RE: APPROVE QUIT CLAIM DEED FOR POUDRE PONDS SECOND ANNEXATION AND
AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Quit Claim Deed from the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County,to the City
of Greeley for the Poudre Ponds Second Annexation, commencing upon full execution,with further
terms and conditions being as stated in said Quit Claim Deed; said property being described as the
W 1/2 of the NE 1/4 of Section 36, Township 6 North, Range 66 West of the 6th P.M.,Weld County,
Colorado, and
WHEREAS, after review, the Board deems it advisable to approve said Quit Claim Deed, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Quit Claim Deed between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, to the City of Greeley for the Poudre
Ponds Second Annexation be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said Quit Claim Deed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 2nd day of May, A.D., 2012.

QUIT CLAIM DEED
THIS DEED is made this ad/day of May, 2012, between County of Weld, State of Colorado, a
body politic and corporate of the State of Colorado, of the first part, and to the City of Greeley, a
municipal corporation of the State of Colorado, of the second part.
WITNESSETH, that the said party of the first part, for and in consideration of the sum
of one-dollar ($1.00), and other good and valuable consideration, to the said party of the first pan
in hand paid by the said party of the second part, the receipt whereof is hereby confessed and
acknowledged, has remised, released, sold, conveyed and QUIT CLAIMED, and by these
presents does remise, release, sell, convey and QUIT CLAIM unto the said party of the second
part, its heirs, successors and assigns, forever, all the right, title, interest, claim and demand
which the said party of the first part has in and to the following described lots or parcels of land
situate, lying and being in the County of Weld and State of Colorado, to wit:
All of the real property that may have been conveyed to the party of the first part by quit
claim deed recorded in the Office of the Weld County Clerk and Recorder on May 10, 2005, at
Reception Number 3284723, with said property being thus conveyed being more fully described
in the attached Exhibits "A" and "B."
FURTHER IRREVOCABLY ASSIGNING all responsibility for maintenance of the
said real property that was required by the party of the first part in quit claim deed recorded in
the Office of the Weld County Clerk and Recorder on May 10, 2005, at Reception Number
3284723, from the party of the first part to the party of the second part.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances
and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right,
title, interest and claim whatsoever, of the said party of the first part, either in law or equity, to
the only proper use, benefit and behoof of the said party of the second part, heirs and assigns
forever.
IN WITNESS WHEREOF, the said party of the first part has hereunto set its hand and
seal the day and year first above written.

About 4 or 5 years ago there was a stretch of the Poudre River Trail that was deeded to Weld County in an area that was
intended to be annexed by the City of Greeley shortly thereafter. The idea was for the County to get the trail from the
developer and then deed it over to the City once that annexation was in progress. With the downturn in the economy,
the City annexation was not soon forthcoming. However, it is happening now. The City is in the process of doing the
Poudre Ponds 15`and 2n°Annexations. See the attached letter and attachments from the City. They have asked for the
BOCC to deed the trail to the City. See the attached QCD and descriptions. Note that the maintenance responsibilities
will transfer to the City with the execution of the QCD.
This matter is on the agenda for tomorrow, Wednesday, May 2, 2012. I recommend that the Board approve the QCD
and authorize the Chairman to sign.

Please find enclosed a copy of the Poudre Ponds l' and 2,d Annexation Impact Report. The applicants for the
proposed annexation are Double SM Farms, Cottonwood Land & Farms, LLC, City of Greeley and Weld
County. This document fulfills the statutory requirements pursuant to C.R.S. 31-12-108.5 of filing one copy
with the Board of County Commissioners governing the area proposed to he annexed.
The following is the City of Greeley schedule for processing this request.
April 17, 2012 City Council Ordinance Introduction
April 24, 2012 Planning Commission Public Hearing
May 15, 2012 City Council Public Hearing/Final Reading of Ordinance
