BRUSH, COLORADO 80723 IN LOT 9, BLOCK 4 OF WEST HILL 'N
PARK, LOCATED IN THE SOUTH HALF OF SECTION 26, TOWNSHIP 5
NORTH, RANGE 66 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, are vested with the authority of managing the affairs
of Weld County, Colorado, and
WHEREAS, it has come to the attention of the Board of County
Commissioners that Charles E. Newport has started construction
on a carport located on the above described real estate without
having obtained a building permit , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desire to issue to Charles E. Newport a building
permit for the purpose of building a carport on the above
described real estate.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that Charles E. Newport
be, and hereby is , granted a building permit for the purpose of
building a carport on the above described real estate, subject ,
however, to approval of a final plat by the Board of County
Commissioners on the West Hill 'n Park Subdivision.
BE IT FURTHER RESOLVED that the issuance of this building
permit does not absolve the owner or owners of said real estate,
or developers of said real estate from any violations of the
Weld County Zoning Resolution or Subdivision Regulations .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 15th
day of November, A.D. , 1976 .

SUBJECT: Request for Building Permit and sale of lots in West
Hill 'n Park PUD
This item is being presented for your information regarding apparent sale
of lots in an area which has not yet been final platted. On the attached
map-there is an outline of the entire West Hill 'n Park area which was
zoned Mobile Home PUD. The shaded area is what has been final platted
to date. The balance in white has been preliminarily platted, however,
because of limitations the area has not been final platted. The white
area immediately west of the shaded 1st filing and immediately north of
County Road 52 is illustrated as lots on a culdesac. Three of these
apparently have mobile homes and the fourth is the lot for which a
building permit has been requested. None of these have been platted but
have apparently been sold, although there are no instruments of record
to establish a transaction.
1 . Section 13 of the Subdivision Regulations is attached for your reference.
Under this section, it is stated that it is illegal to sell unsubdivided
land prior to a plat being approved and filed. Also the Board of County
Commissioners shall have the power to bring an action for such activity.
Section 13C. states that the Board may authorize building permits on land
divided in an illegal manner and approve accesses. If such an approval were
granted, it should be clearly stated that issuance of the permit is not in
any way intended to relieve or absolve the perpetrators of the violation(s)
of any civil or criminal liability. It is merely intended to not permit
unjust treatment to innocent victims.
2. There has been an apparent sale of four lots in the unplatted portion
of the aforementioned subdivision, however, there is no record of said
transactions available. These lots would be designated as Lots 8, 9, 10 and
11 of Block 4, West Hill 'n Park Second Filing.
3. A request for a building permit for a garage on a Lot 9, Block 4 has
been made. The Dept. of Planning Services has no authority to issue the
permit. The applicant for the permit is one Charles E. Newport. He has
indicated that he is currently purchasing the property.
Additional information:
In March of this year N.H.P.Q. submitted an application for West Hill 'n Park
Second Filing. Upon review of the submittal , three items were asked to be
done to complete the submission. These items are:
1 . Submission of plans to the County Engineer to insure completeness.
2. Submission of a contract or some tangible guarantee that water service
will be available, and
3. Submission of a contract or some tangible guarantee that sewer service
will be available.
These items have not yet been presented. As soon as we have these items,
action can begin to process a final plat on the area known as Second Filing.
SECTION 13 VIOLATIONS AND PENALTIES
A . Any subdivider , or agent of a subdivider , who transfers
or sells or agrees to sell or offers to sell any sub-
divided land before a final plat for such subdivided land
has been approved by the Board of County Commissioners
and recorded or filed in the office of the County Clerk
and Recorder shall he guilty of a misdemeanor and shall
be subject to a fine not to exceed five hundred dollars
for each parcel or interest in subdivided land which , is
sold or offered for sale . All fines collected under this
paragraph (A ) shall be credited to the general fund of
the county .
B . The Board of County Commissioners of the county in which _
the subdivided land is located shall have the power to
bring an action to enjoin any subdivider from selling ,
agreeing to sell , or offering to sell subdivided land
before a final plat for such subdivided land has been
approved by the Board of County Commissioners .
C . Building Permits

( I ) Building permits , for construction on land divided

this ,Resolution , shall liot he issued unless reviewed

Sec. 203. All buildings or structures which are structurally unsafe or not pi oviduct with adequate egress,or which constitute a fire hazard,
or ate otherwise dangerous to human life, or which in relation to existing use constilme a hazard to safely or health or public welfare, by
reason of inadequate maintenance, delipidation, obsolescence, fire hazard, disaster damage, or abandonment, as Sneof'it in this Code or any

Sec. 1405. Ib) Sanitation. Every dwelling unit shall be provided with a kitchen equipped with e kitchen sink and with bathroom facilities
consisting of a water closet,lavatory and either a bathtub or shower. Plumbing fixtures shall be provided with running water necessary for their
operation.
