RE: FINDING AND ORDER: ABATEMENT OF NUISANCE CONDITION ON PROPERTY
OWNED BY MR. CHARLES G. SMITH - C.R.S. 25-1-518
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mr. Charles G. Smith, owns property located on a three (3) acre parcel
(Parcel#070531100004), located in part of the W1/2 NE1/4 of Section 31, Township 7 North,
Range 67 West of the 6th P.M., Weld County, Colorado("the Property"), on which household trash,
including food waste, has been deposited, thereby constituting a nuisance in need of abatement in
accordance as per provisions of Section 25-1-518, C.R.S., and
WHEREAS, despite efforts by the Department of Public Health and Environment("DPHE")
staff to resolve said matter, the nuisance was not abated, and
WHEREAS, on the 23rd day of July, 2012, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said nuisance condition,and
WHEREAS, Mr. Charles G. Smith was not present or represented at said hearing, although
he was notified of said hearing by the DPHE, and
WHEREAS, the Board of County Commissioners deems it advisable to issue an Order of
Abatement against Mr. Charles G. Smith, thereby ordering that the nuisance condition on the
Property be abated within 24 hours, and if the abatement is not completed within said 24 hours,
ordering that the DPHE arrange for the abatement of said nuisance and assess the cost of said
abatement against the Property or against Mr. Smith, as allowed pursuant to Section 25-1-518,
C.R.S.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, an Order of Abatement against Mr. Charles G. Smith be, and hereby is, issued
whereby Mr. Smith is ordered to abate the nuisance condition on the Property within 24 hours of the
date of this hearing and, if said abatement is not completed within said 24 hours,that the DPHE be,
and hereby is, ordered to arrange for the abatement of said nuisance and assess the cost of said
abatement against the Property or against Mr. Smith, as allowed pursuant to Section 25-1-518,
C.R.S.

Nuisance Condition& Notice of Hearing
Dear Mr.Smith:
In response to a complaint,your property,a 3 acre parcel(Parcel 4070531 100004),south and adjacent to Alexander Estates,
Weld County,Colorado was inspected by a representative of this Department. The inspection revealed that trash,which
included food waste,was being disposed of on the property. The trash was not stored in closed containers and was uncovered
and accessible to pests. This trash allows for the attraction,breeding.and emergence of birds, insects,rodents and other disease
vectors.
The Department requested that you remove and properly dispose of the trash during a telephone conversation on June 29,2012
and sent a letter via Certified Mail and U.S. Mail, stating the same,on July 2,2012. Inspections on July 6 and July 13,2012
revealed that the trash remains on-site.
The above described condition constitutes a nuisance. Title 25, Article I. Part 518 of the Colorado Revised Statutes(25-1-518
C.R.S.)provides the following:
The county or district board of health shall examine all nuisances,sources of filth,
and causes of sickness, which, in its opinion,may be injurious to the health of the
inhabitants, within its...,county...,and shall destroy, remove,or prevent the same
as the case may require.
At a public meeting of the Weld County Board of County Commissioners on Monday,July 23,2012 at 9:00 AM,this
Department will request that the Board,as Board of Health, issue an order to abate, within 24 hours,the above identified
nuisance condition on your property. Should you not abate this nuisance condition,the Board may have the nuisance abated
and the costs of this abatement assessed against you or the property. Your presence is requested at this meeting,which will be
held in the Hearing Room,Weld County Administration Building, 1150 O Street,Greeley,Colorado. If the nuisance is
abated prior to this hearing it will be removed from the agenda. If you have any questions,please contact this office at(970)

Subject: Illegal Disposal of I lousehold Trash at(Parcel#070531100004), Weld County,Colorado.
Dear Mr.Smith:
In response to a complaint your property,a 3 acre parcel(Parcel 4070531100004), south of Alexander Estates, Weld County,
Colorado was inspected by a representative of this Department. The inspection revealed that trash,which included food waste,
was being allowed to accumulate on the property. The trash was not stored in closed containers and was uncovered and
accessible to pests. This trash allows for the attraction,breeding and emergence of birds,insects, rodents and other disease
vectors.
During a telephone conversation with the Department on June 29,2012 you said the trash was deposited on the property by you
and that you intended to sort and burn it once a burn permit could be obtained. You were informed by the Department that the
burning,burial,storage and sorting of trash was not allowed at the property and no bum permit would be issued for burning
trash even if there were currently no statewide fire ban in place. Furthermore,you were requested to remove and properly
dispose of the trash by July 4,2012 and asked to keep the Department updated regarding your plans and progress.
The above described condition constitutes a nuisance. Title 25, Article I, Part 518 of the Colorado Revised Statutes(25-1-518
C.R.S.)provides the tallawing:
