Re : Widmaier irrigation culvert
Dear Mr. Houtchens :
We have your letter of May 8th, 1978 addressed to Mr. Gilman
E. Olson of the Department of Engineering of Weld County,
Colorado, relative to the Widmaier irrigation culvert.
Please be advised that on May 17th, 1978 at the regular meet-
ing of the Board of County Commissioners of Weld County, Colo-
rado, I was instructed by the Board of County Commissioners
to write you advising you that Weld County is fully aware
that the culvert exists at the site you mentioned in your
letter, namely approximately half way between County Roads
#37 and #39 , precisely at a point where the NW corner of
Section 7 , Township 7 North, Range 65 West, bears north 90°
west 2, 775 feet.
I am further authorized to advise you that Weld County has
no objections to the continued use of this culvert at the
above described site.

Please find attached a request for written permission from
Weld County for the present location of a culvert across
Weld County Road 84 approximately half way between Weld
County Roads 37 and 39 .
An on site inspection reveals this culvert has been in
existance some length of time and I see no apparent
problems by leaving it as is . Therefore , I would
recommend this written request be granted .

Re: Widmaier irrigation culvert
Dear Mr. Olson:
Pursuant to my conference with you the other day I am writing to
obtain written permission from Weld County for the location of a
culvert which is presently in existence on County Road #84
between County Road #37 and #39 . The culvert is located approx-
imately halfway between County Roads #37 and #39 and was legally
described in a statement of claim to a water right filed in the
state engineer' s office in 1969. According to that statement of
claim the culvert is located at a point whence the NW corner of
Section 7 , Township 7 North, Range 65 West, bears north 90 west
2 , 775. 00 feet. The water is collected in the borrow pit of
County Road #84 and then carried in the culvert into an open ditch
onto the Widmaier property to the south.
I can find no records of who constructed the culvert under the
County Road but find that Mr. Widmaier himself bought the materials
in May of 1970.
You and I checked the County permit record file for that period of
time and did not find a permit in the name of Mr. Widmaier. His
son William advises me that it is possible that the County may
have constructed the culvert under the road for Mr. Widmaier.
The owner of the property that is served by the culvert now is
Mariam A. Widmaier and William K. Widmaier, Trustees under
Declaration of Trust of Marion C. Widmaier.
The owners understand that in the event any changes are made to
the County Road in the future, that would necessitate removal for
relocation of this installation, they will be required to do so
probably at their own expense upon the written request of Weld
County, Colorado. They further understand that Weld County , Colorado
will not be responsible for any damage that may result in the
maintenance of the roadway to the installation placed inside
County right of way limits.

If I can supply any further information, please let me know.
I need some form of written permission from the County for the
location of this water diversion before I go to a hearing
before the Referee of the Water Court which is scheduled for
hearing on Friday, June 9, 1978.
