USR Questionnaire
1. We are currently operating a commercial water facility within an agriculturally zoned district.
We have been permitted through the State of Colorado a total of 33 acre feet of water from
the Upper Larimer Aquifer.The purpose of the facility is to supply water to oil and gas
companies to support drilling operations in the area.The existing well and possibly a second
well are located within Section 4,Township 10, Range 61 West of the 6th P.M.
2. The facility provides a necessary and valuable service to gas and oil companies in the area.The
facility is used to fill trucks with water to be used by drilling companies in the area.The water
will also be used by oil companies for dust control in the surrounding area.
3. The allocation of water in an agricultural area is appropriate and necessary due to the oil and
gas activity in the area.The current use actually reduces the impact of oil and gas operations in
the area by using local water for production, minimizing longer haul routes,which will reduce
the impact on all county roads.
4. Current land uses include mostly ranching operations. Due to the influx of oil and gas
production in the area,there are many oil and gas facilities.A local commercial water sales site
supports the oil and gas industry by reducing the impact on county roads because of shorter
hauling routes.
5. A) Approximately six(6) semi-tractor tanker drivers access the facility per day.
B) No on-site employees are required for this facility.
C) The site is operational 24 hours per day, 7 days per week.
D) Structures currently on the site include a 10 x 12 portable storage shed and four(4)
21,000 gallon frac tanks for water storage.Additional storage tanks could possibly be
added in the future for more ground water storage.There is also a possibility a lined
fresh water lagoon could be constructed on the site.A transfer pump would also have
to be installed for the lagoon.The lagoon will be an alternate form of water storage and
would not affect the average loads per day.

F) Vehicles accessing the site are semi-tractor tankers hauling 3,000 to 7,500 gallon tanks
weighing approximately 40,000 to 80,000 pounds and are 25 feet to 60 feet long.The
daily average amount of trucks accessing the site is six(6) per day and could possibly
increase to twelve (12) loads per day if a second well is constructed. Eighty (80) percent
of truck traffic comes from the west on WCR 122, and the remaining twenty(20)
percent of the truck traffic comes from the east.
G) Pawnee Fire Protection District.
H) Domestic water is not needed on the site. Drivers should spend less than 20 minutes at
the site.There is no irrigation on the property.
I) Sewer system is not needed at the site. Drivers should be at the site less than 20
minutes during load out operations.A request for a waiver of water and septic systems
will be requested.
J) Water storage tanks.
6. No landscaping appears to be needed and none is proposed at this time.
7. If the facility were to cease operation the tanks and equipment would be removed.The
property would be reclaimed to natural grasslands.
8. The contour of the property allows for natural drainage of storm water.Storm water originates
form the north property line and flows southeasterly across the property. It follows a natural
drainage to the southeast as it leaves the property. No storm drainage issues have occurred on
the property.
9. Truck pad for loading has already been constructed. No landscaping is proposed.
10. A trash receptacle with a lid will be on site and will be taken to applicant's residence and
disposed of by Waste Management as needed.
WASTE HANDLING PLAN NARRATIVE

Potential wastes to be generated at the facility would consist of household only. Trash
receptacles will be located at the facility during water load out operations. Trash will be
contained within fully enclosed containers 24 hours a day, and will be disposed of
weekly or as needed at applicants residence by Waste Management. A waiver will be
requested for water and sewer due to the short period of time drivers will be on the
site, which would be 20 minutes or less.
TRAFFIC NARRATIVE

Traffic flowing into the access point will be from WCR 122, which runs east and west. An
average of six (6) semi-trucks will access the facility per day. If the second permitted well is
constructed on the site, there could possibly be twelve (12) trucks accessing the site per day.
Eighty(80) percent of the trucks will arrive and depart to the west, and twenty (20) percent will
arrive and depart from the east. These percentages could change depending on the location of
oil field development in the area.
There is a 30 foot access easement across adjacent lot for trucks to access Lot B (water dock).
DUST MITIGATION PLAN NARRATIVE

On-site vehicle speeds will be restricted to reduce the amount of dust generated. The
on-site driveway and loading area will be watered for dust control as needed. Weld
County Road 122 adjacent to the water loading area will also be watered for dust
control as needed.

B22 ACCESS AND UTILITY EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
The undersigned, Douglas K. Duggan and Deborah S. Duggan, owners of the legal and
equitable title to the following described real estate, hereafter referred to as "Grantor",
for and in consideration of value received, the receipt of which is hereby
acknowledged, does grant and convey to the Town of Grover, hereafter referred to as
"Grantee", an access and utility easement through, over, under and across a parcel of
land located in the Northwest Quarter of Section 4, Township 10 North, Range 61
West of the 6th P.M., City of Grover, County of Weld, State of Colorado, being more
particularly described as below as "The Easement".
The Term and Consideration
Grant of Easement: The following described easement is granted for a term of
ninety-nine (99) years from the date of recording.
Covenants of the Town of Grover ("Town").
1) The Town agrees to provide Grantor 325,000 gallons of treated water per
year to be applied by Grantor in such manner and at such times as determined
by Grantor in its sole discretion. Any amount in excess of 325,000 consumed in
any calendar year shall be paid for at the established municipal residential rate.
2) Grantor shall have the right to use the water in the sewer lagoon for
irrigation use.
3) The Town will install a meter pit from their fresh water supply at the sewer
plant site.
4) The Town will pay the sum of$6,000 to Grantor for the purchase equipment,
materials and labor for installation of the water lines, hydrants and tanks.
5.) Grantor shall indemnify, hold harmless and defend the Town from and
against any and all liabilities, claims, penalties, forfeitures or suits, and the
costs and expenses incident thereto, including reasonable attorney's fees which
may hereafter arise as a result of any injury to any person, destruction or
damage to any property including livestock, contamination of or adverse effects
on the environment, or any violation of laws, regulations or orders and assumes
all risk inherent in or resulting from its use of Town water provided hereunder.
6) The Town shall be exclusively responsible for the installation and
maintenance of the fence around the circumference of the lagoon.

employees, and/or all persons under contact with them, the right to enter upon and
travel across said premises and strip of land for the purpose of surveying, excavating

The undersigned, GRANTORS, for themselves, and their heirs, administrators,
successors, assigns, covenant and agree that no building, structure, or other above or
below ground obstruction that will interfere with the purposes aforesaid, will be placed,
erected, installed, or permitted upon the above described premises and further
