HomeMy WebLinkAbout20122261.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING A SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT, USR12-0031 (FORMERLY USR-632), FOR AN AGRICULTURAL SERVICE ESTABLISHMENT PRIMARILY ENGAGED IN PERFORMING AGRICULTURAL, ANIMAL HUSBANDRY OR HORTICULTURAL SERVICES ON A FEE OR CONTRACT BASIS, INCLUDING: GRAIN AND/OR FEED ELEVATORS, GRAIN AND FEED SALES, COMMERCIAL GRAIN STORAGE AND DRYING, SEED PRODUCTION, PROCESSING, STORAGE, MIXING, BLENDING AND SALES AND RETAIL AND WHOLESALE OF PRODUCTS AND SIMILAR GOODS ASSOCIATED WITH THE AGRI-BUSINESS AND AGRICULTURAL USES AND A VARIANCE TO THE SETBACKS REQUIREMENT FROM A PUBLIC RIGHT-OF-WAY IN THE A (AGRICULTURAL) ZONE DISTRICT - NORTHEAST GRAINS, LLC, AND FORREST AND JUDY TAPPY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of August, 2012, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing the application of Northeast Grains, LLC, 417 Glenora Street, Sterling, Colorado 80751, and Forrest and Judy Tappy, P.O. Box 115, Stoneham, Colorado 80754, for a Site Specific Development Plan and Amended Use By Special Review Permit, USR12-0031 (formerly USR-632), for an Agricultural Service Establishment primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including: grain and/or feed elevators, grain and feed sales, commercial grain storage and drying, seed production, processing, storage, mixing, blending and sales and retail and wholesale of products and similar goods associated with the agri-business and agricultural uses and a variance to the setbacks requirement from a public right-of-way in the A (Agricultural) Zone District on the following described real estate, to-wit: South 13 feet of Lot 15 and all of Lots 16, 17, 18 of Block 3 Stoneham; being part of the NW1/4 NW1/4 SE1/4, SW1/4 SW1/4 NE1/4 of Section 5, Township 7 North, Range 56 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing the Board deemed it advisable to grant the applicant's request to continue said matter until September 26, 2012, due to a scheduling conflict and to allow Northeast Grains, LLC, and Forrest and Judy Tappy to have the matter heard by a full quorum of the Board, and Q U CJv Pl., PLc), 2012-2261 CA Q i a PL0599 RE: CONTINUANCE (USR12-0031) - NORTHEAST GRAINS, LLC / FORREST AND JUDY TAPPY PAGE 2 WHEREAS, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant and, having been fully informed, finds that this request be approved and the matter should be continued to September 26, 2012, at 10:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the abovementioned matter be, and hereby is, continued to September 26, 2012, at 10:00 a.m. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 29th day of August, A.D., 2012.
