 17, T7N, R67W of the 6th P,M. ,
Weld County, Colorado . The property is located 10 miles west of Ault on
the south side of Colorado Highway 14. The property in question contains
approximately 36. 89 acres of Class II , III , and IV irrigated soils . The
request is to split the property into parcels of 18. 36 acres and 13. 53
acres for residential use.
On January 9, 1978, the Board of County Commissioners denied a request by
Chester Smith and George Sloan for a lot size variance. On January 16 , 1978 ,
the Board of County Commissioners reconsidered and approved the request by
Chester Smith and George Sloan for a lot size variance reversing its pre-
vious decision to deny the lot size variance . At the time the Board made
the original decision on that request , the Department of Planning Services
Staff submitted a letter of recommendation to the Board. A copy of that
letter of recommendation is included in the attached packet . Nothing has
been received by our office which would change our recommendations of denial
for this request as outlined in the letter to the Board of County Commis-
sioners dated January 9, 1978 .
However, if the Board approves this request , it should be pointed out that
the State Department of Highways has requested the applicant to provide an
additional 17 feet of right-of-way on the south side of Highway 14 by
reserv. - ion , setback, or dedication , preferably the latter .

• Range to the west.
Bedrock encountered on the subject property consists of the Upper
Cretaceous Pierre Formation consisting of shales, siltstones and sandstones.
Engineering Geology
The area has generally gentle slopes estimated to be on the order of five
(5) to twelve (12) percent. No geologic hazards due to mass land movement
were visible on the property, nor are any anticipated. With proper site grading.
and adequate drainage, no erosional problems are predicted. Engineering
geology problems appear to be limited to those problems encountered with high --
groundwater table conditions, as discussed earlier, and with the excavation of
the dense sandstone bedrock encountered in the area of Boring 2. Difficulties
may be encountered in the northeast corner of the site in the construction of
roads where deep cuts are necessary, in the excavation of deeper building
foundations, and in the construction of deep utility lines. It is felt that blasting
and/or the use of special equipment may be necessary to excavate the dense
rock.
it is recommended that all roadway subgrades be placed a minimum of
three (3) feet above maximum seasonal groundwater elevations. Roads should
be designed to prevent the pending of water. It Is felt that no commercial
deposits of coal, limestone, sand and gravel or quarry stone are available for
extraction on the property. Coal reserves in this part of Colorado are located
in the Late Upper Cretaceous Laramie Formation which is not present in this
area. Commercial limestone deposits are located within the Cretaceous Niabrara .-
Formation located below the Pierre Formation. However, since the Pierre
Formation is approximately five thousand (5000) feet thick in this area, extraction
of this limestone would not be considered economically feasible. No sand and
gravel and/or quarry stone were visible or encountered on the property.
Waste Disposal
in view of the percolation rates and the soil and/or groundwater conditions
encountered at the site, It Is our opinion that the majority of the site is suitable
•
for construction of standard and/or adjusted grade septic systems. The bottom
of all soil absorption fields should be placed a minimum of four (4) feet above
the bedrock stratum and existing groundwater. In those areas where the
depth to bedrock and groundwater is seven (7) feet or greater (See Depth to
Bedrock and Depth to Groundwater maps) construction of standard systems is
feasible. in those areas where the depth to bedrock and groundwater is between
five (5) and seven (7) feet below the surface, it is our opinion that adjusted
tgrade septic systems are feasible. It Is suggested that the bottom of all
absorption fields in these areas be placed four (4) feet above the bedrock
stratum and existing groundwater and that the top of the field In these areas .-
be filled so that there is a minimum of two (2) feet of soil cover over the system.
• Fill material placed over the system should be compacted to at least eighty-five
I • percent (85%) of Standard Proctor Density. The edges of the fill should be
sealed with an impervious clay material to prevent lateral seepage. In our
I opinion standard and/or modified septic systems are not feasible In the northern
portion of the site where the depth to bedrock and/or groundwater is less than -
1 five (5) feet. it is suggested that alternate systems such as a package aeration
j system be used In lieu of a septic system in these areas.
GENERAL. COMMENTS

- it should be noted that the recommendations discussed above were based
on the results of a preliminary investigation. It Is recommended that additional
field and laboratory testing be performed prior to construction to provide a sound
basis for determining the physical properties and bearing capacities of the soils
( encountered.

II , III , and IV irrigated soils . The request is to obtain a
variance from the minimum lot size requirement , Section 9-4(A) (6 )
of the Weld- County Subdivision Regulations , so that he can apply
for a recorded exemption. Section 9-4(A) (6) states :
That under the original tract or parcel of land to be
divided under this section meets the minimum lot size
requirements established by the Weld County Zoning
Resolution-variance from this requirement being allowed
only upon good cause being shown to the Board of County
Commissioners or where said tract or parcel of land lies
within the Comprehensive Plan area of an existing incor-
porated town of Weld County. (Revised 4-17-74 ) "
If the lot size variance is approved, Mr . Smith will proceed with
a recorded exemption application to create two parcels of approxi-
mately 16 and 20 acres . Currently , there are no improvements
located on the property . As indicated in a letter dated December
11 , 1977 , submitted by Mr . Smith , the intent is to sell both par-
cels as separate lots for residential uses .
Based upon the information submitted and the adopted policies and
regulations of Weld County, the Department of Planning Services
Staff recommends denial of the request for the following reasons :
1 . The proposed split does not comply with the Weld
County Comprehensive Plan , with the intent clause
of the Recorded Exemption procedure (Section 9-2

of the Weld County Subdivision Regulations ) , and
the intent clause of the Agricultural District
(Section 3 . 3A of the Weld County Zoning Resolution )
for the following reasons :
a. The request would not be encouraging agricul -
tural uses as the highest and best uses since
it would promote non-agricultural use of agri-
cultural land and,
b. It would not be providing for the orderly ex-
pansion of urban growth , since the split would
allow two sets of improvements to be built (one
on each proposed parcel ) and therefore create
an urban encroachment on rural land use and ,
c . The proposed split would be promoting the divi-
sion of agricultural land into smaller , less
economic parcel sizes.
2 . The minimum lot size in the Agricultural Distri - '
is 80 acres for irrigated land . The intent i < i
maintain large enough tracts for farm purposes , and
to assist in the encouragement of agricultural uses
of the highest and best use of the land . The pro-
posed split is in violation of that intent .
3 . Good cause has not been shown why the variance should
be granted as stipulated in Section 9-4(A ) (6 ) of the
Weld County Subdivision Regulations .

Dear Mr. Cunliffe:
The Colorado Division of Highways has reviewed the Chester Smith and
George Sloan Exemption application. We ask that consideration be given to the
future right-of-way needs on State Highway 14. Our 1994 projected right-of-way
needs map calls for a minimum of 150 feet (75 feet each side of centerline) .
The existing highway right of way is approximately 100 feet (58 feet on the south
side of centerline). Therefore, we request that an additional 17 feet be pro-
tected on the south side of the highway by reservation, setback, or dedication
(preferably the latter) as local zoning laws and regulations permit.
We would appreciate the opportunity to review any future development plans
on this site if this exemption is approved.
