HomeMy WebLinkAbout20123490.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING SUSPENSION OF COLORADO RETAIL FOOD ESTABLISHMENT LICENSE- DOUBLE TREE RESTAURANT AND LOUNGE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Double Tree Restaurant and Lounge, located at 701 Vasquez Boulevard, Platteville, Colorado, is allegedly in violation of the Colorado Retail Food Establishment Rules and Regulations, and WHEREAS, on December 10, 2012, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violations at the facility licensed to PAZ, LLC, P.O. Box 404, Platteville, Colorado 80651,which was represented by Jesus Fuentes, and WHEREAS, after hearing testimony from all present, the Board of County Commissioners deemed it advisable to suspend said license until a consultant is brought on-site to assist with operations and the Department of Public Health and Environment staff has had an opportunity to review and refine changes to the proposed Plan of Action with the owner, and that the $1,000.00 civil penalty be deferred and allowed to go toward the cost of the consultant. The Weld County Department of Public Health and Environment (Department) has given the facility all opportunities to come into compliance as afforded to them in the Colorado Revised Statutes. Unfortunately, our inspection staff continues to observe violations that have the potential to directly result in illnesses of patrons dining at the establishment. The average number of violations cited for all licensed retail food facilities is 1.97 (during the first 9 months of 2012). Of the 46 total violations cited,35 were critical violations (76%). Of those critical violations,24 were foodborne illness risk factor violations (69%). CRITICAL ITEMS Critical items are related directly to foodborne illness. April 30, 2012 A First Notification of Non-Compliance was issued for violation 03e (improper cold holding of potentially hazardous food) and was sent via regular mail. The letter was not returned to our office as undeliverable. May 22, 2012 A follow-up inspection was conducted in which violation 03e (improper cold holding of potentially hazardous food) was cited. June 6, 2012 A Second Notification of Non-Compliance was issued for violation 03e (improper cold holding of potentially hazardous food) and was sent via regular mail. The letter was not returned to our office as undeliverable. July 3, 2012 A follow-up inspection was conducted in which no violations were cited. July 16, 2012 A Notice of Civil Penalty ($250.00) and Compliance Warning was issued for violation 03e (improper cold holding of potentially hazardous food) and sent via regular mail. The letter was not returned to our office as undeliverable. The civil penalty was paid in full on September 7, 2012. August 11,2012 After facility indicated that they'd not received the letter sent on July 16, 2012, another copy of the letter was sent to the facility by regular mail. August 31, 2012 A regular inspection was conducted and violation 03e (improper cold holding of potentially hazardous food) was again cited. September 24, 2012 A Second Notice of Civil Penalty ($500.00) and Notice of Non- Compliance Intervention Meeting (Enforcement Meeting) was sent to the facility via certified mail and was signed for by Lorena Fuentes on October 1, 2012. October 4, 2012 The second civil penalty in the amount of$500.00 was paid in full. October 11, 2012 An Enforcement Meeting was conducted at the health department office for Double Tree Restaurant and Lounge. It was attended by Debra Adamson and Dan Joseph of WCDPHE as well as Jesus Fuentes and Glenda Donoho from the restaurant. The meeting included discussion of the compliance and enforcement process in the event further violations were cited as well as potential solutions for the violations that had continued to occur. October 23, 2012 A Formalization of Enforcement Meeting summary was issued via regular mail. November 7, 2012 A follow-up inspection was conducted in which violation 03e (improper cold holding of potentially hazardous food) was again cited. Shana Fassman and Dan Joseph discussed records that would be important if a hearing were to be held, including training records, temperature logs, and meetings with staff. November 15, 2012 Shana Fassman and Deb Adamson held a conference call with Jesus Fuentes and Glenda Donoho of the Double Tree Restaurant and Lounge. The call included discussion of the upcoming hearing as well as recommendations by the Department including hiring a consultant, additional training, temperature monitoring and verification. November 16, 2012 A summary email regarding the phone conversation of November 15, 2012, was sent to the facility. Box 404 Platteville, Colorado 80651 RE: Double Tree Restaurant and Lounge, 701 Vasquez Boulevard, Platteville, Colorado FIRST NOTIFICATION OF NON-COMPLIANCE RETAIL FOOD ESTABLISHMENT Dear PAZ, LLC: On June 10, 2011, an Environmental Health Specialist with the Weld County Department of Public Health and Environment conducted a follow-up inspection of Double Tree Restaurant and Lounge, licensed by you PAZ, LLC, located at 701 Vasquez Boulevard, in Platteville, Colorado. The following items were found to be in violation of the Colorado Retail Food Establishment Rules and Regulations (* denotes a critical violation): VIOLATIONS *03a Found 5 gallon container of pork broth at 51 degrees F in walk in cooler. Found 5 gallon container of potato soup at 45 degrees F in walk in cooler. Both food items were prepared previous night. Potentially hazardous foods shall be cooled using one or more of the following methods: in shallow, uncovered containers that facilitate heat transfer (ex. metal), stirring while in an ice bath, use of an ice wand, under refrigeration, adding ice as an ingredient or other effective method. Food discarded in trash, see voluntary condemnation. Corrected at time of inspection. REPEAT VIOLATION. Section 3-502 A of the Colorado Retail Food Establishment Rules and Regulations states: "Cooked potentially hazardous food shall be cooled from 135 degrees to 41 degrees, or below, in 6 hours provided that the food is cooled from 135 degrees to 70 degrees within the first 2 hours." Section 3-503 of the Colorado Retail Food Establishment Rules and Regulations states: "Cooling shall be accomplished as required in section 3-502, by using one or more of the following methods based on the type of food being cooled: 1) Placing the food in shallow pans; 2) Separating the food into smaller or thinner portions; 3) Using rapid cooling equipment; 4) Stirring the food in a container placed in an ice water bath; 5) Using containers that facilitate heat transfer; 6) Adding ice as an ingredient; or 7) Other effective methods that meet the requirements of section 3-502 of these rules and regulations." The temperature of potentially hazardous foods shall be 41 degrees F or below or 135 degrees F or above, at all times, except during necessary periods of preparation. Temperature not off more than four hours, container moved to cold hold unit by coffee area in diner. Corrected at time of inspection. REPEAT VIOLATION. Section 3-401 A of the Colorado Retail Food Establishment Rules and Regulations states: "The temperature of potentially hazardous food shall be 41 degrees F or below or 135 degrees F or above, at all times, except during necessary periods of preparation or as otherwise provided in this code." Violation numbers 3a and 3e were also cited during an inspection of this facility on April 1, 2011, and the deficiencies were corrected at the time of the inspection. Therefore, pursuant to sections 25-1-107, 25-1-109, 25-4-1610(c) and 25-4-1611 Colorado Revised Statutes, you as the licensee are hereby ordered to maintain correction of the deficiencies so as to comply with the Colorado Retail Food Establishment Rules and Regulations. Specifically, enact and enforce Standard Operating Procedures (SOPs)to ensure ongoing compliance with the Colorado Retail Food Establishment Rules and Regulations by training employees on cold holding and cooling procedures and monitoring employees to ensure compliance with SOPs. An example SOP has been enclosed for your use. The Weld County Department of Public Health and Environment shall assess compliance during the next follow-up inspection. Any written statement or data concerning the deficiencies set forth above will be considered by the Department. Failure to comply with the provisions of this First Notification of Non-Compliance by continued or additional violations within the categories of rules and regulations of which you are notified herein, will subject you, as licensee, to additional enforcement proceedings. The following item was found to be in violation of the Colorado Retail Food Establishment Rules and Regulations (* denotes a critical violation): VIOLATIONS *03e Found inserts of shredded cheese and tomatoes in drawer under grill at 56 degrees F at time of inspection. Potentially hazardous foods shall be kept cold at 41 F or below. It was determined that food was not off temperature more than four hours, inserts moved to walk in to cool. Dan Joseph and Debra Adamson met with Jesus Fuentes and Glenda Donoho (managers) to discuss concerns and to develop a plan of correction for the outstanding violations. At this time the Department has one main concern regarding food safety, the improper cold holding of potentially hazardous foods. However, other violations were discussed as these have the potential to become issues if not resolved. Violations discussed included, but aren't limited to: hygienic practices, improper hot holding of potentially hazardous foods, and pest control. We discussed correction options with staff in an attempt to ensure that these violations would not be cited on future inspections. You stated that temperature logs are being kept for the refrigeration units that have had issues and that those same refrigeration units have been repaired. In addition, you stated that staff are taking temperatures on a regular basis and that units are being cleaned. Department staff recommended that in addition to keeping logs for the refrigeration units that have had prior issues, that logs be maintained for all refrigeration units in the facility. Department staff also recommended that the facility maintain a training log for staff indicating what training was given and which staff member received that training. During our discussions, you were provided with the last two (2) years of inspection reports, a summary showing the number and types of violations since 2011, enforcement letters since 2011, and a manual on active managerial control titled"Managing Food Safety: A Manual for the Voluntary use of HACCP Principles for Operators of Food Service and Retail Establishments." September 24,2012 A Second Notice of Civil Penalty ($500.00) and Notice of Non-Compliance Intervention Meeting (Enforcement Meeting) was sent to the facility via certified mail and was signed for by Lorena Fuentes on October 1, 2012. October 4, 2012 The second civil penalty in the amount of$500.00 was paid in full. October 11, 2012 An Enforcement Meeting was conducted at the health department office for Double Tree Restaurant and Lounge. It was attended by Debra Adamson and Dan Joseph of WCDPHE as well as Jesus Fuentes and Glenda Donoho from the restaurant. . The meeting included discussion of the compliance and enforcement process in the event further violations were cited as well as potential solutions for the violations that had continued to occur. October 23, 2012 A Formalization of Enforcement Meeting summary was issued via regular mail. November 7, 2012 A follow-up inspection was conducted in which violation 03e (improper cold holding of potentially hazardous food) was again cited. Pursuant to the above information and as provided in Section 25-4-1611 (I), C.R.S. 1998, Repl. Vol.,you are hereby ordered to pay the civil penalty in the full amount of$1,000.00. Such civil penalty must be received by the Weld County Department of Public Health and Environment within ten (10) days from the receipt of this letter. Checks must be made payable to Weld County Department of Public Health and Environment (WCDPHE). You are scheduled to appear before a public meeting of the Weld County Board of Commissioners on Monday, December 10,2012, at 9:00 a.m. The hearing will be held at the Weld County Centennial Center, 1150 O Street, Greeley, Colorado, during the regular Board meeting. The Board will be requested to authorize legal action to enjoin the operation of your establishment unless and until you are in compliance with the Colorado Retail Food Establishment Rules and Regulations. Always check the temperature of all food a. All Food handlers will have a thermometer in their pocket while on their shift. b. Every time the refrigerator door is opened the temperature will be checked. c. If food is found off temperature it will be discarded. 2. Maintaining food at cold temperature a. All food underneath the mainline grill needs to be covered at all times with correct lid. b. Add-ons-(ham, cheese, and tomatoes) need to be close to cooking operations to minimize temperature loss of cooler. c. Add ice under container with food to keep food cool d. All meats and the temperature of cooler should be watched very closely and documented. i. Try and maintain chicken 1/2 ° from freezing. 1. Raw on bottom & ready to eat on top. e. A monthly check has been put in place on all coolers and freezers for proper function and maintenance. i. All reports will be put in a file for record. 3. Stopping the spread of bacteria a. On the main grill we will use different tongs and spatula for meat, seafood, poultry, and egg, as well as keep them separate. b. Wash surfaces and utensils after every use. c. Hands will be washed after each touching of different foods. Soap and hot water will be used for at least 20 seconds of scrubbing. d. Change of gloves every time food is touched. X 4. Food Handler Training Course a. All current employees are up to date with this training course. b. All new employees will take and pass the course before being released to work. 5. Main Cause of All these violations were due to miscommunication. But with 100% participation of all staff all problems are resolved and they are at above standard. 7. All new hand soap dispensers have been placed by every sink along with paper towels. The dishwashers will check at the beginning of every shift to ensure its full and working properly along with the level of paper towels. 8. Gloves are put in easy to reach places so they can be easily changed. 9. If equipment is found off temperature we will move all items, if not off temperature, to another place and call to fix equipment ASAP.
