SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS
(OUTDOOR STORAGE), PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN
APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN
FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING
SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - NORTH WELD
COUNTY WATER DISTRICT
A public hearing was conducted on April 18, 2012, at 10:00 a.m., with the following present:
Commissioner Sean P. Conway, Chair
Commissioner William F. Garcia, Pro-Tern

Commissioner David E. Long
Commissioner Douglas Rademacher

The following business was transacted:
I hereby certify that pursuant to a notice dated March 16, 2012, and duly published March 21,
2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of the
North Weld County Water District, for a Site Specific Development Plan and Use by Special
Review Permit, USR12-0002, for an Oil and Gas Support and Service (water hauling) and any
Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial
or Industrial Zone Districts (outdoor storage), provided that the property is not a lot in an
approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District.
El Chair Conway advised the public that one of the Commissioners will need to be excused
from the proceedings at 12:00 p.m. Commissioner Kirkmeyer explained one of the cases
(USR12-0003) is within her District and she would like to be in attendance and she apologized
for any inconvenience a continuance may cause. Chair Conway indicated the Board will hear
USR12-0002 first and then proceed with USR12-0003, which will likely result in a continuance.

ID Tom Parko, Department of Planning Services, presented a summary of the proposal, gave
a brief description of the location of the site, entered the favorable recommendation of the
Planning Commission into the record as written, and displayed aerial maps and photographs of
the site and surrounding area.
El Heidi Hansen, Department of Public Works, stated the site is accessed from County Road
(CR) 88, which requires 60 feet of right-of-way at full buildout. She stated the average daily
traffic count is 211 vehicles, and this site is intended to eliminate much of the traffic in the area.
She further stated the Road Maintenance Agreement will alleviate many of the concerns and the
engineered traffic study has been waived.
e Lauren Light, Department of Public Health and Environment, explained staff requested the
facility provide permanent restroom facilities; however, the Planning Commission added
language to Development Standard #11 to allow portable toilets and deleted Condition of
Approval #1.B. She noted the deletion was inadvertently left in the Draft Resolution and should
be deleted. She further stated the site will be surfaced with gravel and water will be applied for
dust.
El Leanne Kuntz, Engineering Assistant, represented the applicant and requested the Board
waive the portable toilet requirement, since the truck drivers are only on the site for 30 to 40
minutes and they have access to a restroom facility three miles south of the site at a
convenience store in the Town of Ault.
e The Board expressed concern with the request.
IR No public testimony was offered concerning this matter.
e The Board indicated agreement with deleting Condition of Approval #1.B. Ms. Light
indicated the site would only be required to have one portable toilet and the Board indicated
agreement with retaining Development Standard #11 as recommended by the Planning
Commission. Ms. Kuntz indicated the applicant has reviewed, and agrees to abide by, the
Conditions of Approval and Development Standards, as proposed and modified.
IR Commissioner Kirkmeyer moved to approve the request of the North Weld County Water
District for a Site Specific Development Plan and Use by Special Review Permit, USR12-0002,
for an Oil and Gas Support and Service (water hauling) and any Use permitted as a Use by
Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts
(outdoor storage), provided that the property is not a lot in an approved or recorded subdivision
plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in
the A (Agricultural) Zone District, based on the recommendations of Planning staff and the
Planning Commission, with the Conditions of Approval and Development Standards as entered
into the record. Her motion included the deletion of Condition of Approval #1.B. The motion
was seconded by Commissioner Long, and it carried unanimously. There being no further
discussion, the hearing was completed at 11:16 a.m.
