WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners of Weld County, Colorado held a public hearing on the 30th day of April, 1979 at the hour of 9 :00 o'clock a.m. for the purpose of hearing the application of W.R.E.N. Broadcasting Company for the granting of a Conditional Use Permit for KIIX Radio Transmission Towers on the following described real estate, to-wit: The Southeast Quarter of Section 18, Town- ship 7 North, Range 67 West of the Sixth P.M. , Weld County, Colorado, being more particularly described as follows : Considering the South line of said Southeast Quarter as bearing South 86°47 ' 57" West and with all bearings contained herein relative thereto is contained within the boundary lines which begin at the Southeast Corner of said Section 18 and run thence South 86°47 ' 57" West 2411. 60 feet to the South Quarter corner of said Section 18 ; thence North 00°10 '21" , East 2635. 02 feet to the Center Quarter corner of said Section 18 ; thence North 86°42 '28" East 2421. 72 feet to the East Quarter Corner of said Section 18 ; thence South 00°23 '12" West 2639 .48 feet to the point of beginning. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for KIIX Radio Transmission Towers , and WHEREAS„ Section 3 . 3 .D. of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon the granting of a Conditional Use Permit by the Board of County Com- missioners , and WHEREAS , the Board of County Commissioners of Weld County, Colorado heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations f) %(i// L/ 7Z/g 790459 Z'rldO.3 i I of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permit for KIIX Radio Transmission Towers on the hereinabove described real estate complies with all of the conditions as set out in Section 3. 3 .D. (2) of the Weld County Zoning Resolu- tion. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of W.R.E.N. Broadcasting Company for KIIX Radio Transmission Towers on the hereinabove decribed tract of land be,;,arid hereby is, granted subject to the development standards contained in the Conditional Use Permit. NWl-NW$, Section 2 , T1N, R67W LOCATION: Southeast of the_ intersection of County Roads 21 and 14 APPEARANCE: Steve Theede, Assistant District Manager - Cheyenne DISCUSSION: Mr. Theede first gave a brief description of why Continental Pipeline Company is doing business in Weld County. This primarily being gathering crude oil from producing wells. The crude is gathered into a main station at Fort Lupton and injected into the main line system that moves south to Denver to serve refineries in that area. Part of this total system encompasses two locations. One at the location applied for in this request and the other at U.S. Highway 85 and County Road 18i, Planning CommissioL linutes Page 2 April 17, 1979 • being Spindle A and Spindle B . respectively . The proposed use for this -' =_ - amendment is- for ac-.crude-=oil=-truck-unloading-facility and-transfer - _ facility to receipt pipeline gathered crude into the facility for subsequent delivery, by pipeline, to Continental Pipeline' s Fort Lupton station. This will increase the accuracy of measuring receipt volumes from truck transports and reduce truck traffic. Discussion followed regarding the truck traffic. Tom Honn then read the staff ' s - - -recommendation- for approval=of= the request -and the Development Standards. The Chairman then asked Frank Suckla and Percy Hiatt for their comments on their site review of the proposal . Mr. Suckla stated that he feels the existing facilities are too close to the road and too close to the farm buildings. Mr. Hiatt stated he felt the same as Mr. Suckla and does not want to. see the facility enlarged any more closer to the -n-- ------eurrounding'--property owners,—being -the--Berger' s.- Chairman-Carlson--then asked for comments from the audience . At this time Jack Berger, Jr. • expressed his opposition to the facility as he feels that it is a safety hazard and does not want the facility enlarged for this reason. He distributed pictures of a spill of the facility. He also stated that trucks are operating 24 hours a day and the circular area is not paved. - -- -Jack- Berger, Sr. stated- he-felt -the same way . He has -no -objection if they move it farther awaay. Chairman Carlson then asked John Hall of the Weld County Health Department for his comments. regarding this . Mr. Hall at this time stated that at the Spindle B site there was oil on the ramp where the trucks unloaded. The oil was being transported on the truck tires and then onto the road. He also stated that he did some noise flebel--testing-at'both--sites -and-the-noise-level -was -too high--when -- - the trucks were running and unloading. When they left the level was alright . Mr. Gilbert then asked if the area was in fact paved as stipulated in the permit . Mr. Theede stated that a concrete drive was put in because asphalt deteriorates . MOTION: Be it therefore resolved to table the request until the Planning Commission meeting- on May- 1, 1979 for further -research by the Planning Staff as to whether they have in fact met the commitments that were made in the original Special Use Permit ; further informationon the capacity of the bermed area if an additional 1,000 barrel storage is added. There are no water rights with this property and no irrigation water. The topography of the land has not allowed this ��property -to--be' farmed; -so =this is-only-native grass-----Some--discussion-- , - followed regarding the small pond that will be developed in the existing drainage area. Tom Honn and the Planning Staff were unable to make a recommendation regarding this request . Mrs . Kerbs, surrounding property ' Planning Commissio ' linutes Page 4 April 17, 1979 owner, stated that the only thing she is concerned about is that a provision should be made for damage to property if the pond should -wash out . -Jim Gilbert -stated that heh-ad site reviewed the property and feels that this is an excellent concept and a very natural and compatible use for the property. Also that it would be the highest and best use of the property. Mrs. Kountz asked if the applicant was aware of the snow-making machines that could create noise at the Sharkstooth Ski area. Mr. Moore said he was aware of this . • -MOTION: Be it therefore resolved to recommend approval -to the Board of County Commissioners because it is an extremely compatible use for this piece of ground in that the Planned Unit Development will only disturb 15 acres of property and because it is the highest and best use for this piece of ground. The towers will not prevent future farming. Ben Nix then asked why four towers are needed. Ihor Sulyma then explained that the towers are used to control the amount and direction of the signals to provide coverage and to meet requirements as set down by the FCC. Tom Honn then read the staff ' s recommendation for approval and the Development Standards . Chairman Carlson then asked for any comments f om persons in the audience . At this time Bob Ray, in representing Julius and Annabell Lindquist , expressed their opposition to the request . Wi bur Schild also expressed his opposition as he feels his property will be devaluated and he has towers surrounding his property now. Mr. Nix th n asked why this particular site was chosen . Mr. Metcalf responded that they had looked for several months and this site was the only one whic would be the least affected as regards agricultural ground. _ _MOTION: Be it therefore resolved to recommend denial for the following S, reasons : 1) Just because the water has been sold off the farm does not remove the designation of prime agricultural ground; 2) Concern with the number of towers that are going to go into that area that are proposed now, that are existing now, that are proposed and will: be proposed in the future; 3) In this type of request the neighbors feel 'ngs _ have _tobe strongly considered in any recommendation_ the Planning Commission makes. Motion carried. • CONSIDERATION OF LOCHBUIE SEWAGE DISPOSAL SYSTEM: Tom Honn stated that this item represents '_ a request by the Town of Lochbuie for approval for sewage collection facilities . A Special Use Permit was issued in 1973 which allowed for the location and eventual construction of the sewage treatment facility located northeast of the community. The staff does recommend approval of this request to the - Planning_ Commission . " This determination is based, in part, upon the following: A. It is the opinion of the Department of Planning Services staff that the applicant has demonstrated the need for the proposed site in their letter dated April 13 , 1979 . The Colorado Geological Survey has no objections provided subsurface conditions in excavations be evaluated by qualified personnel to determine if adverse soil conditions are present and to assure proper foundation design. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The attached Development Standards being recommended and approved for the Conditional Use Permit. 2. No building or electrical permits shall be- issued on the Conditional Use Permit area until the Development Standards for the Conditional Use Permit have been placed on the Conditional Use Permit plat and said plat has been delivered to the office of the Department of Planning Services . W.R.E.N. BROADCASTING COMPANY - CUP DEVELOPMENT STANDARDS 1. The permitted uses on the hereon described parcel of land shall be a radio broadcasting system and shall be limited to the facilities shown including 5 radio transmission towers and a control building (16' x 28 ' ) and all other uses permitted by right under Section 3 .3B of the Weld County Zoning Resolution. 2. Installation of the radio transmission towers shall conform to Federal Aviation Administration standards and/or regulations regarding air safety and lighting and any other applicable rules and regulations of governmental bodies having jurisdiction on the premises . 3 . The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds . 4. Upon termination of construction, all disturbed soils areas shall be revegetated or gravelled to reduce susceptibility to soil erosion. 5. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems . 6. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be :constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 7 . All construction, electrical work and fabrication shall be done in accordance with the Weld County Building Code. 8 . The appearance of the facility shall be maintained in a .neat and orderly condition through periodic painting and maintenance. 9. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Conditional Use Permit by the Planning Commission and Board of County Commissioners before such changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . Comments : 1. The Federal Communications Commission and the Federal Aviation Administration did not respond to the referrals sent to them. The specific site in the request for zoning is the parcel of property located at the SE* of Section 18 T7N R67W, Weld County, Colorado. (FCC) A Radio station is a Federal Communications Commission/licensed broadcast facility which provides service in the form of aural transmission to a large area using the technology of electromagnetic wave propagation. Because, the facility is licensed by the FCC it must conform to their •I rules and regulations in all aspects. As these rules and regulations pertain to technical operation, the FCC has set down certain criteria for a broadcast facility in providing a necessary coverage as well as protection to other existing broadcast stations. In order to better understand the operation of a broadcast facility, visualize this analogy: The signal being broadcast from a radio station, if it could be seen , would have the shape of that of a balloon filled with water and placed on the floor. This configuration would be called "omni- directional" in that the radiated signal emitted from one tower (the stem of the baloon fixed to the floor) would characteristically spread out in all directions. This is the most simple operation for an AM broadcast station. Using the technology of electro-magnetic wave engineering, it is possible to change the shape of the radiated signal by using additional towers. Referring once again to our water-filled balloon , if one was to place a pencil along side the balloon and press It toward the balloon, the shape would change so that in certain directions the balloon would bulge out and in other directions would be supressed. It is impolrtaiit to note that the stem of the balloon is fixed to the floor and cannot move. This stem can be referred to as a "reference"tower• and the pencil can be referred to as a "control" tower. It can easily be pictured that by varying the •location Weld County pg 2 of the control tower with respect to- the reference tower, numerous shapes of the pattern can be achieved. The FCC, in very definite rules, places stringent requirements with regard to the quality of the signal which must be provided over the primary licensed city as well as the suppression of signal to meet protection requirements of co- and/or adjacent channel stations. With respect to the KIIX facility in Fort Collins, the stations which require protection are as follows: KCSJ, Pueblo CO KSJB, Jamestown ND KCSR, Chadron NE KNOW, Denver CO. As can be seen, the station directions from Fort Collins in which protection must be provided are northeast, east and south. Therefore, going back to our water-filled balloon, let's put sharp pointed needles in the directions where protection must be provided. Now we take our control tower and vary the shape of the balloon so as not to be pricked by any of these needles. In the case of KIIX it requires a four-tower arrangement in a particular manner so that the protection requirements in the correct directions are met. Such 2 configuration results in one large signal lobe directed from due west to almost due north. This pattern is achieved using a four-tower directional antenna system with the spacing and orientations of the towers with respect to one another being that in the shape of a parallelogram. Full engineering details with regard to the protection requirements necessary, and proposed operation of the four-tower antenna system have been submitted to the FCC in the WREN Broadcasting Company' s application for construction permit dated 16 March 1978. THis application for CP is on file and readily available to the public from the FCC as well as the public file of the broadcast facility, KIIX. • Because of the shape of this directional antenna pattern, it was necessary to locate a transmitting site east and slightly south of Fort Collins. In addition to a directional daytime pperation, KIIX Radio is planning a directional nighttime operation which has more stringent protection and coverage requirements. It is best to utilize the same transmitting site for both operations therefor a transmitter site location becomes extremely critical so as to be able to meet the necessary FCC requi4rements. = Weld County page 3 t . In the case of KIIX radio the transmitter location site was confined to an area of approximately 6 square 'miles measuring 2miles north and south, and 3 'miles east .and west. The proposed transmitter site located almost in the center of the northern boundary of the area. I It is imperative that the transmitter site for any AM broadcast installation be comparatively level in nature and free of obstacles which would impair its operation. Such obstacles as- irrigation ditches, creeks, sharply disruptances in elevation (ravines, cliffs , etc) . Therefore, in addition for the KIIX facility to be located in the relatively limited area, the area that it could be located in must be comparatively level . The gperation of a broadcast facility is m non-polutingpe vvironmentally clean. The land which the facility is located upon can be 'used for either planting or grazing. There is no affect on the land f immediately adjacent to the transmitter site by the operation of the facility. ' Nor does the operation of the facility affect the development of the land adjacent to it in any way. As can be seen around numerous broadcast installations, home developements have been constructed. And because 'of the extremely low frequency, there has never been a question of health or safety hazard by the operation of the facility to the surrounding areas. It is, of course, understood that if anyone should happen to brush up against one of these towers during its operation, then of course it would be comparable to placing one's hand on a hot frying pan. However, and because of stringent FCC requirements, these towers are enclosed in an an'dT.w 4,P,4 appropriate fenceiland locked.aad• constructed in a manner so as to discourage entrance. Add-i-t-Fena-1-}y The location for the guy anchors are similarly enclosed to both provide protection for the tower and as well as for the health and safely of animals and/or people. Compatability of this operation with the surrounding terrain is a difficult subject to speak to. When the surrounding terrain consists of flat, level land four 360' towers do not seem compatible. On the northern boundery of the property the poles cxi-sts of420 foot square,,taperediself supporting structure approx. 115' high. Across the western boundery there exists numerous poles which are self-supporting awi taperedJtubular type which range from a 4 'to 5 foot diameter at the base to approx. 1 foot diameter at the top' 124' High. These tubular poles are solid. Both types of poles are painted gray in color. The towers are uniform cross-section and ere guyed. There are constructed in a triangular shape, using three poles ( each leg of the - triangle) which are approx. two inches in diameter. The poles are then interlaced with i I 4" diameter structural supports so as to give strength the higher the tower goes. The overall width of a face is approx. 2' . The overall structure is held in place with guyes r lay to /fri,, (steel cables) which are normally 3/8" in diame r. As compared to the ia-1 =, .off diameter transmission line cables of the power poles. 41. From an engineering point of view, if it is possible to string a pieces of #10 copper r" wire 360' tall this would be sufficeint as a radiating elementsfor a direction antenna. r i.� However, MUNKIND0 NXX*X_ mechanically such a configuration is not possible with our i, present state of the art in mechanical en ineerin 9� g,�herefore, this type of tower is necessary. It is immaterial to the operation of the broadcast facility what color the tower is painted. l ` However, the Federal Aviation Administration has a Health and Safety factor that requires ‘ t Weld County page 6 • that the towers be painted international orange and white so as to discourage low flying turkeys a�*'� their ,during daytime flying. At night the FAA requires that the tops of these towers have a flashing beacon again also to warn pilots of their location and height. Se from an engineering point of view, the elimination _g of -8 lighting would be better for the operation of the system. The FCC, in very definite rules, places stringent requirements with regard to the quality of the signal which must be provided over the primary licensed city as well as the suppression of signal to meet protection requirements of adjacent and co-channel stations. With respect to the KIIX facility in Fort Collins, the stations which require protection are as follows: KCSJ, Pueblo CO KSJB, Jamestown ND KCSR, Chadron NE KNOW, Denver CO. It can be seen that the station directions from Fort Collins where protection must be provided are northeast, east and south. Therefor, going back to our water-filled balloon, let's put sharp pointed needles in the directions where protection must be provided. Now we take our control towers (we' ll need more than one) and vary the shape of the balloon so as not to be pricked by any of these needles. In the case of KIIX it requires a four-tower arrangement in a particular manner so that the protection requirements in the correct directions are met. Such a configuration results in one large signal lobe directed from due west to almost due north. This pattern is achieved using a four- tower directional antenna system with the spacing and orientation of the towers with respect to one another, being that of a parallelogram. Full engineering details with regard to the protection requirements necessary, and the proposed operation of the four-tower antenna system have been submitted to the FCC in the WREN Broadcasting Company's Application for Construction Permit dated 16 March 1978. This Application for CP is on file and readily available to the public from the FCC as well as the public file of radio station KIIX. Because of the shape of this directional antenna pattern, it was necessary to locate a transmitting site east and slightly south of Fort Collins. In addition to a directional daytime operation, KIIX Radio is planning a *directional nighttime operation which has more stringent protection and coverage requirements. It is best to utilize the same transmitting site for both operations, therefore a transmitter site location becomes extremely critical in order to meet the necessary FCC requirements. In the case of KIIX radio, the transmitter location is confined to an area of approximately 6 square miles measuring 2 miles north and south, and 3 miles east and west. Therefore, in addition to the KIIX facility having to be located in a relatively limited area, the actual position within that area where it can be located must be comparatively level . The operation of a broadcast facility is non-poluting and environmentally clean. The land which the facility is located upon can be used for either planting or grazing. There is no affect on the land immediately adjacent to the transmitter site by the operation of the facility. Nor does the operation of the facility affect the development of the surrounding land in any way. There have been home developments around numerous broadcast installations around the country. And because of the extremely low frequency, there has never been a question of health or safety hazard from the operation of the facility. It is understood, of course, that if any- one should happen to brush up against one of these towers during its operation, the result would be comparable to placing one's hand on a hot frying pan. However, and because of stringent FCC requirements, these towers are enclosed by a fence, constructed to discourage entrance, and locked. The location for the guy anchors are similarly fenced in to provide protection to the tower as well as for the health and safety of animals and people. Compatibility of this operation with the surrounding terrain is a more difficult subject to speak to. When the surrounding terrain consists of flat, level land four 360' towers do not seem compatible. But then again, a 4-lane wide, 200-foot long bridge over a 400' deep gorge is also not compatible with the surrounding terrain, but is extremely necessary for its purpose. The area for miles around the proposed transmitter site is agricultural in nature (at this date) and would not be disrupted by the operation of the facility, and the population is so slight that minimum impact with regard to esthetics for maximum amount of people is evident. With regard to esthetics, it must be pointed out that there are already several poles and towers in the area. Running along the northern and western boundaries of the proposed transmitter site is the Platte River Power Authority transmission line. This transmission line consists of two types of poles across which transmission power cable are suspended. On the northern boundary of the property these poles consist of a 20-foot square, tapered, self supporting structure approximately 115' high. These poles are four-sided and are constructed using 7" wide "L" beams criss- crossing numerous times for support and strength. Across the western boundary are many poles which are self-supporting, tapered tubular types which range from 4 to 5 feet in diameter at the base to about 1 foot in diameter at the top, 124 feet high. These tubular poles are solid. Both types of poles are painted gray in color. And about 1f miles due north there is a Mountain Bell microwave relay point for communications transmission. The four towers proposed by WREN Broadcasting Company will be arranged in a parallelogram. Each tower will be an open triangular shape approx- imately 24 inches across each face, of uniform cross-section (not tapered) , and constructed of legs of about 2" poles interlaced with ₹" supports for strength as the tower rises higher. Each overall structure is held in place by guys of 3/8" steel cable (compare to the 1" to 1i" diameter transmission line cables already on the existing power poles) . From an engineering point of view, if it were possible to string 4 pieces of 1/10 copper wire 360' high this would be sufficient for the radiating elements of a directional antenna system. However, such a structure is not possible at our present state of art in mechanical engineering. Therefore, this type of tower is necessary. It is immaterial to the operation of the broadcast facility what color the towers are painted. However, the Federal Aviation Administration has a Health and Safety factor that requires that the towers be painted international orange and white to discourage any low flying during daytime hours. At night the FAA requires that the tops of these towers have a flashing beacon (red) also to warn pilots of their location and height. From an engineering point of view, the elimination of the lighting would be better for the operation of the system. Unfortunately we must have the lighting because of FAA requirements. We have tried to present the need for the operation of this broadcast facility from this particular transmitting site in the most simple and basic terms to be readily understandable to laymen. Actually the operation of the broadcast facility is a very complicated and sophisticated system. Full details of its operation, technical design considerations, protection and coverage requirements , and other pertinent details are available in the Application for Construction Permit. I As indicated by the accompanying' location map, the proposed construction will take place on soil types (X53-B) Kim loam, 1 to 3 percent slopes, (X53-C) Kim loam, 3 to 5 percent slopes and (41-B) Weld loam, 1 to 3 percent slopes. . I All three soil types are deep and well ,drained with moderate to slow permea- bility. All exhibit a low load support characteristic which may require special structural 'design for the intended use. The Weld loam soil also exhibits a shrink-swell potential in the subsoil which may require special design for construction purposes. These soils should be evaluated by a competent. soil engineer to determine proper design and construction requirements for the individual sites. Soil descriptions for the other soil types found in the SE4 of section 18, Twp. 7N, Range 67W are included for your information. I did not comment on the characteristics of these soils for planned activity as it does not appear they will be involved.
