Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Heidi Hansen Health Department representative, Mary Evett The following business was transacted: I hereby certify that pursuant to a notice dated November 27, 2012, and duly published November 30, 2012, in the Greeley Tribune, a public hearing was conducted to consider the request of Steven and Teresa Wells/VVells Ranch, c/o Noble Energy/Wattenberg Holding, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0057, for a Mineral Resource Development Facility, including an Oil and Gas Support and Storage Facility (oil and gas central processing facility, along with an oil storage facility, tank and pipeline storage and future water recycling) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. e Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated Condition of Approval #1.1 has been met by the submittal of the Partial Assignment of Surface Lease, marked Exhibit D. He stated the subject site will be contained to the lot created through Subdivision Exemption, SUBX12-0019, which is to be recorded in the near future, and the Resolution for this case will need to reflect the updated legal description. He displayed a vicinity map and reviewed surrounding land uses and referral responses. He entered the favorable recommendation of the Planning Commission into the record as written and displayed photographs of the site and surrounding area. rivu 2012-3419 /- Ii-13 PL2192 HEARING CERTIFICATION - STEVEN AND TERESA WELLS/WELLS RANCH, CIO NOBLE ENERGY/WATTENBERG HOLDING, LLC (USR12-0057) PAGE 2 El Heidi Hansen, Department of Public Works, provided a brief overview of the roadway classifications, transportation plans, improvements requirements prior to construction, Final Drainage Report, and Grading Permit. El Mary Evett, Department of Public Health and Environment, reviewed the water and sewer provisions (portable toilets and bottled water), Waste Handling and Dust Abatement Plans, APEN, and Spill Plan. To be consistent with a previously discussed case, she stated Condition of Approval #1.E may be moved to become a new Condition #7.A, under"Prior to the Certificate of Occupancy." Ms. Evett indicated Condition #1.D has been met, and Condition #1.C could be deleted, since it is addressed in Condition of Approval #6.D. Fl Julie Cozad, Tetra Tech, represented the applicant and submitted a copy of her PowerPoint presentation, marked Exhibit E. She stated this will be an unmanned facility and its primary purpose is to pipe oil and gas to market and reduce the truck traffic by 18,000 trips per day. She also requested Development Standard #3 be increased from two (2) to four (4) employees. Fl No public testimony was offered concerning this matter. Chair Conway reviewed the discussed revisions, and Commissioner Rademacher proposed a change to Development Standard #21 to replace the word "shall" with "may". Mr. Yatabe stated the co-applicant's name should also be revised to replace "SemGroup" with "Wattenberg Holding, LLC" throughout the documents. In response to Chair Conway, Ms. Cozad stated she and the applicants have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed and modified. Fl Commissioner Long moved to approve the request of Steven and Teresa Wells/VVells Ranch, c/o Noble Energy/Wattenberg Holding, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0057, for a Mineral Resource Development Facility, including an Oil and Gas Support and Storage Facility (oil and gas central processing facility, along with an oil storage facility, tank and pipeline storage and future water recycling) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting Condition of Approval #1.C, deleting and moving the language from Condition of Approval #1.E to become a new Condition of Approval #7.A, "Prior to the Certificate of Occupancy", amending Development Standard #3 to increase the number of employees from "two (2)" to "four (4)", and modifying Development Standard #21 to replace the word "shall" with "may". The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
