RESOLUTION RE: ACTION OF THE BOARD CONCERNING SUSPENSION / REVOCATION OF COLORADO RETAIL FOOD ESTABLISHMENT LICENSE - CULVER'S RESTAURANT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Culver's Restaurant, located at 3502 29th Street, Greeley, Colorado, is allegedly in violation of the Colorado Retail Food Establishment Rules and Regulations, and WHEREAS, on January 16, 2012, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violations at the facility owned by Joe Gibbons, who was represented by Eric Powers, General Manager, and WHEREAS, after hearing testimony from all present, the Board of County Commissioners deemed it advisable to accept the plan of correction submitted by the ownership and management of Culver's Restaurant and to assess the $750.00 civil penalty, with the understanding that if the facility does not comply with the items contained within the plan of correction through the next follow-up inspection, as well as the next regular inspection, another hearing may be scheduled with the Board of Commissioners to consider suspension or revocation of said license, and WHEREAS,after said hearing on January 16, 2012, violations continued to be observed by the Department of Public Health and Environment at its inspections; therefore, staff brought the matter back to the Board's attention for action, and WHEREAS, after hearing testimony from all present on March 12, 2012,the Board of County Commissioners deemed it advisable to hold the suspension in abeyance, continue the matter to March 26, 2012, at 9:00 a.m., accept the civil penalty in the amount of$1,000.00, and to require a certification of the Weld Star training and the daily submittal of temperature logs to staff, and WHEREAS,after hearing testimony from all present on March 26,2012,the Board of County Commissioners deemed it advisable to hold the suspension in abeyance and continue the matter to May 2, 2012, at 9:00 a.m.,with the condition that all of the staff complete their training by 5:00 p.m., on March 30, 2012, or be brought back before the Board for suspension. During this time the Department was to conduct two additional inspections. The Department conducted two additional inspections on July 11,2012, and July 24, 2012. During those two inspections, five critical violations were cited. Four of these violations have been cited previously at the facility, and of these four, three were discussed specifically at an informal training held on February 22, 2012, at the facility (labeling of spray bottles, stocking of soap and paper towels, storage of personal drinks). Recommendation: The Department is of the opinion that the facility has had all opportunity to achieve compliance with the Colorado Retail Food Establishment Rules and Regulations (see attached time line), but has failed to achieve consistent compliance with those Rule and Regulations. Therefore,the Department is recommending that the facility's Retail Food Establishment license be suspended for a minimum of two days during which time the facility has an outside entity (3` party) perform onsite training on all food safety risk factors,with an emphasis on those violations noted since the beginning of 2012. The Department recommends the facility not be allowed to reopen until outside training has been provided. 2012-2020 Culver's Time Line July 12,2011 to July 2012 July 12 2011 to Six inspections of the facility were conducted where violations of 3e (improper October 7 2011 cold holding of potentially hazardous food-$500.00 civil penalty assessed), lb (moldy food), 5b (no water available at hand sinks-$250.00 civil penalty assessed) and 8b (unlabeled spray bottles)were cited which lead to the Department meeting with facility ownership for a non-compliance intervention meeting. October 26, 2011 The non-compliance intervention meeting was held with Joe Gibbons(owner) and Eric Powers(manager)where violations previously noted at the facility (with focus on improper cold holding temperatures) and the civil penalty enforcement process was discussed. December 7, 2011 A follow-up inspection of the facility was conducted where violation 3e (improper cold holding of potentially hazardous food)was cited. January 16, 2012 The 1" Board of County Commissioners(BOCC) suspension/revocations hearing was held. • The owner submitted a plan of correction which the BOCC and the Weld County Department of Public Health and Environment (Department) agree to. • Facility directed to pay the assessed $750.00 civil penalty. February 2, 2012 As part of the Plan of Correction, Dan Joseph visited the facility and discusses key issues/violations with staff and provides an opportunity for questions. February 17, 2012 A follow-up inspection of the facility was conducted where 3 critical violations were cited (one of those being improper cold holding of potentially hazardous food). March 12, 2012 A 2n° BOCC suspension/revocation hearing is held.The facility agrees to the following: • To pay the assessed $1,000.00 civil penalty. • To maintain daily temperature logs and submit those to the Department. • To have all staff attend Weld Star food safety training. March 21, 2012 Weld Star class was conducted where 19 staff members attend. March 22, 2012 A follow-up inspection is conducted where violation 3e (improper cold holding of potentially hazardous food)was cited. March 23, 2012 A 3r° BOCC suspension/revocation hearing is held. The facility submits a restructuring plan which includes: • To have all remaining staff obtain food safety training by March 30, 2012. • To replace the existing store manager. • To submit temperature logs for a month. • To receive another inspection of the facility within the month. April 24, 2012 A follow-up inspections of the facility was conducted where 3 critical violations were noted. May 2, 2012 A 4th BOCC suspension/revocation hearing was held. The Department recommended the following: • Suspension/revocation be held in abeyance for 3 additional months. • Two regular inspections to be conducted in that time period. July 11, 2012 First regular inspection of the facility was conducted where 2 critical violations were cited. July 24, 2012 Second regular inspection of the facility was conducted where 3 critical violations were cited. August 1, 2012 5th BOCC suspension/revocation hearing to be held. The plan required installing new management, additional training for all employees, and submission of temperature logs for the next month. As of April 27,2012, the facility has complied with the requirements of the plan of correction. Weld County Department of Public Health and Environment (the Department) staff agreed to perform an additional inspection in order to determine if the plan of correction was effective. We conducted our inspection on April 24, 2012, and did not find any of the violations that have been noted since July 2011. However, we did cite three new critical violations during that inspection: one of the faucets at the 3-compartment sink was nonfunctional, the dish machine was not sanitizing, and there was a dented can. Based on this information, the Department recommends that the suspension be held in abeyance for another three months and that two additional regular inspections be conducted during this time period. If the regular inspections yield additional critical violations among those that have previously been cited or if the facility does not remain in substantial compliance, the Department would request the ability to bring Culver's back to a hearing in front of the BOCC prior to the end of the three-month period. Note: The Colorado State Legislature recently voted to change 25-4-1609 Colorado Revised Statutes (C.R.S.)which allowed the health department to bring retail food establishments to a hearing in front of the Board of County Commissioners (BOCC) for options other than the assessment of three civil penalties within a calendar year. We no longer have that authority. The statutes now state that license suspension/revocation hearings may be held only after the assessment of three civil penalties within the prior 12-month period. The Weld County Department of Public Health and Environment (Department) has given the facility all opportunities to come into compliance as afforded to them in the Colorado Revised Statutes. Unfortunately, on March 22, 2012, our inspection staff again observed and cited an improper cold holding violation during the follow-up inspection that was done as one of the conditions set for continued operation during the March 12,2012, hearing with the Board of County Commissioners. The Department is awaiting a proposal with conditions and changes regarding the management of the store as well as future corrective actions prior to making a recommendation regarding resolution of this situation. The owner,Joe Gibbons,will arrive in Greeley on Sunday, March 25,2012,with a proposed agreement in hand.
