Application for Use by Special Review
1. Description of Proposed Use:
This USR application is referred to as the C&H Fabrication Facility USR application and is
submitted from C&H Excavation, LLC. The site is approximately 3.5 acres in size and
located 0.5 mile north of the intersection of WCR 84 and WCR 33 and 1.5 mile north of the
intersection of SH 14 and WCR 33. The site is in the A-Agricultural zone district. The
applicant is proposing to use the property as an equipment manufacturing facility, including
but not limited to the manufacturing of crossover stairs, cattle guards and large water tanks
once assembled capable of holding up to 5-acre feet of water. The proposed improvements
include:
• Lean-to: north side of property approximately 450 feet in length and 15 feet high
• 8-foot solid fence on north side from lean-to west
• 6-foot solid fence on east side
The existing building will remain on the site. A storage area for raw materials and finished
product awaiting transportation is proposed along the north property line (within and adjacent
to the lean to) and along the east property line, behind the building. The facility will not
include any painting, all painting work will be performed in an offsite facility in Ault.
Please see the Site Plan in the Appendix for a detailed layout of the site including existing
and proposed improvements.
The proposed facility is to operate between the hours of 6 a.m. and 10 p.m. Monday through
Friday.
Site access is via an existing private driveway on WCR 33, approximately 0.45 miles north
of the WCR 33 and WCR 84 intersection and 0.55 miles south of the WCR 33 and WCR 86
intersection. WCR 84 and WCR 86 are easily accessible from HWY 85.

2. Consistency with the intent of the Weld County Code,Chapter 22 of the
Comprehensive Plan
Comprehensive Plan Consistency
Section 22-2-10 (D) emphasizes to ensure that adequate services and facilities are currently
available or reasonably obtainable to accommodate the requested new land use change for
more intensive development. Weld County has been physically and economically developing
through Oil and Gas businesses. The proposed facility contributes to the county's oil and gas
business by providing fabrication services of oilfield equipment.
The Comprehensive Plan also addresses the presence of oil and gas deposits in the County
and addresses goals and policies to have supporting utilities, public services and related
facilities for any industrial development. The proposed facility will assist the existing oil and
gas businesses in the County by fabricating oilfield equipment.
3. Consistency with the intent of the Weld County Code, Chapter 23 (Zoning) and the
zone district in which it is located.
Section 23-3-40 (S) states that any use permitted as a Use by Right, an Accessory Use, or a
Use by Special Review in the commercial or industrial zone districts may be constructed,
occupied, operated and maintained in the A (Agricultural) Zone District upon approval of a
permit in accordance with the requirements and procedures
Section 23-3-310 (B) Uses Allowed by Right in the I-1 Industrial Zone District addresses that
any use of a research, repairing, manufacturing, fabricating, processing, assembling or
storage nature may be conducted in the 1-1 Zone District as long as such use is conducted
only within enclosed buildings.
Section 23-3-320 (B) Uses Allowed by Right in the 1-2 Industrial Zone District also addresses
that any use of a research, repairing, manufacturing, fabricating, processing, assembling
or storage nature may be conducted in the I-2 Zone District. The uses identified may be
conducted outside of an enclosed building, provided that the use and/or operations of the use
are screened from adjacent public rights-of-way and adjacent properties.
The proposed oilfield equipment fabricating facility may be permitted regarding its
compliance with the County Code. A Use by Special Review Permit is required for the
proposed development in A (Agriculture) Zone District.
4. Surrounding Uses and Compatibility with surrounding uses.
The proposed fabrication facility is mainly surrounded by agricultural lands. A feed lot
operation is located approximately 0.5 miles to the southeast. Several residences are located
nearby. Consideration has been taken to ensure that the facility will operate in a manner that
is compatible with existing and planned uses in the area.

5. Describe the following:
a. Number of people who will use this site
Currently up to 18 employees per shift will report to this site in addition to the
average two deliveries of raw materials per week and an average of three to four
shipments per week of finished product from the site.

Approximately 18 employees per shift will be employed on this site, with two shifts.
• Office staff: 4-5
• Shop workers: 13-14

• 6 a.m. to 10 p.m. Monday through Friday

The proposed use will use all existing buildings on site together with a "lean-to"
along the north side of the property approximately 450 feet in length (commencing at
the east lot line) and 15 feet high. In addition, a solid fence would be built along the
north side of the property west of the lean-to. Finally, a 6-foot solid fence will be
constructed along the east property line of the property. The proposed lean-to would
be of a color complimentary to the structures on the property of the neighbor to the
north of the site
e. Type and number of animals, if any, to be on this site
There will be no animals on site.
f Kind of vehicles that will access this site and how often
On a daily basis approximately 18 employees per shift will access the site using
personal vehicles. Weekly, an average of six tractors with semi or flatbed trailers will
pick up and deliver items to the site.
g. Who will provide fire protection to the site
Ault Fire Protection District provides fire protection to this site. A referral packet
will be sent to the District by the County. Once an approval letter is received it will
be placed in the Appendix.
h. Water source on the property
Water will be provided from an existing well on the site. The well's permit number is
286516.
L Sewage disposal system
There is an existing septic permit on site, permit number is G19820005. A new
system designed to be used by the site employees will be designed and permitted.

j. Storage or warehousing
Raw materials delivered during the week will be stored pending fabrication into
products manufactured by applicant. Finished product will be staged awaiting
shipment.
6. Proposed Landscaping
There is no existing screening and no additional landscaping is being proposed with this
application.
7. Reclamation procedures
Should the fabrication business no longer be needed by the respective businesses, all
equipment will be removed and the ground re-graded to accommodate agricultural uses.
8. Storm Water Drainage
The site drains generally from west to east. A WQCVF is proposed in the northeast corner of
the site. Please refer to the drainage memo in the appendix for more detail on the proposed
storm water facilities.
9. Construction period
Construction of improvements will take place following the approval of USR permit.
10. Waste Handling Plan
Paper waste and refuse will be stored on site in commercial containers and removed by a
commercial rubbish handler. All scrap metal will be sold to a metal recycler. There will be no
painting performed on site. The waste handler contracted to pick up refuse at this site is
Waste Management. Scrap metal removal is handled by Andersen's Salvage.
11. Dust Abatement Plan
The drive into the location is recycled concrete. Should dust exist on site from vehicles, C&H
will first apply water as abatement. Should this not be effective, Magnesium Chloride will be
applied to all dust causing areas.

1. Notification Requirements
In accordance with Section 23-2-260 (B) (9) of the Weld County Code a certified list of the
names and addresses of the owners of property within 500 feet of the subject property is
listed below and provided in the Appendix. The County is responsible for mailing the notice.

2. Operation Standards
NOISE CONTROL:
Some noise may at times be emitted from the fabrication operations. Operations are
scheduled in an attempt to perform the majority of fabrication inside the building or on the
east side of the building. Additionally, the rural nature of the site is preferred to mitigate the
effects of noise emissions on the surrounding property owners.
AIR AND WATER QUALITY:
All activities will be in compliance with the permit and control provisions of the Colorado
Air Quality Control Program, Title 25, Article 7, C.R.S. as applicable. A septic system is
located on site. No waste water from the production facility will be discharged within the
site. All waste is carried by vehicle off the site.
LIGHTING:
Lighting exists on the building. Lighting is for nighttime and emergency work only.
Any new source of lighting on the site shall be shielded so that light will not shine directly
onto adjacent properties where such would cause a nuisance or interfere with the use on the
adjacent properties. In addition, neither direct nor reflected light from any light source on
site will create a traffic hazard to operators of motor vehicles on the adjacent access road.
WEED CONTROL:
The fabrication operations site will be kept free of weeds, rubbish, and other waste material.
The area shall be treated if necessary and as practicable to prevent invasion of undesirable
species and noxious weeds.

3. Required Permits
Weld County:
A Use by Special Review Permit is required to be approved by the Board of County
Commissioners for this facility.
C&H Excavation, LLC will submit any additional permits necessary for County approval
prior to the commencement of construction on site.
Ault Fire Protection District:
The Site Plan and Special Review Use Application will be referred to and reviewed by the
Ault Fire Protection District. Approval of the plans is expected. A letter from the fire district
regarding this proposal will be added to the Appendix once it is received.
4. Traffic
A Traffic Memorandum is provided in the appendix of this application.
5. Fire & Emergency Response
There is adequate provision for the protection of the health, safety and welfare of the
inhabitants of the immediate area and the county.
All roads leading to and those in the site area will be designed and maintained to support fire
apparatus. Ample room for a turnaround is available to accommodate fire apparatus.
Emergency response is provided by the Ault Fire Protection District and the Weld County
Sheriff.

OVERVIEW
This traffic memo is prepared to accompany the USR permit application for the oil field services fabrication
uses proposed by C&H Excavation, LLC at 41450 WCR 33 in Ault,Colorado. This memo provides an overview
of the long term traffic associated with this site.
BACKGROUND
Access to the site is located on WCR 33 via an existing driveway. The site is located approximately 0.45
miles north of the intersection of WCR 84 and WCR 33 and 0.55 miles south of the intersection of WCR
86 and WCR 33 northeast of Ault. WCR 33 is an all-weather asphalt paved road. East-west traffic on WCR
84 is controlled by a stop sign at WCR 33. WCR 84 is paved east of WCR 33 and gravel west of WCR 33.
East-west traffic on WCR 86 is controlled by a stop sign at WCR 33. WCR 86 is paved on both sides of
WCR 33. All roads have 60' of right-of-way. SH 14 is located approximately 1.45 miles south of the site.
Access from WCR 33 to SH 14 is controlled via stop sign.
The use on the site consists of office, storage, parking, and the fabrication of oil field equipment
including but not limited to crossover stairs, cattle guards, and large water tanks. These uses are
existing uses and no new buildings are proposed with this application. This memo assesses current
traffic generation associated with the site operations.
All vehicles must enter the site from WCR 33. Some vehicles may come from the north (US 85 via WCR
86)or from the south (US 85 via WCR 84).
TRIP GENERATION

The following vehicle summaries have been used to determine the anticipated traffic generation
numbers:

TRIP DISTRIBUTION
Approximately 20%of operational vehicles exiting the site during an average day will exit north on WCR
33 towards Pierce and WCR 86 and 80%will exit south on WCR 33 towards WCR 84 and SH 14.All
employees will utilize this same route to access the site on a daily basis.Similarly,deliveries will also
access the site from WCR 33.
CONCLUSION
The ongoing use of the site and associated traffic is consistent with the existing uses on surrounding
properties and existing traffic on WCR 33.The Intersections of WCR 33 at WCR 84 and WCR 86 have a stop
control on the side roads and adequate tine of site for proposed traffic volumes.
The access and use of the site as fabrication should not create any adverse impacts on the surrounding road
network.

Re: Drainage Letter—C&H Excavation LLC USR
Ms. Hansen,
The purpose of this letter is to document drainage conditions associated with the C&H
Excavation LLC Use by Special Review Permit application.
Background
The site is located in the SW 1/4 of Section 2,Township 7 North, Range 66 West of the 6th P.M.,
Weld County, Colorado. The project entails the conversion of an existing onion processing plant
site into a manufacturing facility. The site is 3.5 ± acres. This site is within Parcel No.
070702300061; Lot B of AMRE-991. The site is not located within a FEMA designated
floodplain. Refer to the USR Maps for more information.
The site slopes generally from Southwest to Northeast at approximately 0.1%.
Storm Water Quality
An on-site storm water depression is proposed to capture storm water runoff from the site.
Attached are supporting calculations for sizing of the required storm water quality capture
volume.
The WQCV is calculated as a function of imperviousness and BMP drain time using the
equation:
WQCV=a(0.91/3-1.19/2+0.78/)
WQCV= Water Quality Capture Volume(watershed inches)
a—Coefficient corresponding to WQCV drain time
/= Imperviousness
Watershed inches are then converted to acre-ft by multiplying by the project area and dividing by
12. The imperviousness of the site will be 0.4. The required storage is 0.052 acre-feet or 2277
cubic feet. The storm water depression area will be located to the northeast of the proposed site
of construction and will be 1.5 feet deep. An existing diversion berm along the North edge of the
site,and a swale that will be constructed along the East edge of the site will work in conjunction
to direct water flow toward the storm water depression(see the USR plans for more
information).

Conclusion
The proposed C&H Excavation LLC site will not have any impacts on existing drainage patterns
or adversely affect downstream properties or structures.

Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with long—standing agricultural practices and a lower level of F-
services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: J
open views, spaciousness, wildlife, lock of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring forms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Q
Agricultural users of the land should not be expected to change their long—established agricultural practices to accommodate the CON TACTS
intrusions of urban users into a rural area. Well—run agricultural activities will generate off—site impacts, including noise from
tractors and equipment; slow—moving farm vehicles on rural roads; dust from animal pens, field work, harvest and grovel roads;
