The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: The City of Dacono has jurisdiction over CR 13 (Colorado Blvd) and will dictate access and right-of-way requirements. The applicant stated that there are no employees and the public comes to the site minimally when puppies are available. A water quality depression design and location has been submitted and is acceptable to Public Works. • This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show and label the Water Quality Area on the Plat. 2. Add the following notes to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. Water will be supplied by Central Weld Water District. The water bill provided with the application indicates usage is for a dwelling unit. Approval for business usage is required. The application states that neither business will have employees. There will be clients who come to the site and they must have access to potable water, restroom and hand washing facilities. There was also no mention if any water will be used in the daily • sanitation of the kennel and/or supplies (bowls, bedding ect). Either an approved septic system will need to be installed for kennel and client usage or one of the existing permitted septic systems must be made available for use. There are two septic permits on file for this property. Septic permit G19870193 was issued fora 3 bedroom mobile home. Septic permit SE-9600017 was issued as a loan evaluation for a 4 bedroom mobile home. There is not a septic permit on file for the residence that was constructed in 1924. The application indicates that a homemade septic system is utilized for the kennel, which is not acceptable. Either an existing permitted septic system shall be utilized or a new septic system shall be installed. In either instance, an engineer's review is required. Waste handling and dust abatement plans are required. Noise will be restricted to the level allowed in the non-specified zone district. The applicant submitted a Pet Animal Care Facilities Act license that expired February 29, 2012. A current copy of the license is required. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: • • The following requirements are recommended to be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. Submit documentation from Central Weld County Water District indicating that water service is available for business usage. 3. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the residence constructed in 1924. Any existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. 4. In the event the applicant intends to utilize an existing septic system for the kennel and clients, the septic system shall be reviewed by a Colorado Registered • Professional Engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 5. Alternately to item #4 above, an individual sewage disposal system is required for the kennel and clients and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 6. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. • 2 • 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 7. The applicant shall provide a copy of the current license from the Pet Animal Care Facilities Act (PACFA) to the Weld County Department of Public Health and Environment. We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed weekly from the facility and disposed of by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid • waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 6. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. . 9. Adequate drinking, handwashing and toilet facilities shall be provided for visitors and clients of the facility, at all times. • 3 • 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes, at all times. The facility shall utilize the existing public water supply. (Central Weld County Water District) 11.Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 12.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. • • 4 • KitisrmMEMORANDUM COLORADO To: Chris Gathman, Planner May 14, 2012 From: Bethany Salzman, Zoning Compliance Officer Subject: USR12-0007 Referral Upon review of my case files and computer, an active Complaint (COMP11-00244) was noted. This complaint was initiated due to the operation of a Kennel without the necessary Weld County Zoning Permits. This case has not yet proceeded to our County Court phase. Since this case has not progressed to the Violation status, no investigation fee is required. This complaint was from a private citizen. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied,the number of dogs shall be reduced to 8(eight)or fewer within 30(thirty)days.
