HomeMy WebLinkAbout20130329.tiff RE CE t eNED Minutes WELD COUNTY COUNCIL WELD December 17, 2012 OMMISSION COUNTY COMMIS_,IO JEH The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter, Monday, December 17, 2012, at the Weld County Administration Building, Greeley, CO. ROLL CALL: The meeting was called to order by President Charles Tucker and on roll call the following members were present, constituting a quorum of members thereof: Councilman Charles Tucker, President Councilwoman Perry Buck Councilman Don Mueller Councilwoman Marge Klein Also present: Sean Conway, Weld County Commissioner Chair, County Commissioner Doug Rademacher and Karleen Watson, Council Secretary. APPROVAL OF AGENDA: Councilman Mueller made a motion to approve the December 17, 2012 agenda. The motion was seconded by Councilwoman Klein and carried. APPROVAL OF MINUTES: Councilwoman Klein made a motion to approve the November 26, 2012 minutes. The motion was seconded by Councilman Mueller and carried. PROGRAM REVIEW: Sean Conway, Chair, Weld County Board of County Commissioners — 2012 Year in Review. Commissioner Conway and County Commissioner Doug Rademacher went over 2012 accomplishments including: --Fiscal conservatism: only County in the nation with no short-term debt, long-term debt or sales tax --Budget has $90 million contingency of which $32 million in rainy day fund. County valuation went up a one billion dollars in 2012 to 6.5 billion overall, higher than Larimer County --Received Outstanding Accounting Department award for the 30th year in a row --Transfer of Weld County Paramedic Services to NCMC in April. Result has been a $3.8 million benefit to county taxpayers --Opened four CNG Fueling Stations as part of the "Clean Energy Project. They are in Firestone, Greeley, Fort Lupton and Kersey. The governor is looking at Weld County as a model. --Updated County URL address to Weld.gov --Three new Department Heads named: Planning -- Tom Parko, General Services — Trevor Jiricek and Public Works — Dave Bauer 1 - i 2013-0329 1 — Weld County Council Minutes December 17.2012 Page 2 of 4 --NACO (National Association of County Organizations) Prescription Drug Program started. Members (have to be resident of Weld County) receive a discount right of the top of prescription drugs --Regional Crime Lab broke ground and is set to open next summer --WCDPHE free water testing available to residents due to oil and gas fracking concerns. They have received 84 water samples with no incidences of contamination. --City of Greeley approved a fourth POD for the jail that gives a ten-year window to be completed. County will try to keep putting this off as long as possible due to 24/7 staffing costs of $25,000 for one bed at the jail in terms of annual cost (aside from construction costs). --Completed Technology Assessment for the County for future purposes --Ending of Weld County Transportation Division which resulted in $250,000 savings to taxpayers --Completed Weld County Communication $5 million Tower Project --New Spillman Conversion completed. County's platform was one of oldest in the nation and if it went down it would have been catastrophic. Pertains to all public safety in Weld County. --Commissioner Conway attended the Chamber Retreat for the Greeley Chamber of Commerce which includes approximately 400 members. Membership Survey Results were given. Commissioner Conway addressed upgrades on county roads due to oil and gas usage. Expanded and created the Niobrara Energy Group. Thirty oil and gas companies working in Weld County so try to get ahead of problems by meeting with these companies and CDOT every other month at the County Southwest Complex. Buy America Act does not affect purchased vehicles by County. If a county receives money for vehicles purchased need to be those vehicles built in America. Example is the VanGo program which is about 400 people a day that carpool in the area but the vehicles purchased need to be made in America. County asked for a waiver and it was not approved. Currently, get congressional leaders to understand vans are Chrysler but made in Canada instead of Toyota built in America. Federal grant requires this so they do not buy vehicles with Federal money but done through RFP. PUBLIC COMMENT: Tonya Vanbeber, 41430 WCR 33, Ault, CO. Concerns regarding a business near her home. Dustin Winter, 41555 WCR 33, Ault, CO. Concerns about an IGA that has been broken by Town of Ault by the annexation of WCR 33 outside of the Town's authority. Currently, the Town of Ault has not claimed any responsibility for owning the road. Commissioner Conway responded that there are limits in terms of what the Board of County Commissioners can do as far as municipalities. As far as the road goes they will look at the road annexation statutorily and municipality assumes responsibility for the road. Commissioner Rademacher advised that he would like to investigate the particulars on this issue and they will follow up. Weld County Council Minutes December 17, 2012 Page 3 of 4 Bob Gill, Pierce, CO. Asked question as to why the Board of County Commissioners did not shut down the business due to violation. Commissioner Rademacher responded that the business started the process to become a legitimate business (go through the USR process). As long as they start the process they can keep operating through that process. Board of County Commissioners cannot enforce a municipality's rules and regulations. NEW BUSINESS: After discussion, Councilwoman Buck made a motion to appoint Bernard C. Kinnick to fill the District 2 seat until the next regular County election. The motion was seconded by Councilman Mueller and carried. Councilman Mueller made a motion to adopt Resolution 193 appointing Bernard C. Kinnick to the District 2 seat until the next regular County election. The motion was seconded by Councilman Mueller and carried. After discussion, Councilman Mueller made a motion to appoint Marge Klein for the District 3 seat until the next regular County election. The motion was seconded by Councilwoman Buck and carried. Councilman made a motion to adopt Resolution 194 appointing Marge Klein to the District 3 seat until the next regular county 2014 election. The motion was seconded by Councilwoman Buck and carried. After discussion, Councilman Mueller made a motion to set the next meeting date for January 21, 2013, and then set subsequent meeting dates at that meeting. The motion was seconded by Councilwoman Buck and carried. Coordinator reports — None.
