The small station will consist of a compressor engine with related equipment and buildings on a 200' X 200' site in the NE/SE Section 1; T9N R60W. The compressor station is needed to maintain pipeline operational pressures to transport natural gas to the national energy market via Sterling's existing and proposed pipeline system. The formal USR application is currently undergoing Weld County review and approval. However, Sterling anticipates the need to begin construction of the proposed compressor station prior to issuance of Weld County Planning Department approval. Sterling intends to follow all necessary and prudent requirements of the County Planning Department and other county agencies during construction. Construction start prior to formal approval is needed to ensure that the pipeline system is operational as soon as possible upon formal County approval. Delays to system operation could cost Sterling, the County, the producers, and the mineral right holder's substantial revenues if the pipeline system is not available to transport additional gas volumes. Lack of an operational gas transport system will require continued flaring of gas from completed wells. Further, Sterling has secured a site lease agreement from the affected landowner. Therefore, this is Sterling's formal request that the permission to begin construction of the compressor station be granted while the project undergoes formal review. INTRODUCTION As exploration and production (E&P) companies continue to drill for oil and natural gas,there is a need for the infrastructure to gather, process and distribute the natural gas liquids and natural gas. Increased volumes,as well as the siting of recent drilling facilities, have put a strain on the currently available gathering and processing systems. To respond to the need for increased transportation capacity, Sterling Energy Investments LLC("Sterling") is proposing to construct,own, and operate a compressor station (Grover Station) in Weld County, CO. The station will service a proposed 10-inch gas pipeline that is currently undergoing the USR review and approval process as well. USE BY SPECIAL REVIEW QUESTIONNAIRE The following sections address the requirements of the Use by Special Review (USR) Questionnaire. A copy of the USR Permit Application Form and Questionnaire Checklist are included in Appendix A. The Non-1041 Application is provided in Appendix B. A. PROPOSED USE OF THE PROPERTY Sterling Energy Investments LLC(Sterling) proposes to build the Grover Compressor Station,a natural gas fired compressor station southeast of Greeley,CO. A compressor station constantly pressurizes the pipeline system to maintain gas flow. The gas in the compressor station is pressurized by special compressor and engines. A schematic drawing showing equipment layout is provided in Appendix C. The proposed use is consistent with the comprehensive county plan to foster development of the natural resources of Weld County. Given the size of the property,only a small amount of pasture land would be affected. Those lands are listed as: NE/SE Section 1;T9N R60W A complete description of the Project is included in Section D of the Non-1041 Special Review Permit Application document(Appendix B). B. CONSISTENCY WITH WELD COUNTY CODE, CHAPTER 22 OF THE COMPREHENSIVE PLAN The Weld County Comprehensive Plan addresses goals and policies for agriculturally zoned properties, oil and gas deposits, as well as environmental pollutants that the compressor site may emit. The 1 Sterling Energy Investments LLC Grover Compressor USR Application Package Comprehensive Plan also addresses the presence of oil and gas deposits in the County and encourages the extraction of oil and gas resources that conserve the land and minimize the impact on surrounding land and the existing surrounding land uses. Oil and Gas Policy 2.8 within Chapter 22 of the Code further states: "Oil and gas activities should be planned to accommodate current and future subdivision activities to the extent such development can reasonably be anticipated". The proposed Project meets the objectives outlined in the Comprehensive Plan without changing the use of the land where it is built. C. CONSISTENCY WELD COUNTY CODE,CHAPTER 23 (ZONING) Pursuant to Section 23-3-20,oil and gas production facilities are allowed as a use by right in A (Agricultural)Zone Districts. The Project is located entirely within an Agricultural Zone District,and such zoning allows oil and gas support and service operation such as compressor stations. Any impacts to actively cultivated land by the Project will be temporary, and agricultural operations can return once the facility is operational. Section 22-2-10(D) emphasizes the extraction of natural resources as an important part of the economy of the County. Adding a compressor to this site contributes to the expansion of the county's industrial economic base by providing increased capacity to an essential function in the production of natural gas in the County. Oil and gas facilities are allowed as a use by right in the A(Agricultural) Zone District. However, oil and gas support and service operations such as a Compressor Site require the approval of a Use by Special Review Permit. D. CONSISTENCY WITH SURROUNDING LAND USES The proposed site is located in unincorporated Weld County in an Agricultural Zone District. The area surrounding the site is dry land pasture. The Project is consistent and compatible with the surrounding land uses as a use allowed by right under Weld County Code Section 23-3-20. In addition,any impacts from construction of the Project will be temporary,and agricultural operations can return once the facility is operational. The compression,treatment and processing of natural gas produced in Weld County is a necessary component of marketing this valuable resource. Providing the required treatment will not only foster the development of an important economic base but will also contribute to the convenience and general welfare of the residents of the County. The station contributes to the County's tax base with little or no adverse impact in terms of additional roads or other governmental expenditures E. PROJECT DETAILS 1. Number of people who will use this site. The site will be un-manned, but will usually be visited once per day by one or two employees. 2. Number of people proposed to be employed at this site. 2 Sterling Energy Investments LLC Grover Compressor USR Application Package Sterling does not anticipate that the Project will require any new permanent workforce. The site will be unmanned and visited by existing workforce routinely for up-keep and maintenance. 3. Hours of operation. The compressor station will operate 24 hours a day,7 days a week,365 days a year. 4.Type and number of structures to be erected (built) on this site. One compressor building with engine and compressor, one small measurement and controls building, one diesel fired backup generator, one slug catcher, one condensate tank, and one Connex storage container(see preliminary plot plan Appendix C) S.Type and number of animals,if any,to be on this site. There will be no animals associated with the Project site. 6. Kind of vehicles(type,size,weight)that will access this site and how often. There will be a one-ton pickup truck visiting the site once or twice a day. A bobtail trailer will access the site two to four times a month to haul condensate or water from the site. 7.Who will provide fire protection to the site? The La Salle or Platte Valley Fire District would be dispatched depending on the location of the emergency along at the compressor station site. The Project will not have a water source;therefore, water or other fire retardants would be transported to the station if necessary. 8.Water source on the property. During construction, bottled water will be provided for construction personnel. Water may also be used for dust suppression. If dust suppression is required,the water will come from a municipal water source,and will be transported by water truck to the area where dust control is needed. 9.Sewage disposal system on the property. During construction,the contractor will supply portable sewage disposal units. Post construction, a portable sewage disposal unit may be provided by Sterling. 10. If storage or warehousing is proposed,what type of items will be stored? 500 gallon tank for glycol;500 gallon tank for oil;500 gallon tank for methanol;400 barrel tank for condensate. Storage tanks will be above ground and placed within secondary containment structures. F. PROPOSED LANDSCAPING FOR THE SITE 3 Sterling Energy Investments LLC Grover Compressor USR Application Package During construction, all liquid and solid waste will be stored and removed for disposal according to applicable regulations.Temporary sewage disposal units will be placed in areas of active construction, and will be maintained regularly to prevent water or soil contamination.Any leaks from equipment or vehicles will be cleaned up in accordance with BMPs,and disposed of at appropriate disposal facilities. No wastes will be stored or stockpiled during operation of the Project. Other waste from the facility will include: • Used compressor lube oil • Lube oil or hydrocarbon liquid contaminated rags Used lube oil will be transported away from the site using certified transporters to approved disposal. Any spill reporting or remedial actions will be the responsibility of Sterling's Facility Spill Prevention, Containment, and Countermeasures Plan (SPCCP). III.ACCESS INFORMATION Since this is an unmanned facility the station will only need to be accessed for routine maintenance and inspection. Therefore Sterling plans to use the pipeline right of way to access the station, entering on to the ROW off of Weld County Road 111. IV.WATER SUPPLY See Section II.E.8 of this application.Water for consumption will be supplied by: Deep Rock Water Co. 2640 California St., Denver,CO 80205 (800) 695-2020 Water for dust suppression testing will come from a municipal water source. Sterling has a site lease agreement in place with Landowner (Appendix E). VII.AFFIDAVIT OF INTERESTED LAND OWNERS See Appendix E for the Land owner site lease agreement. VIII.CERTIFICATE OF CONVEYANCE Sterling has negotiated a long term lease with the surface owner. See Appendix E for certified certificate of conveyance. IX. EMERGENCY CONTACT See Appendix F for emergency contact information. X. INTERGOVERNMENTAL AGENCY(IGA) BOUNDARY STATEMENT The Project is not located within an IGA;therefore, a notice of inquiry is not required. XI. DRAINAGE REPORT Following construction of the Project,the land will be returned to its pre-construction contours, BMPs will be installed per Sterling's SWMP,and disturbed, non-stabilized areas will be seeded or left fallow according to landowner stipulations. Drainage patterns will not be altered;therefore,a drainage report is not required for the Project. Water drainage across the site is indicated on the site plot plan in Appendix C. XII.TRAFFIC STATEMENT During construction of the Project,vehicles will access the right-of-way from existing facilities,or via county roads that are adjacent to the right-of-way. Any additional traffic resulting from construction of the compressor station will be minor,and temporary.Sterling will apply for all required permits for roads crossed by the Project. Once the compressor station is operational, additional traffic will be limited to an occasional vehicle used for regular inspection and maintenance. Since the Project will not contribute to the altering of traffic patterns in Weld County,Sterling assumes that a traffic study is not required for this application. XIII.WASTE HANDLING PLAN 6 Sterling Energy Investments LLC Grover Compressor USR Application Package During construction,all liquid and solid waste will be stored and removed for disposal according to applicable regulations. Any leaks from equipment or vehicles will be cleaned up in accordance with BMPs,and disposed of at appropriate disposal facilities. Sterling has contracted with the following waste handler for haul-away services: Waste Management 18211 Iris Dr. Sterling, CO 80524 (970) 384-6300 Temporary sewage disposal units will be placed in areas of active construction,and will be maintained regularly to prevent water or soil contamination. See Section V of this application for the name and address of Sterling's sewage disposal contractor. XIV. DUST ABATEMENT PLAN During construction of the Project,water trucks will be used to maintain dust and fugitive particulate suppression. The Colorado Department of Public Health and Environment(CDPHE) requires an Air Pollution Emission Notice(APEN)to be filed for projects that disturb 25 or more acres of land. This site is less than one acre in size, but Sterling will file an APEN with the CDPHE for a standard air emissions permit prior to the start of construction. XV. FLOOD HAZARDS The project is not located in a Flood Zone area. Due to hydraulic considerations,the compressor station is optimally located at its current site. Because of the system hydraulics and the Landowner's willingness to lease the needed 200'X 200' site for the facility, no alternative compressor station site locations were pursued. 1 C.3. Construction equipment and vehicles will receive fuel from mobile fuel trucks as needed. Fuel trucks and construction equipment will be equipped with spill kits and fire extinguishers, and personnel will be trained in spill prevention,control,and countermeasures to mitigate any spills that may occur during refueling operations. Equipment and vehicles will not receive regular maintenance at the construction site. Any leaks from equipment or vehicles will be cleaned up in accordance with BMPs, and disposed of properly. There will be no bulk fuel storage at the site. The backup generator set will run on diesel fuel and a small tank for diesel will be associated with the generator. The Project consists of a compressor station site, including measurement, backup generation, and associated facilities which will pressurize a pipeline system. The compressor station will deliver rich natural gas recovered from the Niobrara formation to existing delivery facilities. The location of the proposed compressor station is in the NE/SE of Section 1 in Township 9 North, Range 60 West, 6th P.M., Weld County, CO. The facility site and equipment layout is in Appendix B of the application. The site will be unmanned and approximately 1 acre or less in size. Onsite equipment includes the following: • A compressor building containing a 1200 horse power compressor engine • A small measurement building • Two 500 gallon tanks for methanol and glycol (above ground) 2 • A diesel fired backup generator and 500 gallon diesel fuel tank(above ground) • Piping for two pig launcher/receivers and slug catcher vessel • A 400 bbl condensate tank • A 200 bbl skid drain tank • One Connex storage container • All appropriate metering needed to account for the station gas flows. • A small air compressor and receiver system to be used to power pneumatically-driven control valves and the ESD system. It will also be used to start the compressor The site has been designed with the provision for an additional engine and condensate tank if needed in the future. D.2.A complete analysis of the alternative routes or sites considered,to include in each case: N/A D.2.a. Reasons for consideration N/A D.2.b.Types of agricultural land and other land use affected The site is located in AG zoned lands currently used as dry land pasture. D.2.c.Construction cost of the proposed alternatives The anticipated cost of construction of the Compressor is approximately$2 MM. D.2.d.Impacts on mineral resources Sterling anticipates little impact to mineral resources. D.2.e. Impacts on wildlife habitat Land use at the selected route is dry land pasture. No wetlands or sensitive environmental areas are proximal to the site. No trees,shrubs,or non-grass vegetation will been impacted. Once construction is complete,the area surrounding the compressor station outside the fence boundaries will be restored to pre-construction conditions,thus allowing any wildlife use that was temporarily displaced during construction to return. D.2.f. Impacts on historical,archaeological,and scenic resources Sterling does not anticipate encountering undiscovered historical or archaeological artifacts. If artifacts are discovered during construction,Sterling will alert the appropriate authorities to determine the best method for protecting the finds. 3 D.2.g.Visual impacts created by aboveground facilities The facility is less than one acre and will have a minimal effect on the land or horizon. Additionally the building and above ground structures will be painted to match the landscape. Sterling employs highly trained operators and contractors and maintains close working relationships with all emergency response personnel. D.8.A description of emergency procedures to be followed in case of a reported failure or accident involving the proposed facility. Sterling maintains a monitoring system that includes a gas control center that tracks pressures,flows, and deliveries on its entire system.The gas control center is staffed 8 hours a day, 7 days a week, 365 days a year. Automated alarms and callout systems are utilized during un-manned hours. Operators are on-call 24 hours per day,7 days a week,365 days per year. Sterling will install and maintain a remote automation system for this compressor station. The station will be available for remote shutdown if required. Normal compressor system shutdowns will monitor the site on a 24-hour basis and will automatically shut down and isolate the compressor station when needed. Sterling also staffs area offices near the compressor station site with personnel who can provide the appropriate response to emergency situations and direct safety operations as necessary. D.9.A description of the method or procedures to be employed to avoid or minimize the impacts on irrigated agricultural land. No irrigated agricultural lands are affected by the proposed compressor station site location. . D.10.A discussion of how the proposal conforms to the guidelines of Chapter 22 of this Code and any other applicable code provisions or ordinance in effect. All properties affected by the Project are located within an Agricultural Zone District. Article II, Division 4 of the Weld County Code permits oil and gas support and service facilities to be constructed in an Agricultural Zone District. As such,the Weld County Comprehensive Plan in Chapter 22 of the Weld County Code addresses goals and policies for agriculturally zoned properties and oil and gas deposit production. Section 22-5-90 of the Comprehensive Plan states:"The most efficient and environmentally friendly way to transport crude oil is by pipeline, rather than by truck. Transportation of the product by pipeline has less impact on County roads. Less truck traffic also benefits air quality in the area, another benefit that comes from more pipeline infrastructure". Oil and Gas Policy 2.8 within Chapter 22 of the Code further states: "Oil and gas activities should be planned to accommodate current and future subdivision activities to the extent such development can reasonably be anticipated". The proposed Project meets the objectives outlined in the Comprehensive Plan without changing the use of the land where it is built. Due to the small size of the site (i.e. 200'X 200'),the effect on any active agriculture will be temporary and isolated to the construction phase of the Project. Once the pipeline is operational,agricultural activities may resume surrounding the fenced area. 5 0.11.A discussion of the proposal for maintenance of the facility so as to prevent dust,soil erosion and the growth of noxious weeds. During construction of the Project,water trucks will be used for fugitive dust suppression along the right-of-way as necessary.Sterling will submit an Air Pollutant Emission Notice (APEN),Application for Construction Permit,and Fugitive Dust Control Plan for Land Development with the CDPHE, and will not commence construction of the Project until the required permits are obtained. Sterling and its contractors will follow the SWMP to prevent soil erosion during construction, and will install permanent BMPs and will gravel the site once construction is finished to encourage soil stabilization during operation of the Project. Graveling the site will also help to reduce the risk of noxious weed infestation.Should noxious weeds be identified on the ROW, Sterling will implement control measures. D.12.A drainage report outlining the method of preventing surface runoff from exceeding the historical flow. During construction of the Project, BMPs will be installed in accordance with the SWMP to prevent surface water runoff from eroding soils and exceeding the historical flow.After construction,during operation of the Project,the surface will have been returned to preconstruction contours, and permeability will not change. Surface runoff is expected to remain identical to historical flow, and Sterling will install a water quality control structure to help control run off from the historical flows. For these reasons, no drainage report was developed for the Project. D.13.A Decommissioning Plan.Adequate financial assurance to cover the decommissioning of the facility may be required as a condition of approval of the Decommissioning Plan.
