HomeMy WebLinkAbout20120653 HEARING CERTIFICATION DOCKET NO. 2012-15 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR12-0001, FOR USES SIMILAR TO THE USES LISTED AS USES BY SPECIAL REVIEW (FIRE STATION AND TRAINING FACILITIES - BURN TOWER, PUBLIC EVENTS) AS LONG AS THE USE COMPLIES WITH THE GENERAL INTENT OF THE A (AGRICULTURAL) ZONE DISTRICT - PLATTE VALLEY FIRE PROTECTION DISTRICT A public hearing was conducted on March 7, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair - EXCUSED Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Tom Parko Public Works representative, Heidi Hansen Health Department representative, Mary Evett The following business was transacted: I hereby certify that pursuant to a notice dated February 2, 2012, and duly published February 8, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of the Platte Valley Fire Protection District, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0001, for Uses similar to the uses listed as Uses by Special Review (fire station and training facilities — burn tower, public events) as long as the use complies with the general intent of the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Chair Pro-Tem Garcia advised the applicant's representative, Fred Voseipka, RLH Engineering, Inc., that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Conway will listen to the record and make the determining vote. Mr. Voseipka indicated he would like to proceed today. Mr. Yatabe referenced the design plans submitted by the applicant, which are duplicates of previously submitted Planning Commission Exhibit 5.B. Tom Parko, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site. He stated the property is intended to accommodate a new fire station and training facilities, with the number of employees at the site varying from five to eight, during regular shifts, and increasing up to 20 to 45 people during volunteer firefighter trainings. He further stated the regular office hours will be 9:00 a.m., to CA Pt• y Pw, 4 � 2012-0653 H - (2], r } PL2148 HEARING CERTIFICATION - PLATTE VALLEY FIRE PROTECTION DISTRICT (USR12-0001) PAGE 2 5:00 p.m., Monday through Friday; however, the facility will technically operate 24 hours a day, seven days a week, on an emergency basis. Mr. Parko indicated the site is located within the Intergovernmental Agreement (IGA) area for the Town of Kersey, which indicated no desire for annexing the site, since it has no means for providing utility services; however, they did request landscaping that is consistent with the Town's standards. He stated twelve referral agencies reviewed the proposal, six offered comments which have been addressed in the Conditions of Approval and Development Standards, and staff received no correspondence from surrounding property owners. He reviewed an aerial vicinity map depicting the surrounding land uses and Kersey IGA boundary, and also stated Non-conforming Use Permit, NCU-131, will be terminated, since the unpermitted mobile home has been removed from the site. Mr. Parko stated the applicant intends to retain the existing house to be used for future operations, the seven-acre parcel was created through Recorded Exemption, RECX11-0029, the Landscaping Plan will meet the intent of Kersey's request, and he displayed photographs of the site and surrounding area. Heidi Hansen, Department of Public Works, stated the site is accessed from County Road (CR) 53, which is a collector road requiring 80 feet of right-of-way at full buildout, and has an average daily traffic count of approximately 3,780 vehicles. She stated the stormwater drainage has been reviewed and approved by staff, and the grading permit will be approved following this hearing. In response to Commissioner Rademacher, Ms. Hansen stated there are no plans to upgrade CR 53 to an arterial at this time. Mary Evett, Department of Public Health and Environment, stated a tap has been issued by the Central Weld County Water District and there is a well for the new building fire suppression system and hydrant. She stated the septic system has been approved by the Board of Public Health, which will service the residence that is to house firefighters until the new fire station is constructed. She stated the applicant has submitted a Dust Abatement Plan, and they submitted documentation at the Planning Commission hearing indicating they will not be doing maintenance at the site, which resulted in the deletion of Conditions of Approval #1.B, #1.E, and Development Standard #18; however, those changes were not reflected in the Resolution and need to be removed from the Board's Resolution. In response to Commissioner Rademacher, Ms. Evett reviewed the proposed number of employees and stated the septic system is already designed to accommodate the extra capacity of the community room and living quarters. In response to Commissioner Kirkmeyer, Ms. Evett explained Condition of Approval #1.6 is a requirement for septic systems designed to serve more than 20 persons. Commissioner Kirkmeyer also requested Development Standard #11 be modified to clarify that emergency vehicles are exempt from the noise level restrictions. Mr. Voseipka referred to the site design drawings, previously submitted as Planning Commission Exhibit 5.B, which he reviewed for the record, including the site layout, landscaping plan, accesses, parking, septic field location, and irrigation ditches. He stated the well is permitted for firefighting purposes within the property, and he also reviewed the grading plan, and interior layout plans. In response to Commissioner Rademacher, Ms. Hansen stated the applicant did provide a full stormwater detention pond, due to the amount of paving on the site. Mr. Voseipka confirmed the maintenance of equipment will be done off-site. 2012-0653 PL2148 HEARING CERTIFICATION - PLATTE VALLEY FIRE PROTECTION DISTRICT (USR12-0001) PAGE 3 No public testimony was offered concerning this matter. In response to Commissioner Kirkmeyer, Mr. Voseipka stated some of the outbuildings will be demolished and the applicant is agreeable to the language contained in Condition of Approval #1.C. Responding further to Commissioner Kirkmeyer, he agreed amending Condition of Approval #3 to allow up to one hundred eighty (180) days to record the plat would be preferable. In response to Chair Pro-Tem Garcia, Mr. Voseipka stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed and modified. Commissioner Kirkmeyer moved to approve the request of the Platte Valley Fire Protection District for a Site Specific Development Plan and Use by Special Review Permit, USR12-0001, for Uses similar to the uses listed as Uses by Special Review (fire station and training facilities— burn tower, public events) as long as the use complies with the general intent of the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Her motion included deleting Conditions of Approval #1.6 and #1.E, modifying Condition #3 to allow 180 days to record the plat, modifying Development Standard #11 to clarify emergency vehicles are exempted from noise levels, and deleting Development Standard #18 since no maintenance will be conducted at the site. The motion was seconded by Commissioner Rademacher, and it carried unanimously. There being no further discussion, the hearing was completed at 10:43 a.m. This Certification was approved on the 12th day of March, 2012.
