Dear Mrs. Clark and Council Members :
The Weld County Council , according to the media, is concerned
about the role of Mr. David, the Weld County Attorney, in
connection with the suspension of Commissioner Jacobucci .
Certain statements made in this connection need to be clarified.
The Board of County Commissioners of Weld County is concerned
about the implementation of the Home Rule Charter, and are
working hard toward that goal . When the Weld County Council
issued its order of suspension of Commissioner Jacobucci , the
Board of County Commissioners naturally was concerned as to
whether or not such action was legal . To that end, the Board
of County Commissioners directed Mr. David to research the
matter and to render an opinion upon the legality and the
enforceability of the suspension. The legality and enforceability
of the suspension was a matter of prime concern to the Board
of County Commissioners, and the legal advice of Mr. David
was, therefore, immediately sought on these questions by the
Board of County Commissioners.
Mr. David has not participated in the defense of Mr. Jacobucci
in the criminal action now pending, and will not participate
in any manner in such defense. Any statement implying that
Mr. David has assisted in the defense of Mr. Jacobucci is
simply untrue.

All work performed by Mr. David in connection with the
legality and enforceability of the suspension, has been
performed at the request of the Weld County Commissioners ,
and is a legitimate and proper role of the Weld County
Attorney.
