RE: RECORDED EXEMPTION 224 - RICHARD L. NEALE and KAREN NEALE
WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, at a public hearing
held on the 30th day of August, 1976, in the Chambers of the
Board of County Commissioners, Weld County, Colorado, that a
certain parcel of land, being the property of Richard L. Neale
and Karen Neale, Box 280, Platteville, Colorado, and more
particularly described as follows, to-wit :
The South Half (5z) of the Northeast Quarter
(NE4) of Section 15, Township 3 North, Range
66 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows :
Beginning at the Southeast Corner (SE Cor)
of said South Half (31/2) of the Northeast Quarter
(NE4) of said Section 15, and considering the
East Line of said South Half (S1) of the North-
east Quarter (NE4) as bearing South 00°05 ' 43"
East, with all other bearings contained herein
relative thereto;
Thence South 89°47 ' 37" West, 30. 00 feet to the
True Point of Beginning.
Thence continuing South 89°47 ' 37" West, 2640 . 43 feet;
Thence North 00°02 ' 52" West, 1316 . 04 feet;
Thence North 89°51 ' 43" East, 2639 . 33 feet;
Thence South 00°05 ' 43" East, 1312. 89 feet
to the True Point of Beginning.
Said described parcel of land contains 79. 652 Acres,
more or less, and is subject to any rights-of-way
or other easements as recorded by instruments
of record or as now existing on said described
parcel of land,
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, desires to exempt this particular
division of land pursuant to its authority under Section 30-28-
101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED that the hereinabove described
parcel of land owned by RICHARD L. NEALE and KAREN NEALE, be
exempt from the definition of the terms "subdivision" and "sub-
divided land" , as provided for in Section 2-lA(3) of the Weld

County Subdivision Regulations .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 1st

Re: Recorded Exemption 224
Dear Commissioners:
The attached application, plat, and related materials are in reference
are in reference to a request by Richard Neale for a Lot Size Variance
and a Recorded Exemption. The parcel in question is described as the
SZ of the NE4 of Section 15, T3N, R66W of the 6th P.M. , Weld County,
Colorado. Said property is located 3 miles east and 11/2 miles north
of Platteville. The subject propety contains 79/662 acres of pre-
dominately Class IV and VI non-irrigated soils. The request is to
split the property into parcels of 12.398 acres and 67 .264 acres.
Mr. Neale has his residence on the 12.398 acre parcel . There are no
improvements on the 67.264 acre parcel .
Based upon the information submitted and the adopted policies in the
County, the Planning Commission staff recommends denial for the following
reasons:
1 . The proposed split does not comply with the Weld
County Comprehensive Plan because it would promote
non-agricultural use of agricultural land and it
would encourage urban encroachment on rural land
use.
2. The request is not in compliance with the intent
clause of the recorded exemption procedure (Sec.
9-2 of the Weld County Subdivision Regulations).
Said clause states:
"The intent in establishing the Recorded
Exemption procedure is to provide, in
accordance with the Weld County Compre-

hensive Plan, a means wereby non-productive
agricultural lands may be developed for
higher or more productive uses, in-so-far
as such uses are compatible with surrounding
agricultural uses in areas where such land di-
visions are proposed. (Rev. 4/17/74)"
The granting of the lot size variance and recorded exemption
would allow for the conversion of agricultural land to an
urban type of use which would not be a higher or more productive
use and said urban use would not be compatible with surrounding
agricultural uses.
3. The recorded exemption request is not in conformance with the
intent clause of the Agricultural Zone District (Section 3.3 A
of the Weld County Zoning Resolution) which states:
"Intent - The intent in establishing the A-I Agricul-
tural Zone District is to allow all agricultural and
related uses in those areas in which agriculture is
and should continue to be the predominant land use.
This district is intended to discourage encroachment
of incompatible uses upon the agricultural land
in the district, to encourage agricultural uses as
the highest and best use of the land in the district
as compared with other uses in conflict therewith,
and to provide for the orderly expansion of urban
growth in conformance with the Weld County Compre-
hensive Plan."
The request would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would be breaking up a large
block of land.

Dear Commissioners :
Due to circumstances beyond my control, I am forced
to request a recorded exemption for a property split on
my Farm.
I purchased the 80 sores in December 1971 and in 1973
I built my home on it. I was advised at the time of closing
that my real estate taxes would be approximately $564. 00
(attachement A) . Instead my real estate taxes turned out
to be $1231.19 (attachement B) . I am in real danger of
losing my home or the farm land (67 acres ) . I can not
afford the taxes on the home and the payments on the farm
land. I must sell the farm land in order to retain my
home. I request your consideration of this matter.
