A Use by Special Review permit for a 100 foot wireless tower.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 28 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The applicant will use the existing access to the property. No additional accesses will be granted.
Water Quality is not a concern for an unmanned wireless tower site.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
• Management Agency (FEMA).
REQUIREMENTS:
1. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.

Environmental Health Services has reviewed this proposal for an expansion of an
existing 65 foot wireless communications tower by 35 feet. The height of the tower at
completion will be 100 feet. As no employees will be located at the site, permanent
water and sewer is not required. Portable toilets and hand washing units can be utilized
during construction of the expansion. Bottled water is sufficient for drinking provisions
during construction.
We have no objections to the proposal; however, we do recommend that the following
requirements are incorporated into the permit as development standards:
• 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. Adequate drinking (bottled water), toilet facilities (portable toilets) and hand
washing units shall be provided during construction of the facility.
6. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Comments: A building permit will be required for any new construction,alteration, or addition to any building or tower on the
property. It is recommended that a code analysis be done on the project by a design professional with experience
in this area.
A building permit application must be completed and two complete sets of plans including engineered foundation
plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review.A
geotechnical engineering report performed by a registered State of Colorado engineer shall be required. Building
permits are required for buildings, structures and change of use for buildings which required permits before the
beginning of construction or the proposed change of use.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit
application.Currently the following has been adopted by Weld County:2006 International Building Code;2006

Chris:The Town of Platteville is concerned about the location of the new Telecommunications
facility expansion and also unclear where this new facility will be located. Our reasons are as
follows:
The County may not be aware but Open Range is in bankruptcy and is forced to sell all equipment
as reported in the Denver Post. Chris you sent us a description for Open Range yet the
application in question seems to be for Level 3.
1) Chris-Can you please confirm that USR11-0012 is an application by Level 3 and that they
cannot locate on the existing sites within Platteville?
2) The Town has allowed three recent telecommunication facilities or expansions and like
the County, prefer co-location if at all possible. Current facilities that are within the
Town of Platteville and exceed the 35 ft. height limit include:
a. The Town Water tank just north of the cemetery along US 85;
b. The Open Range telecommunication facility just off Reynolds Avenue (508
Reynolds at the Town Park)—In 2009 we permitted the construction of one
weathered steel 100 foot monopole and related CMRS facilities within a 100 ft. X
100 ft. leased area. This equipment and service is being discontinued as I
understand it, since the company is in bankruptcy.
• c. The T-Mobile telecommunication facilities on top of Platteville Feed.This is
located at 405 Front Street and was expanded in March of 2009.
3) The Town Code specifically states that co-location within our defined Urban Growth Area
•
must first be considered prior to allowing additional towers, particularly those over 35 ft.
Specific section of the Town's CMRS regulations that we need to ensure are met are
included below. Can you confirm that the applicant has met these standards and also
confirm who is the applicant. Again,there is a reference to Open Range
"(c) Compliance with FCC standards. Upon a request by the Town (on no more than
one (1) occasion per year), CMRS facility owners and operators shall certify that:
(1) The CMRS facility complies with the current Federal Communications Commission
("FCC") regulations prohibiting localized interference with reception for television and
radio broadcasts; and
(2) The CMRS facility complies with the current FCC standards for cumulative field
measurements of radio frequency power densities and electromagnetic fields."
(f) Collocation. The Town encourages the collocation of CMRS facilities when feasible
to minimize the number of CMRS facility sites. To further the goal of collocation the
following standards apply:
(1) No CMRS facility owner or operator shall unreasonably exclude a
telecommunications competitor from using the same facility or location. Each request
for a new CMRS facility shall demonstrate why collocation is not feasible at an existing
facility or site.
(2) If a telecommunication competitor attempts to collocate a CMRS facility on
an existing or approved CMRS facility or location and the parties cannot reach an
agreement, the Town may require a third party technical study to be completed at the
• expense of both parties to determine the feasibility of collocation.
(g) Design Standards for CMRS Facility Sites. All CMRS sites are subject to the site plan
review process as set forth in Section 16-4-100 of this Chapter, and fees as specified in
Appendix A- Schedule of Fees. The review process shall vary according to the type of
CMRS facility proposed and the zone district in which the facility is located. The purpose
of the site plan review for CMRS facility sites is to ensure that the necessary antennae,
equipment, and equipment shelters are sited and screened in a way that minimizes visual
and physical impacts on the surrounding area. The following design criteria and
requirements shall apply to all CMRS antennae, equipment, and equipment shelters:
(1) All CMRS antennae, equipment, and equipment shelters shall be designed
to be compatible with surrounding buildings and existing or planned uses in the area.
This may be accomplished using compatible architectural elements such as color,texture,
scale, and character;
(2) The siting and installation of CMRS antennae, equipment, and equipment
shelters shall preserve or enhance the site. Existing vegetation, if any, should be
preserved and improved to provide screening for the facility;
(3) All freestanding CMRS facilities shall be fenced or secured to prohibit
tampering with the equipment. Fencing should not be used exclusively but instead be
supplemented with vegetation. Any security fencing should be a design that blends into
the character of the existing environment and meet the height limitation for the zone
district in which the fencing is located;
•
(4) All CMRS antennae and equipment should be no taller than necessary for
the efficient operation of the CMRS antennae and equipment;
(5) Applicants shall demonstrate that the CMRS facility site is a necessary
component of the applicant's overall communication network and communication plan
for the community. Such demonstration shall require that the applicant establish at least
one (1) of the following criteria: (1) the site is necessary to provide appropriate signal
coverage quality; (2)the site is made necessary pursuant to the applicant's FCC license; or
(3) the site is necessary to handle increased capacity due to caller volume. In addition,
the applicant shall demonstrate: (1) existing topography and/or structures in the
surrounding area preclude other locations in the same area; and (2) technical and
engineering factors require the site to be in the desired location in relation to other
existing sites and system constraints such as frequency requirements, availability of
electric power and interconnection to telephone land lines, and site access;
(6) All CMRS antennae, equipment, and equipment shelters shall be sited,
designed, and screened to minimize the visibility of such equipment from surrounding
properties, public streets and neighborhoods. All monopoles and radio towers shall
demonstrate that the materials and structure minimizes the visual impact on surrounding
properties to the greatest extent possible;
(7) The color(s) of all CMRS antennae, equipment, and equipment shelters
shall minimize the visibility of the CMRS facility; and,
(8) To minimize the visual and physical impact on the surrounding area caused
by freestanding and building mounted CMRS facilities, the Town encourages innovative
and multiple use of building and structures for the location of CMRS telecommunications
• facilities,antenna, and equipment.
We remain concerned that yet another 100 ft. telecommunication facility is being
constructed at the gateway to our community. WCR28 is the southern boundary of our
adopted Urban Growth Area Boundary. The Comprehensive Plan specifically references
this as the southern gateway to the Platteville Community. Co-location on the Town's
water tank, on the Platteville Feed Silo or on the 100 ft. monopole that will no longer be
in use should be investigated prior to allowing yet another 100 ft.tower. Please feel free

USR for Telecommunications Tower Extension
Dear Mr. Gathman:
Please find attached RF data provided by Level (3) Communications, LLC, justifying the
current need for the requested tower extension from 69 feet to 100 feet.
The information provided below is our response to the comments provided by Ms.
Barbara Cole with Community Matters, Inc. I am hopeful that said information will
provide Ms. Cole with a better understanding of our project and the Community need it
will satisfy.
• The proposed development to be reviewed by the County as a USR involves a request
to extend an existing microwave tower structure which will enable the existing facility to
better serve the surrounding communities by providing greater backhaul capacity for
both wireless broadband providers and wireless telecommunications providers.
Open range was just one of numerous wireless broadband providers who are
committed to providing wireless broadband throughout rural America in association with
a program sponsored by the USDA. Each of these providers together with the local
telecommunications service providers need the added backhaul capacity provided by
this facility.
The City needs to avail itself of the submitted RF Data, Photo Simulation data, and the
USR submittal data which clearly shows the exact location of the existing facility that is
slated for expansion.
The application is by Level (3) Communications, the fee simple land owner, and the
Fiber Optic (F.O.) backhaul provider. The tower extension can not be located on
existing sites in Platteville because the Level (3) equipment and the Level (3) F.O.
switch only exist at the Level (3) property.
The existing Level (3) Communications facility actually off loads some of the towers in
Platteville listed by Ms. Cole. Ms. Cole is concerned regarding the preference to
approve co-locations before allowing additional towers, this USR does not involve

an additional tower but rather is more inline with preparing an existing tower to handle
the co-location of additional antennas.
We will confirm that Level (3) Communication the fee simple property owner and the
owner of the F.O. backhaul system is the applicant for the USR. Furthermore, the
Applicant maintains an FCC license and the proposed tower structure extension is in
complete accord with the FCC regulations and the FAA regulations.
Additionally, the existing tower structure, and likewise the proposed tower structure
extension have been designed with access capacity in order to accommodate the future
co-locations of other service providers. The tower owners desire to accommodate
future co-location is demonstrated by the excess ground space maintained at the base
of the tower structure.
The proposed facility meets the screening requirements of Weld County. Furthermore,
the facility as been sited towards the interior of the parent tract thereby maximizing
existing natural buffers in an attempt to minimize potential visual impacts to adjoining
• properties and public right-of-ways. Additionally, the existing facility is enclosed by a
locked security fence.
The attached RF data establishes the fact that the proposed tower structure extension
is the minimum height necessary to provide the required level of service. Likewise, the
RF data demonstrates that the proposed tower structure extension is needed to
enhance the existing Level (3) Communications backhaul network.
With the existing Level (3) Communications F.O. network being located at the site of the
proposed tower structure extension and not at the Town's water tank, or the Platteville
Feed Silo or the 100 ft. monopole, the use of these structures in Level (3)
Communications' backhaul network is not a realistic option.
We are hopeful that the attached RF data together with the information listed above
might assist the Town in better understanding our proposal. Please feel free to contact
me if we can provide additional information.

Comments: CDOT has no issues with this proposal. Please note that direct access off of Highway 85 will never be
considered.Access must continue to come off of the county road system.Our right-of-way request is 100 feet
from centerline of the highway if not currently available.
