Box 758 Greeley, Colorado 80631 Dear Mr. Dunbar: Your concern as addressed to the State Highway Commission regarding Weld County's continuing participation in the Safer-Off-System (SOS) Program, is the subject of this letter. Federal regulations for the FY 1976 Off-System Roads (OS) Program provided that funds be made available to counties of each state on a fair and equitable basis for use on local roads in rural areas. The 1976 Federal-Aid Highway Act ammended the OS Program by establishing the SOS Program and funds were authorized for FY 1977 and 1978. This ammending legislation changed the regulations providing that funds are to be made available throughout each state on a fair and equitable basis with special emphasis on low-cost projects which contribute significantly to the safety of the traveling public. The requirement that the funds be used only in rural areas was dropped from the SOS Program. Therefnre_ local city streets in urban areas are eligible fox funding With these changes in Federal regulations, the Special Highway Committee developed a statewide priority list of improvement projects for Colorado's FY 1977 SOS apportionment. The Committee selected projects based upon the information furnished by local authorities on their application forms. Special emphasis was given to project applications documenting safety benefits. Geographical distri- butions were also considered. The Department of Highways has discussed with the Committee's staff the distribu- tion of project application forms. We were advised that their intent was to mail all information to all counties and cities within the state. It is the concern of the Colorado Department of Highways that complete distribution of program informa- tion be provided for all entities thereby ensuring that federal regulations are complied with. 780736 <« o a Ed Dunbar Page 2 February 15, 1978 I am sending your letter together with a copy of this letter to the Special Highway Committee. The Department is advising the Committee that an explanation of the project selec- tion process be sent to all entities submitting applications for 1978 SOS Projects. This explanation is to include: 1) All projects submitted; 2) Those projects submitted for funding, and 3) Those projects which were not selected with a brief explanatory reason.
