The Weld County Public Works Department has reviewed this proposal. Staff comments made during this
phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process. Issues of concern must be resolved with the Public Works Department. Our comments
and requirements are as follows:
REQUIREMENTS:
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum
height of 12 inches until the area is completely developed.
•The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway
257) This section has been annexed by the Town of Windsor.
This area is not in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).

Environmental Health Services has reviewed this proposal to rezone Lot B Amended
Recorded Exemption RE-1452 from Planned Unit Development to the Agricultural Zone
District. The lot is vacant and an individual sewage disposal system and a tap from
North Weld County Water District will be installed when a residence is constructed.
The following conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage Disposal
• Regulations. Please note, the lot owners shall verify with the nearest Town/City
or Sanitation District to determine the location of the nearest sewer line. In
accordance with the Weld County Code, if a sewer line exists within 400 feet of
the property and the sewer provider is willing to serve the proposed structure, a
septic permit cannot be granted by the Weld County Department of Public Health
and Environment.

Comments: 1. A building permit shall be obtained prior to the construction of any new structures.
2. A plan review is required for each building or structure for which a building permit is required. Buildings,
structures and use shall conform to the requirements of the various codes adopted at the time of acceptance of
the permit application. Currently the following codes have been adopted by Weld County. 2006 IRC,IBC; 'MC,
IPC; IECC; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility and Chapter 29 of the Weld County
Code.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2006 International Building Code: 2006 International
Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2008 National
Electrical Code and Chapter 29 of the Weld County Code.

The above referenced Change of Zone application is proposed for approximately 71 acres east of and
adjacent to Highway 257 and north of Weld County Road 72. From reviewing the materials
provided, it appears that the application is requesting the existing zoning of PUD be changed to
Agriculture. It appears that the property will eventually still be utilized for estate residences. Given
this information, the District does not object to the Change of Zone. However, the School District
requests to be notified of any proposed land use changes associated with this property as there will be
future impact to the school district. Your continuing cooperation is sincerely appreciated, as is the

Dear Mr. Perko:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of December 21,
2011. The subject property is depicted as High Density Estate Single Family Residential on the Town's Land
Use Plan Map. The Windsor Comprehensive Plan states that the High Density Estate Single Family
Residential land use depiction is intended to provide for clustered single-family residential subdivision
development while preserving open space. Section 16-14-50 of the Town of Windsor Municipal Code
requires that all lots within any subdivision containing individual sewage disposal systems contain a minimum
lot size of two and one-half(2%)acres. This application proposes one lot with a single-family residence and
a septic system. Since the lot exceeds the two and one-half(2%)acre minimum size requirement it appears
that this application is consistent with the Town's Land Use Plan map.

The subject property is located within the Town's Growth Management Area (GMA) and the Town of Windsor
Comprehensive Plan states, "The GMA is intended to define those specific areas within the planning area
where it is most logical to extend urban services in the near term, that is, within the next five to ten years."
Although the subject property is located within the GMA, it would not be feasible to extend Town services to
the area in order to serve such a low density. Therefore, staff does not recommend that annexation be
required at this time. However, should the subject property be proposed for urban level development in the
future, the owner should contact the Town regarding annexation and provision of urban level services in
accordance with the Town of Windsor Comprehensive Plan.
Therefore, the Town of Windsor Planning Commission recommends approval to the Weld County
Department of Planning Services subject to the applicant dedicating additional right-of-way along the entire
length of the west property line to bring the east half of SH 257 up to CDOT's required right-of-way standards.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the water
supply plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a viable water

supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
The application is to change the zoning of Lot B RE-1452, a 70.95 acre parcel, from PUD to A
(Agricultural). The proposed water supply is North Weld County Water District (North Weld). North
Weld provided a "can serve" letter for the property. This office has no objection to the proposal if North
Weld provides the water supply.
