Cuykendall, Roggen, Colorado, requesting approval of site for the construction of a gas gathering plant and transfer terminal facilities on the following described property, to-wit: A tract of land located in the Northeast Quarter of Section 23, Township 2 North, Range 63 West of the 6th Principal Meridian, Weld County, Colorado, and being more particularly described as follows: Commencing at the North Quarter corner of said Section 23 and considering the North line of said quarter to bear North 89°55' 42" East with all bearings herein relative thereto; thence North 89°55'42" East along said North line for a distance of 330. 72 feet to a point; thence South 00°09'53" East for a distance of 288. 26 feet to the True Point of Beginning; thence continuing South 00°09'53' East for a distance of 360. 00 feet; thence North 89°55'42" East for a distance of 500. 00 feet; thence North 00° 09'53" West for a distance of 360. 00 feet; thence South 89°55' 42" West for a distance of 500. 00 feet to the True Point of Beginning. Said tract of land contains 4. 13 acres, more or less, and, WHEREAS, the petitioner was present, being represented by Mr. Robert Clair, right of way representative for Panhandle Eastern Pipe Line Company, and WHEREAS, there was no opposition to the request of petitioner for the location of said gas gathering plant and transfer terminal facilities, and WHEREAS, the said requested location for said natural gas gathering plant and supporting transfer terminal facilities is located in an agricultural zone as set forth in the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (2) of the Zoning Resolution of Weld County, said location for said natural gas gathering plant and support- ing transfer terminal facilities may be authorized upon approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Rodney H. Cuykendall, Roggen, Colorado, to locate a natural gas gathering plant and supporting transfer terminal facilities on the premises indicated above be, and it hereby is granted under the conditions following: 1. That all structures erected upon said premises be removed within one year from the time that said natural gas gathering plant and supporting transfer terminal facilities cease to operate and are closed. 5. Greeley, Colorado 80631 In Re: Application for Special Use Certificate and Planned Unit Development Certificate Gentlemen: In the past two years, exploration and drilling prospects have been undertaken in the Lost Creek Field area immediately south of Roggen in Weld County. Subsequently, there have been many successful finds of oil and natural gas in Lost Creek. To enable their gas to be marketed, the Producers of five natural gas wells in this area contracted Panhandle Eastern Pipe Line Company (PEPL) to buy their gas and construct the necessary gathering facilities to transport the gas from the wellhead. Panhandle Eastern currently has plans to construct approximately five miles of 8" diameter pipeline to these gas wells and deliver the gas at a pressure of 550# to Phillips Petroleum Company's Processing Plant three miles southwest of Roggen. To do this, PEPL must construct a booster station adjacent to the Phillips Plant to compress the gas from a wellhead pressure of about 150# to the 550# required by Phillips. It is the intent of this application to secure the referenced certificates to allow PEPL to construct the aforementioned booster station. The location of the proposed booster station is shown on the attached Exhibit "Al " reproducible drawing. The planned facilities at the station would consist of liquid retention facilities, a 700 H.P. engine-compressor unit with building, a gas pulsation dampener and measuring facility, lube oil and ambitrol storage facilities and a fenced site all as shown on the attached Exhibit "B1" drawing. Integral with each unit are gas coolers and scrubber and engine exhaust and air intake silencing equipment, all mounted on the individual unit's skidded frames. A minimum of air pollution can be expected from the exhausts of these clean burning natural gas powered gas compressors. These four units would be enclosed by a steel building specially insulated against sound emissions. This design indicates that the property line noise level would be no higher than 60 dbA with proposed facilities installed and no more than 65 dbA with the possible future facilities installed as indicated on Exhibit "Bl " - 2 - The plant will be adequately protected frcm fire hazards through installation of 150# wheeled Ansul fire extinguishers and 30# Ansul dry powder hand held extinguishers located strategically throuchout the facility. In addition, automatic emergency shut down systems for high and low temperatures and high and low pressures will be provided on each compressor unit. This station is designed for complete unattended operation; however, one or two personnel will be present for brief periods during the day to perform necessary prevenative maintenance. It is further mutually agreed that in case said premises are left vacant and any part of the rent herein reserved be due and unpaid, then the Lessor may, without in anywise being obligated to do so, and without terminating this Lease retake possession of said premises, and rent the same for such rent, and upon such conditions as the Lessor may think best, making such change and repair as may be required, giving credit for the amount of rent so received less all expenses of such changes and repairs, and said Lessee shall be liable for the balance of the rent herein reserved until the expiration of the term of this Lease. 5. The Lessee covenants and agrees to fence the leased premises with a good and sufficient fence which will prohibit Lessor's cattle from getting on the leased premises. 6. Lessee covenants and agrees that all construction on the leased premises shall be done in a manner that a minimum of damage or destruc- . tion will be done to the grass and other foliage and such ground cover that is damaged during construction shall be immediately reseeded and such other and further measures shall be taken that may be necessary to prevent wind erosion. • 7. Upon the termination of the Lease, Lessees shall remove all buildings and structures placed upon the leased premises and leave the leased premises in the same or similar conditicn as when this lease began. Before the expiration of the Lease, Lessee shall reseed all grass and other ground cover and do such other things necessary to restore the leased premises to a condition as good as that at the beginning of this Lease. IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties aforesaid, that if the rent above reserved, or any part thereof, shall be in arrears, or if default shall be made in any of the covenants or agreements herein contained, to be kept by the said Lessee, it shall and may be lawful for the said Lessor to declare said term ended, and enter into the said premises, or any part thereof, either with or without process of law, to re-enter, and the said Lessee or any other person or persons occupying the same, to expel, remove, and put out, using such force as may be neces- sary in so doing, without being liable to prosecution or in damages therefor, and the said premises again to repossess and enjoy, as in the first and former estate of the said Lessor. And if at any time said term shall be ended as aforesaid or in any other way, the said Lessee hereby covenants and agrees to surrender and deliver up said premises peaceably to said Lessor, immedi- ately upon the termination of said term, and if the Lessee shall remain in possession of the same after the termination thereof, said Lessee shall be deemed guilty of a forcible detaine_ of said premises under the statute, hereby waiving all notice, and shall be subject to eviction and removal, forcibly or otherwise, with or without process of law. as above stated. t AND it is further expressly understood and agreed that all the covenants and agreesrnents in this Lease contained shall extend to and be bind- ing upon, the heirs, executors , legal representatives and assigns of the res- pective parties thereto.
