SUBJECT: USR12-0009, Tri-State Transmission Line
A Use by Special Review permit for an electrical transmission line from Kersey West to South
Kersey 115-kV.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
The project generally runs along CR 51 in private easements. Any new accesses to the County roadways
require an approved Access Permit(the application form is available on the Public Works website).
Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970) 304-6496 ext. 3764 for a
Right-of-Way permit for any work that may be required in the County Right-of-Way. A special transport
permit will be required for any oversized or overweight vehicles that may access the site and may be
obtained by contacting Amy as well.
• In the event that 1 or more acres are disturbed during the construction and development of this site, the
applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and Environment.
If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction.
The grading permit application must contain: an erosion and sediment control plan, a grading plan,
installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be
utilized, and a copy of the approved CDPHE stormwater permit.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. An Access Permit is required for any new accesses to the County roadways.
2. Contact the Public Works Utility Coordinator at (970) 304-6496 ext. 3764 for a Right-of-Way
permit for any work that may be required in the County Right-of-Way.
3. A special transport permit will be required for any oversized or overweight vehicles that may
access the site during construction.
4. In the event that 1 or more acres are disturbed during the construction and development of this
site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control
Division of the Colorado Department of Public Health and Environment.

• 6. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. The applicant is required to comply with all Colorado Department of Health and
Environment, Water Quality Control Division regulations regarding storm water quality
permitting and protection and construction storm water discharges.

Environmental Health Services has reviewed this proposal for construction of a two mile
115 KV transmission line. Permanent water and sewer is not required as this is a
temporary construction use. Portable toilets, hand washing units and bottled water can
be utilized during construction of the pipeline.
The application indicates that dust production will be monitored and dust suppression,
consisting of applying water and revegetation of disturbed areas, will be utilized as
necessary. An Air Pollution Emission Notice (APEN) may be required as the amount of
• disturbed area exceeds 25 acres.
Waste will be kept in enclosed containers and taken to a disposal facility.
We have no objections to the proposal; however, we recommend that the following
requirement be incorporated into the permit as a condition that must be met one month
prior to construction activities:
The applicant shall submit evidence of an Air Pollution Emission Notice (APEN)
application from the Air Pollution Control Division, Colorado Department of
Health and Environment. Alternately, the applicant can provide evidence from
the APCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.

• 2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled along the
construction route.
5. Adequate toilet facilities (portable toilets) and handwashing units shall be
provided during construction of the project.
6. Bottled water shall be utilized for drinking during construction of the project.
7. Environmental Protection Measures for Construction Projects, as identified in
Appendix B of the application, shall be adhered to.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.
• 9. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control

10.The operation shall comply with all applicable rules and regulations of the State

proposals through the submittal of FAA Form 7460-1, Notice of Proposed
Construction or Alteration. If any portion of the proposal is located

above ground level at any location, the FAA requires the project's

If any work requires the discharge of dredged or fill material, and any excavation associated with a dredged or
fill project, either temporary or permanent in an aquatic site, which may include ephemeral and perennial
streams, wetlands, lakes, ponds, drainage ditches and irrigation ditches, this office should be notified by a
proponent of the project for Department of the Army permits, changes in permit requirements or jurisdictional
determinations pursuant to Section 404 of the Clean Water Act.
Work in an aquatic site should be identified by the proponent of the project and be shown on a map identifying
the Quarter Section, Township, Range and County or Latitude and Longitude, Decimal Degrees (datum NAD
83) and the dimensions of work in each aquatic site. Any loss of an aquatic site may require mitigation.
Mitigation requirements will be determined during the Department of the Army permitting review.
