HomeMy WebLinkAbout20123483.tiff RESOLUTION RE: ACTION OF BOARD AT INITIAL HEARING CONCERNING RESCINDING USE BY SPECIAL REVIEW PERMIT#1741 - ROSWELL AND KERRY CHECKETTS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 21, 2010, the Board approved the application of Roswell and Kerry Checketts, 21506 County Road 43, LaSalle, Colorado 80645, for a Site Specific Development Plan and Use by Special Review Permit #1741 for an Agricultural Service Establishment primarily engaged in performing agricultural, animal husbandry, or horticultural services on a fee or contract basis, including a Livestock Confinement Operation (expansion of an existing dairy to a total of 1,400 animals, including milking cows, dry cows, heifers, and calves) in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lots A and B of Recorded Exemption #3556; located in part of the S1/2 NW1/4 of Section 15, Township 4 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services notified the applicant of outstanding Conditions of Approval and items to be completed prior to recording the plat, by letters dated August 5, September 26, and December 15, 2011, and WHEREAS, on the 16th day of January, 2012, an Initial Hearing was held before the Board to consider granting additional time to meet all of the conditions/requirements of approval and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special Review Permit#1741 and Deny the application, and WHEREAS, at said hearing, Tim Naylor, AGPROfessionals, LLC, represented Roswell and Kerry Checketts, and WHEREAS, after hearing all testimony presented, the Board deemed it advisable to continue the matter to September 10, 2012, and then to December 10, 2012, to allow the applicant additional time to meet all of the conditions/requirements of approval and record the plat, with the direction that the applicant provide quarterly status reports to staff. Remaining Outstanding Conditions of Approval: All conditions of approval have been addressed with the exception of the following: Demonstrate that proposed open lot wastewater impoundments will meet the setbacks to water wells and groundwater for new and expanded impoundments required by Colorado Water Quality Control Commission Regulation Number 81 (6 CCR 1002-81), Section 81.8(6)(a)&(b)and that the impoundment's liner(s)meet the seepage rate standards of Section 81.8(2). Evidence of such shall be provided to the Departments of Public Health and Environment and Planning Services. Staff Recommendation: The State of Colorado has given the applicant until August 31, 2012 to demonstrate compliance with State requirements. The pond has been installed but the liner is still in the process of being added. The applicant has requested an extension from the State of Colorado until November 30, 2012 to allow the liner to be installed and tested. • This proposed extension is to allow the applicant time to satisfy a requirement of the Colorado Department of Public Health and Environment. At this time staff does not have evidence that the State of Colorado has accepted this extension request. As the letter states, the pond was scheduled to be completed by August 31 and was in progress at the quarterly progress report.The pond has been excavated and the liner is being placed. The complaint indicated that the wastewater was entering an irrigation ditch and could potentially end up in the Lower Latham Reservoir. On May 24, 2011, members of the Ag Program and Weld County Department of Public Health and Environment conducted a site visit at the facility. On the day of the visit, there were approximately 625 mature dairy cows, 36 cattle and 60 calves confined at the facility. The facility is a Medium Animal Feeding operation as defined in Colorado Water Quality Control Commission regulation No. 81, section 81.2 and is therefore expected to meet and maintain compliance with all applicable regulatory requirements. At the time of the site visit, no wastewater was observed actively discharging from the impoundment located in the northeast corner of the facility. It was noted that additional dirt/fill had recently been placed along the impoundment berm effectively eliminating any discharge of wastewater. However, there was a clear indication that wastewater had recently flowed north from the impoundment, entered an irrigation tail-water ditch and exited the facility's property. The wastewater flowed north, crossing an adjacent property, and appeared to enter an irrigation ditch that would terminate in Beebe Draw and eventually enter the Lower Latham Reservoir. There was no indication that the berm had been cut or otherwise compromised to encourage the discharge, but there appeared to have been a seep of wastewater through the impoundment berm. The impoundment was full at the time from recent heavy rains in the area. The facility does not currently land apply wastewater and relies solely on evaporation for disposal. The facility informed the Ag Program that they arc working with a local consultant to address the wastewater storage system. Construction activities associated with a new impoundment and settling basin, located south of the existing impoundment, were observed at the time of the site visit. The facility Mr.Checketts June 16,2011 Page 2 of 2 stated that once the impoundment and settling basin arc completed, wastewater will be pumped and redirected into the new impoundment so improvements can then be made to the existing impoundment. Regulation No. 81 requires that facilities defined as a Medium AFO design, construct, and maintain impoundments that are capable of storing, at minimum, the volume of liquid manure and process- generated wastewater for 180 days if allowed to evaporate or 120 days if wastewater is land applied. Furthermore, impoundments are also required to have documentation prepared by a professional engineer registered in the state of Colorado certifying that they are lined and do not allow a seepage rate in excess of l x 10-6 cm/sec. The deadline for meeting these requirements was May 30, 2011. On June 3, 2011, the Ag Program received a letter from AgProfessionals, LLC on behalf of the facility. The letter stated that the facility has been working on improvements since September 2009, and anticipates that all construction and corresponding documentation for regulatory compliance will be completed by August 31, 2011. Based on information gathered during the site visit, and information provided by AgProfessionals, LLC, the Ag Program feels that the facility is actively implementing necessary improvements to the wastewater handling system to ensure that releases of wastewater from the impoundment will not occur in the future. The Ag Program approves the requested extension and expects that the extension will facilitate compliance with all regulatory requirements on or before August 31, 2011. Medium AFOs are also required to have documentation on site, prepared by a certified engineer registered in the state of Colorado, certifying that each impoundment has a liner that does not allow seepage in excess of 1x106 cm/sec. The deadline for meeting these requirements was May 30, 2011. Marcellina Dairy (facility) meets the definition of a Medium AFO and is subject to these requirements. On June 3, 2011, the Colorado Department of Public Health and Environment's Environmental Agriculture Program (Ag Program)received a request from AgProfessionals, LLC, on behalf of the facility, to extend the deadline for compliance with these regulatory requirements until August 31, 2011. The Ag Program approved this request in a letter to the facility dated June 16, 2011. On September 7, 2011, the Ag Program received a second request from AgProfessionals, LLC, on behalf of the facility, to extend the deadline for completion of the regulatory requirements until August 31, 2012. Based on information provided in the September 7, 2011 extension request, the Ag Program understands the facility has completed a groundwater investigation and is currently constructing a wastewater impoundment and settling basin. Liner material has been identified but the available amounts and accessibility is requiring that other options be explored. As noted in the June 20, 2011 correspondence to the facility, the Ag Program will not grant any further deadline extensions for compliance with Regulation No. 81 requirements. Therefore, in order to bring the facility into compliance, please provide documentation demonstrating the facility has met the requirements of Regulation No. 81 to the Ag Program on or before the compliance date of August 31, 2012.
