The state mining people are making me revise one page of the application and the Notice to
the Weld County BCC to more accurately reflect (in their minds) the immediate post-approval
of the amendment for our Turnpike mining site. As you may know, the Town of Erie has built a
new wastewater treatment plant and it is located within our mining permit area. Part of the
amendment is to remove the plant site from our permit area, but that will not be done
immediately. Yes, I know it is confusing (to me to!), but there you go.
There are NO proposed industrial uses on the property as part of the reclamation plan; it
will all be returned to agricultural uses for the near future. However the treatment plant is
within the permit area and will be removed from the permit area yet this year.
Anyway, please call me at 303 994-2015 if you have any concerns. Please e-mail back a scan of
your signed and dated affidavit or fax it back to me at 720-322-7053 as soon as possible.

perm t from the olorado Mined Land Reclamation Board(the"Board")to conduct the extraction of construction materials
operations in Weld County. The attached information is being provided to notify you of the
location and nature of the proposed operation. The entire application is on file with the Division of Reclamation,Mining,and
Safety(the"Division")and the local county clerk and recorder.The applicant/operator proposes to reclaim the affected land to A1utyt ur Itracetnni use. Pursuant to
Section 34-32.5-116(4Xm),C.R.S.,the Board may confer with the local Board of County Commissioners before approving of
the post-mining land use. Accordingly,the Board would appreciate your comments on the proposed operation. Please note
that,in order to preserve your right to a hearing before the Board on this application,you must submit written comments on the
application within twenty(20)days of the date of last publication of notice pursuant to Section 34-32.5-112(10),C.R.S.

Continuation of previous amendment and Technical Revisions for mining with no expansion of
permit area but also to incorporate excess reservoir construction by-product (shale) into
reclamation plan. Subsequent to approval, will remove reservoir and facilities (Town of Erie)
from permit area and/or surety reduction.
